32C-021 (3) IBC SECTION 303 ASSEMBLY GROUP A 303.1 Assembly Group A. Assembly Group A occupancy includes, among others, the use of a building or structure, or a portion thereof, for the gathering of persons for purposes such as civic, social or religious functions; recreation, food or drink consumption or awaiting transportation. Massachusetts Amendment 303.1.1 Add section: 303.1.1 Definitions. NIGHT CLUB. An occupancy generally characterized by a combination of any of the following: no theatrical stage accessories other than raised platform; low lighting levels; entertainment by a live band or recorded music generating above - normal sound levels; later -than average operating hours; tables and seating arranged or positioned so as to create ill defined aisles; a specific area designated for dancing; service facilities for alcoholic beverages with limited food service; and high occupant load density. A -1 Assembly uses, usually with fixed seating, intended for the production and viewing of the performing arts or motion pictures including, but not limited to: Motion picture theaters Symphony and concert halls Television and radio studios admitting an audience Theaters A -2 Assembly uses intended for food and /or drink consumption including, but not limited to: Banquet halls Night clubs Restaurants Taverns and bars IBC Commentary A -2: Group A -2 includes occupancies in which people congregate in high densities for social entertainment, such as drinking and dancing (e.g., nightclubs, banquet halls, cabarets) and food and drink consumption (e.g., restaurants). The uniqueness of these occupancies is characterized by some or all of the following: Jj Low lighting levels; b" Entertainment by a live band or recorded music generating above - normal sound levels; rd No theatrical stage accessories; . 6 . Later - than - average operating hours; 'd Tables and seating arranged or positioned so as to create ill- defined aisles; >J A specific area designated for dancing; Service facilities for alcoholic beverages and food; and Zj High occupant load density. The fire records are very clear in identifying that the characteristics listed above often cause a delayed awareness of a fire situation and confuse occupants regarding the appropriate response, resulting in an increased M.G.L. c. 148, s. 26G 1/2 and chapter 3 of the Massachusetts State Building Code both require that sprinklers be installed in any building or portion of a building occupied as a nightclub, dance hall, discotheque or bar with an occupant load of more than 50. What is the definition of a nightclub, dance hall, discotheque or bar? Neither M.G.L. c. 148, s. 26G 1/2 nor the Massachusetts State Building Code provides specific definitions for these terms. In absence of such definitions, the authorities having jurisdiction, including fire departments, building departments and licensing boards that are charged with enforcing the provisions of these laws and regulations must use their best and reasonable discretion in carrying out their enforcement responsibilities. Determinations must be made consistently and fairly based upon specific factors that exist for the particular building. The common and usual meaning of these terms, the legislative intent of the new statute and the intent of subsequent regulations and ordinances should be considered. The statute and the building code mandate enhanced sprinkler protection for property protection and life safety. This mandate is based upon a realization that these types of establishments tend to create circumstances that potentially diminish an occupant's ability to appreciate and /or effectively react to or escape from dangerous fire related situations. Such circumstances, individually or in combination, included but were not limited to: loud noise, low lighting levels, distraction caused by entertainment or dancing activity, crowded occupancy or a diminished capacity due to alcohol consumption. The terms "nightclub" and "dance hall" are used within the A -2 use group classification (A -2 Night Club) found in the 8th Edition of the Massachusetts Building Code. This use group definition was drafted from the 2009 edition of the International Building Code (IBC), a nationally recognized model building code. The commentary documents relating to the A -2 use group definitions used in the 2009 IBC indicates that such classification includes occupancies in which people congregate in high densities for social entertainment purposes. Examples given in the commentary are: dancehalls, nightclubs, cabarets, beer gardens, drinking establishments, discotheques and other similar facilities. The commentary concludes that the uniqueness of these occupancies is characterized, but not limited to, by the following factors: 1) No theatrical stage acpessories other than raised platform; 2) Low lighting levels; 3) Entertainment by a live band or recorded music generating above normal sound levels; 4) Later - than - average operating hours; 5) Tables and seating arranged or positioned so as to create ill defined aisles; 6) A specific area designated for dancing; 7) Service facilities primarily for alcoholic beverages with limited food service; 8) High occupant load density; It seems prudent that the characteristics of the "A -2 like" occupancy (A -2 Night Club), as stated, are the type of factors that authorities having jurisdiction should consider in enforcing the sprinkler mandates of M.G.L. c.148, s.26G1/2 and the Massachusetts State Building Code. These characteristics must also be considered when deciding whether to issue an entertainment license or allowing some other incremental change in use of a given building or portion of a building. It is noted that the list of characteristics is not necessarily all- inclusive. Additionally, the factors may be applied individually or in combination depending upon the unique characteristics of the building. For example, an occupancy that does not serve alcoholic beverages may still be subject to the law if entertainment by live band or recorded music is provided and /or there is a'high occupant load. There are many establishments that are designed and used as a restaurant that also may function as a nightclub, dance hall, discotheque or bar, or similar occupancy. If the establishment which is principally used as a restaurant is only used as a nightclub, dance hall, discotheque, bar or similar occupancy on a temporary basis, it probably may be considered "temporary" use. Therefore it may be allowed if properly permitted by the head of the Fire Department in consultation IEBC Chapter 9 Change in Occupancy (commentary) Purpose The purpose of this chapter is to provide regulations for the circumstances when an existing building is subject to a change of occupancy or a change of occupancy classification. As previously discussed, a change of occupancy is defined in Chapter 2 of the code: Change of Occupancy. A change in the purpose or level of activity within a building that involves a change in application of the requirements of this code. In either case, some scenarios exist that are not dealt with in Chapter 6, 7 or 8, but must be addressed nevertheless. Changes in occupancy or occupancy classification change the activities or activity levels, within a building, which can have implications on the life safety hazards associated with this change in activity. A change from a dance hall to a nightclub is a change in occupancy classification that has clear implications with regard to risks to life. A change from a restaurant to a nightclub is not a change in occupancy classification, but is, nevertheless, a significant change in activity levels with different related life safety risks. Mass Amendments Chapter 34, Existing Buildings (IEBC) 102.2.1.2 Other Cases Where Required. Fire protection systems are required for the following cases: 1. Carbon monoxide alarms are required and shall be selected and installed in accordance with the applicable requirements of 527 CMR and /or 248 CMR and Chapter 9 of the International Building Code 2009 with Massachusetts Amendments (780 CMR 9.00). 