You may cancel this agreement if it has been signed by a party thereto at a place other than
an address of the seller, which may be his main office or branch thereof, provided you notify
the seller in writing at his main office or branch by ordinary mail posted, by telegram sent or
by delivery, not later than midnight of the third business day following the signing of the
agreement. No work shall begin until both parties sign the contract and the owner has a
copy of the contract.
Before agreeing to any home improvement work on your residence you should obtain a free

The homeowner has three -day cancellation rights under MGL c 93 s 48; MGL c 140D s 10 or MGL
c 255D s 14 as may be applicable.

SERVICES PROVIDED BY HOMEOWNER
The Homeowner /Building owner is to provide electricity and water at no additional expense to the
Contractor. The homeowner will also provide or pay for a portable toilet. (see attached estimate)
Objects hanging on walls:
• Fragile items on or near tables, walls, ceilings, etc. should be removed
prior to construction. Contractor is not responsible for items that fall off
the walls, ceiling, etc. during construction.
The following schedule will be adhered to unless circumstances beyond the contractor's control arise:
Work Scheduled To Begin: January 21, 2013
Expected Date of Completion: February 15, 2013 (Adverse weather will extend this date.)
Please note construction projects of this scope can be delayed due to supplies, weather and
unexpected and unforeseen problems. However, the Contractor intends to work in a
continuous manner until project completion (i.e., minimum of 4 ten -hour days per standard
work week). Some work may be completed on Saturdays or Sundays due to weather.
TIME AND MATERIALS CONTRACT:
The Contractor agrees to perform the work, equipment specified above for the
SUM of: $ $23.078.13 (Price does not include change orders, materials or
unforeseen problems)
PAYMENT SCHEDULE
Homeowner agrees to make payments and shall be made according to the following SCHEDULE:
• 10% ($2307.81)due at signing of contract;
• 30% ($6,923.44) due at start of work (expected start date January 21, 2013)
• 30% ($6,923.44)due when bathroom has been gutted, new floor joists installed where
applicable, and new sub -floor installed;
• 20% ($4,615.63) due when rough plumbing and rough electrical work completed
• 10% ($2,307.81) or final amount due at completion of project.
NOTE: Failure to make payments ceases all work. Detailed invoices shall be provided to the
homeowner.

SCOPE OF WORK
1. Remove all plaster in shower and bathroom (as needed) and prep for tile work. Cortina Tile,
contracted by homeowner to install backer board;
2. Coordinate with Plumber and install Temporary toilet;
3. Coordinate with Electrician
4. Install shelf in shower unit, Cortina Tile to cover with bath tile and bull nose;
5. Replace drywall in areas as needed;
6. Replace door and window trim, as needed.
7. Other tasks as necessary to complete project.

MATERIALS FOR THE PROJECT

2. Bath Vanity has been ordered, anticipated delivery February 8, 2013.
UNEXPECTED and UNFORESEEN PROBLEMS
If the Contractor observes problems such as rot, bug infestation or other unknown or unforeseen
problems, the Contractor will inform Homeowner immediately. Repairs will be completed at direct
cost for materials and at an hourly rate of $35.00 per hour per employee. Additional repairs will
require 30% deposit upfront and balance due upon completion of additional work. Homeowner(s)
or Building Owner understands that rot or other problems will cause a delay with completing the
overall scope of work and is not the fault of the Contractor.

The current exemption for "homeowners" was extended to include Owner- occupied Dwellings of one (1) or two(2) families
and to allow such homeowner to engage an individual for hire who does not possess a license, provided that the owner acts
as supervisor. CMR 780, Sixth Edition Section 108.3.5.1.
Definition of Homeowner: Person (s) who own a parcel of land on which he /she resides or intends to reside on which there
is, or is intended to be, a one or two family dwelling, attached or detached structures accessory to such use and/ or farm
structures. A person who constructs more than one home in a two -year period shall not be considered a homeowner.
