05-001 (19) Planning Board - Decision City of Northampton File No.: PL -1999- Date: October 14, 1999 Pursuant to Massachusetts General Laws (MGL), Chapter 40A, Section 11, no Special Permit, or any extension, modification or renewal thereof, shall take effect until a copy of the decision bearing the certification of the City Clerk that twenty days have elapsed after the decision has been filed, or if such an appeal has been filed that it has been dismissed or denied, is recorded in the Hampshire County registry of Deeds or Land Court, as applicable and indexed under the name of the owner of record or is recorded and noted on the owner's certificate of title. The fee for such recording or registering shall be paid by the owner or applicant. It is the owner or applicant's responsibility to pick up the certified decision from the City Clerk and record it at the Registry of Deeds. APPROVAL CRITERIA. In reviewing the Site Plan Approval application for a Telecommunications Facility, the Planning Board FOUND the following: A. SITING: The applicant has located their antenna on an existing tower (a water tower), as encouraged by zoning. B. CO- LOCATION: This criterion is not applicable because the proposal is not for . a new tower. C. AESTHETICS: The telecommunications facility has been designed,, located and • bufferedto ensure compatibility with surrounding tared• uses,.because the •anfe ina will be located on an existing water tower and existing vegetation will be maintained. D. RADIO- FREQUENCY EFFECT: The tower shall be operated only at Federal Communications Commission (FCC) designated frequencies, power levels and - E. DIMENSIONAL AND DENSITY REGULATIONS: The proposed facility meets all required dimensional and density regulations. F. REMOVAL OF TOWER: The applicant must remove the Telecommunications Facility if it ceases to be used for its intended purpose for twelve consecutive months. G. MAINTENANCE OF FACILITY: The applicant must comply with the maintenance and repair provisions outlined at Section 11.8 (3)(G) of the Zoning Ordinance. CERTIFICATE OF SERVICE Pursuant to M.G.L. The requested use will promote the conv and safety of vehicular and pedestrian movement within the site and on adjacent streets and minimize traffic impacts on the stre is and in the area because the site is unmanned, so the facility will have no imp ct on traffic. C. The requested use will promote a harmonious relationship of structures and open spaces to the natural landscape, existing buildings and other community assets in the area because the antenna will not extend any higher than the existing structure (the water tank), limiting its visual impact. • • D. The requested use will not have any significant impact on the City's resources; including the City's water supply and distribution system, sanitary and storm sewage collection and treatment systems, fire protection, streets and school. E. The requested use meets all special regulations set forth in the Zoning Ordinance under Section 11.8. (See Attachment A) F. The requested use bears a positive relationship to the public convenience or welfare by providing for wireless communications. The use will not unduly impair the integrity of character of the district or adjoining zones because the antenna will be mounted on an existing water tower. The use will not be detrimental to the health, morals, or general welfare, and the use is in harmony with the general purpose and intent of the Ordinance. G. The requested use promotes City planning objectives to the extent possible because the antenna is located on an existing structure, as encouraged by zoning. Planning Board found the site plan complied with the following technical performance standards: 1. No new curb cut was requested. 2. No pedestrian, bicycle or vehicular traffic is proposed.