2. Existing buildings or portions thereof when changed in use to an A -2 Nightclub occupancy shall be protected with an automatic fire suppression system. Where the A -2 Nightclub occupancy is created in a mixed use building, the A -2 Nightclub occupancy, including all ingress and egress portions shall require automatic fire suppression when the occupant load is 50 or greater; additionally in such mixed use, the A -2 Nightclub occupancy shall be separated from adjacent uses by one hour horizontal and vertical fire separation assemblies in accordance with the applicable provisions of Chapter 7 of the International Building Code 2009 with Massachusetts Amendments (780 CMR 7.00). 3. Notwithstanding the provisions of this code, automatic fire suppression systems are required in municipalities which have adopted the provisions of M.G.L. c. 148, § 26H or I; also see M.G.L. c. 143, § 97A, and M.G.L. c. 148, § 26G1/2 relative to statutory prospective and retroactive sprinkler requirements for A -2 nightclubs and similar uses. with the Building Commissioner who may establish the terms and conditions of such use. Again the determination of what is "temporary" is within the discretion of the authority having jurisdiction in accordance with analysis described in the previous answer. If the establishment is designed or used as both a restaurant and a nightclub, dance hall, discotheque, bar, or similar entertainment purposes on more than a temporary basis, it may have to be sprinklered since it is not being "used principally" as a restaurant. Authorities having jurisdiction should use their best and reasonable discretion and make the determination consistently and fairly based upon specific factors that exist for the particular building. In determining such matters on appeal the Board will look at such common sense factors such as: a) Does the restaurant establishment regularly and routinely serve meals on a daily basis? b) Does the establishment provide a bar, bar seating, bar standing and a bartender for the purposes of serving alcoholic beverages directly to alcohol consuming customers? c) Does the bar and bar seating area have the ability to expand into the dinning area to accommodate special entertainment activities or increased capacity /density. d) If the establishment provides a bar and bar seating, are alcoholic beverages continuously served to customers more than one hour after full kitchen facilities have been closed? e) Is live or recorded music provided for dancing purposes or for a viewing audience? (does not include background dinner music)? f) Is the music loud enough to interfere with normal conversation? g) Does the establishment provide special entertainment, including but not limited to: musical, theatrical, comedy, or sport viewing activities? h) Based upon the establishments name, decor, atmosphere, does a customer expect a bar or nightclub type establishment? i) Is the establishment or portions thereof routinely or regularly used for private or public functions for dancing, parties, celebrations, entertainment or performance purposes? j) Does the establishment have an entertainment license? egress time and sometimes panic. Together, these factors may result in extensive life and property losses. These characteristics are only advisory in determining whether Group A -2 is the appropriate classification. Often there are additional characteristics that are unique to a project, which also must be taken into consideration when a classification is made. Example: The Downtown Club, a popular local nightclub/ dance hall, features a different band every weekend [see Figure 303.1(5)]. It is equipped with a bar and basic kitchen facilities so that beverages and appetizers can be served. There is a platform for a band to perform, a dance floor in front of the platform and numerous cocktail tables and chairs. The tables and chairs are not fixed, resulting in a hazardous arrangement because there are no distinct aisles. When the band performs, the house lights are dimmed and spotlights are keyed in on the performers. The club is equipped with a sound system that is used at loud levels. The club is open until 3:00 a.m. —the latest time the local jurisdiction will allow. From this description of the Downtown Club, one can readily see that the appropriate classification is Group A -2. Sometimes, however, it is not this easy to determine the appropriate classification. In such cases, the building official must seek additional information regarding the functions of the building and each area within the building. IEBC SECTION 307 CHANGE OF OCCUPANCY [B] 307.1 Conformance. No change shall be made in the use or occupancy of any building that would place the building in a different division of the same group of occupancy or in a different group of occupancies, unless such building is made to comply with the requirements of this code for such division or group of occupancy. Subject to the approval of the building official, the use or occupancy of existing buildings shall be permitted to be changed and the building is allowed to be occupied for purposes in other groups without conforming to all the requirements of this code for those groups, provided the new or proposed use is less hazardous, based on life and fire risk, than the existing use. ' A change of occupancy in an existing structure may change the level of inherent hazards that the code was initially intended to address. Regardless of whether the change is to an occupancy considered to be more or less hazardous, this section applies the provisions of the code for new construction to an existing structure having a new occupancy. This is done so that the applicable code requirements adequately address the specific hazards of the new occupancy. For example, a change from an existing mercantile occupancy to a business occupancy renders all Group B provisions applicable to all portions of the structure where the occupancy has changed. This section is one of the most frequently used provisions in the code for application to existing structures, since the occupancy in a building or structure is subject to change during the life of the building.
