Clark Building Inspector City of Northampton 212 Main Street Northampton, Mass. 01060 Dear Mr. Clark: This letter is a follow up to my initial request to you concerning proposed construction at Hampshire County Hospital. If a special permit is required, then the procedure under the zoning ordinances is pretty clear. My question, however, con- cerns non - conforming use prior to current zoning, which you sug- gest is covered by Section 9.2, Page 9 -1 of the current zoning ordinances. Interpretation of that section would appear to rest on what is meant by substantial change. Is it change in use or change in usable building space? The land in Leeds owned by the County of Hampshire has been used for hospital purposes for many, many years as you know. The trustees of the hospital now propose to add to the existing structure one wing for patient use, consisting of approximately 15,400 square feet. The present hospital building is some 52,500 square feet. The proposed addition will be for the exact same use as the present building; namely, long term patient care. The question then becomes whether you feel that a 25 to 30% addi- tion in square footage would necessitate a special permit. As the trustees must seek a Certificate of Need from the Department of Public Health, an early response from you would be much appre- ciated. Very truly yours, Edwin C. Warner, Administrator Hampshire County Chronic Disease He pital Leeds, Massachusetts 01053 Dear Mr. Warner: In reference to your letter of November 10, 1980; I am afraid that Northampton's Zoning Ordinances are not quite that simple. Northampton requires a Special Permit for hospital use, reference Sec- tion 5, Page 5.5, Paragraph 10. However, this use is allowed with a Special Permit from the Zoning Board of :peals. The use also is prior to the current zoning, and i covered by Section 9.2, Page 9•1, If the extension is not of a substantially greater extent, then a Special Permit would not be required. I am sorry that I cannot give a more definite answer to your question. Please do not hesitate to contact this office if we can be of any further help.
