The general conditions for granting a special permit under the
zoning ordinance will be satisfied by this proposed building due
to the following reasons:
1. The proposed restaurant will provide a wholesome product that
obviously bears a positive relationship to the public
convenience and welfare.
2. The requested use will not create undue traffic congestion,
or impair pedestrian safety, because the increased parking
will help reduce congestion and will facilitate traffic
movement.
3. The requested use will not overload municipal systems, since
a restaurant currently exists on the site.
4. The requested use is currently existing and its nature of use
has a positive effect on the community's health and welfare.

The required parkin for the proposed restaurant is 54
parking spaces. The parking area on parcel 329 is approximately
32 spaces, which means that 22 additional spaces are needed to
satisfy the zoning ordinances. Under the lease agreement a total
of 67 spaces would be available on both sites which is well above
what is required.
Initially an offer to purchase the Massachusetts Electric
Company parcel was made but they would only agree to a lease
arrangement which is renewable on a yearly basis. The electric
company's concern is for possible expansion of their electric
substation. If Massachusetts Electric does expand their power
station in the future, it is anticipated that they would use only
a mirror portion of the leased parking space. Every effort would
be made to continue the lease, which would enable Wendy's to meet
all Northampton zoning codes. In the unlikely event that no
leased land is available in the future, the options would be to
apply for relief of some degree with a variance reduce the number
of seats or some combination of the two.

ASSISTANT CITY SOLICITOR
On June 15, 1977, the Zoning Board of Appeals for the City of
Northampton decided to grant the petition of Cumberland 77, Inc. for
a special permit to allow parking spaces on an adjoining lot to meet
the zoning ordinance parking requirements for a restaurant of 72
person capacity.
Based upon evidence presented to the Board, the Board made the
following findings:
(1) The use requested is listed in the Table of Use Regulations
as a special permit in the district for which application is made or
is so designated elsewhere in this Ordinance. See section $.7.
(2) The requested use bears a positive relationship to the public
convenience or welfare.
(3) The requested use will not create undue traffic congestion,
or unduly impair pedestrian safety. The location of the proposed res-
taurant is on King Street which is already a heavily traveled way;
however, the increase in traffic will not be appreciable.
(4.) The requested use will not overload any public water, drainage,
or sewer system or any other municipal system to such an extent that the
requested use or any developed use in the immediate area or in any other
area of the City will be unduly subjected to hazards affecting health,
safety, or the general welfare.
(5) Any special regulations for the use, set forth in Article XI,
are fulfilled.
(6) The requested use will not unduly impair the integrity or
character of the district or adjoining zones, nor be detrimental to
the health, morals, or welfare.
The following conditions shall apply to this special permit: In
the event the Electric Company cancels the lease with Cumberland 77,
Inc. the seating capacity of the restaurant shall be reduced proportion-
ately to conform to the zoning ordinance parking requirement applicable
at the time of cancellation.
