32C-177 (18) maintaining the Leased Premises pursuant to the laws and building codes applicable to the City of Northampton and the Commonwealth of Massachusetts. Landlord may inspect the Leased Premises upon acceptable reasonable notice in the presence of Tenant at times when patient care will not be disturbed. In the case of emergencies, Landlord may enter without notice. If repairs are required to be made by Tenant pursuant to the terms hereof, Landlord may demand that Tenant make the same forthwith,and if Tenant refuses or neglects to commence such repairs and complete the same within a reasonable time, Landlord may(but shall not be required to do so)make or cause such repairs to be made and shall not be responsible to Tenant for any loss or damage that may accrue to Tenant's property or business by reason thereof. If Landlord makes or causes such repairs to be made, Tenant agrees that Tenant will forthwith on demand pay to Landlord the cost thereof as additional rent, together with interest at eighteen percent(18%) from the date of such demand. The Tenant agrees to accept the Leased Premises"as is",knowing and willing to repair,replace, alter, any make improvements to any and all conditions desired. Section 3.3 -Alterations to the Leased Premises. Tenant may make alterations to the Leased Premises provided such alterations first approved by Landlord, which approval shall not be withheld unreasonably. Tenant shall have sole responsibility for the cost of such alterations. All construction work permitted by this Section 3.3 shall be done in a good and workmanlike manner and in compliance with all applicable laws and all lawful ordinances, regulations and orders of Governmental authority and insurers of the Leased Premises. Tenant shall obtain all state and local permits required before commencing construction of such improvements. Landlord may(but without any implied obligation to do so) inspect the work of Tenant at reasonable times and shall give notice of observed defects. Tenant agrees not to cause or permit any liens for labor or materials performed or furnished in connection therewith to attach to the Leased Premises. All improvements constructed in the Leased Premises at any time during the Term or any extension thereof shall be and remain a part of the real estate, notwithstanding the fact that Tenant may pay for all or part of the construction thereof, and at the termination of this Lease, whether by expiration of time or other- wise, Tenant shall surrender to Landlord the Leased Premises with all improvements therein in good condition, ordinary wear and tear and casualty due to circumstances beyond Tenant's control excepted. Section 3.4- Snow Removal. Tenant shall be responsible for snow removal from the entryways and parking lots adjacent to the Building used by Tenant,and its employees and visitors. Tenant shall pay for the expense of such snow removal. Tenant is responsible for the removal of snow and ice on the Holyoke Street sidewalk and entrance. Tenant is responsible for sanding and salting of the same area. Section 3.5 —Trash Removal. Tenant shall remove and pay for all trash removal generated by its activities. Landlord shall permit Tenant to locate a dumpster and/or trash containers, at Tenant's cost, on the south or east side(rear) of the property, as designated by landlord. Tenant shall pay its pro rata share(22.1%) of Landlord's expense to remove any trash located on the property after notification and if landlord must remove any trash, regardless of source or cause of such trash.
