The parties hereto agree that the stone wall which is being temporarily removed by J -BARC, INC. will be replaced along and outside of the center line of the socalled alcove and not along the southerly side of the five foot easement described above. 9. J -BARC INC., Mr. Thompson and 29 Pleasant Street acknowledge and agree that this Agreement is to be narrowly construed to apply only to specific circumstances; that is, the development by J -BARC INC. of its real property located at 21 -27 Pleasant Street as shown on the plans already submitted to and approved by Mr. Thompson and 29 Pleasant Street and the City, and the fact that the execution of these plans would obstruct a portion of a right of way owned by 29 Pleasant Street. This Agreement will not otherwise affect any other rights and obligations of the parties in the alcove as those rights and obligations exist: past, present or in the future. Any rights that Mr. Thompson and 29 Pleasant Street have under this Agreement may be enforced jointly or severally. This Agreement sets out the entire understanding of the Agreement made between the parties hereto. J -BARC INC., Mr. Thompson and 29 Pleasant Street acknowledge that 29 Pleasant Street has a 16' right of way from its real property through a portion of the so called alcove to Kirkland Avenue. As a part of the agreement among the parties, J -BARC INC., Mr. Thompson and 29 Pleasant Street have located a five (5) foot wide portion of this right of way running the full length of the right of way as shown on a plan of land drawn by Harold L. Eaton and Associates, Inc., dated September 24October 1, 2009, and marked EXHIBIT A, attached hereto and by this reference made a part hereof. J -BARC INC., including its successors and assigns, at their own expense, will install and maintain so- called bollards to mark this five foot wide portion of the right of way. Said bollards will be place along said five food right of way, but will encroach onto the so- called C -2 /Extension Runway. J -BARC INC., its successors or assigns will not allow cars to park in or allow other obstructions on this marked portion of the right of way, except on occasion and on a situation by situation basis and with prior written notice to Mr. Thompson and 29 Pleasant Street. Any of the parties hereto shall have the right to authorize the removal of motor vehicles parking in said five foot wide portion without permission or authority to do so. Mr. Thompson and 29 Pleasant Street will not be responsible for the removal of snow and/or ice from said five foot right of way. One for work at Downtown Sounds and other for work at Pleasant St Theatre. The stamped drawings submitted with each application reflects the work on BOTH buildings. We apologize for any confusion here. The scope of work at Pleasant St Theatre is all within the footprint of that building. The scope of work at Downtown Sounds includes work within the footprint of the building and also the addition which runs across the back of both buildings. There is still outstanding zoning which we have noted on the applications. The building owner, Joe Blumenthal, is in process of getting a sign off of ANR plan by PB and will then record this plan. Confirmation of recording will be forwarded to the Building Dept for inclusion in these applications as soon as we receive them. The Berkshire Design site plans included in these pkgs are based on the ANR plan. An exterior strobe at the front entrance of the building will activate. The Fire Alarm control panel shall send an alarm signal to the third party central monitoring station via telephone lines. The Fire Alarm System reset button returns the system to its normal state. Display messages shall provide operator assurance of the sequential steps as they occur. The Fire Alarm Control Panel is equipped with a 24 -hour battery back up. The Fire Alarm Control Panel is equipped with visible and audible signals to indicate alarm and trouble conditions. 3.0. Test Criteria: A. All features, devices, components, and modes of operation shall be tested for acceptance in accordance with code and NFPA 72. Smoke detectors shall be activated using a magnet per the manufacturer's recommendations. All pull Stations shall be activated by opening and upon activation of each device; the Fire Alarm System shall be checked for proper operation including annunciation at the Fire Alarm Control Panel and transmission of an alarm signal to the central monitoring station. Proper operation in the emergency power mode shall be demonstrated as well as a check of supervision circuits for opens and shorts. * * * End of Basis of Design Narrative* * * Page 3 SECTION 3- FIRE ALARMS SYSTEMS 1.0 Basis of Design A Fire protective signaling system will installed in accordance with 780 CMR and NFPA 72. A. Fire Protection signal system and detection devices in this building will include the following features: 1. Addressable manual pull stations within 5 feet of each exit door and all entry points leading to an egress stairway. All pull stations shall be dual action. 2. Addressable smoke detectors as shown on plan. 3. Addressable heat detectors located within the residential units. 4. Audio and visual notification devices as shown on plans. It is the intent of this design that audible notification devices achieve sound pressure levels of 15 dba above average ambient sound levels utilizing Table A.7.4.2 in Annex A in NFPA 72 as criteria for a minimum average ambient sound level. Also a voice communication system shall be capable of the reproduction of prerecorded messages with voice intelligibility. 5. Emergency power supply for the fire alarm panel shall be supplied by battery packs located at the Fire Alarm Control Panel. B. The fire alarm control panel shall utilize two telephone lines to transmit initiation of a fire alarm to a third party central monitoring station. Alarm signals shall consist of fire alarm, reporting by addressable zone and trouble signals. C. This project does not include any special design considerations or anticipated deviations from code requirements. 2.0 Sequence Of Operation: A. The activation of a fire alarm initiating device will send a signal via the fire alarm control panel to a third party central monitoring station. This fire alarm is designed to alert occupants of the building to evacuate as is associated with this type of facility. The system can be activated manually through the use of manual pull stations. The system shall be activated automatically by smoke detectors. The system shall initiate the fire alarm sequence of events. The addition of a new interior stair from the second floor to the third floor will lead directly to a new exterior exit stair. The existing stair will have enclosures added at each floor to separate them from the exit access corridor. The proposed exterior stair and storage building addition will provide a second means of egress for the basement and first floor of 21 Pleasant Street and for all floors of 26 Pleasant Street including the basement. The new structure is to be constructed as an addition to 21 Pleasant Street. Permanent egress easements have been established to ensure the continuous access to Kirkland Ave for 26 and 29 Pleasant Street. Existing Conditions - Building Summary 21 Pleasant Street: No changes of use are proposed. The existing two story 3B (unprotected masonry) constructed building originally included a meeting space on the second floor with high ceilings. Prior renovations created an intermediate level within this space which now includes an apartment that is accessed from the second floor. The gross area per floor is 3275 square feet. The current mixed use includes M (mercantile) for the music store, B (business) for the luthiery and practice spaces in the basement and R -2 (multifamily residential) for the apartments on the upper floors. No work is intended within the existing building. The proposed single story addition will be constructed of 5A (protected wood frame) and separated from the existing building by the existing 12 inch thick masonry walls which serves as a firewall. The ceiling assembly is one hour construction to protect the openings above the roof of the addition.
