Dear Mr. Nimohay:
Pursuant to our telephone conversation of April 22, 1988, I
am enclosing a copy of a letter from Anna M. DeLue, who is the
owner of property contiguous to the Rakaska lot. As indicated in
the letter, the Rakaskas have permissive use of the DeLue
property to house their horses.
Most importantly, after reviewing the Zoning Ordinance in
effect at the time the Rakaskas began this use (Spring 1974), it
appears that there were no restrictions as to square footage
prior to July 1975 when the new Zoning Ordinance was adopted. I
have enclosed a copy of the Ordinance in effect in 1974, which
was provided to my client by the City Solicitor's Office. I
thank you for referring me to Kathleen Fallon, who was very
courteous to me and who provided this information to Mrs.
Rakaska.
Should you not have additional information to the contrary,
it appears that the Rakaskas have an existing conforming use
which is not made nonconforming, by virtue of Section 4.2 of the
1975 Ordinance.
Please allow me the opportunity to address the remaining
issues in future correspondence. Due to time limitations you
spoke of for the submission of the enclosed information, I have
not been able to fully research the other alleged violations.
