Lastly, a detached location of the carport at the front of the house, off Chestnut Street, in addition to being aesthetically unattractive, would be a physical hardship because it would not provide covered access to the house; and, it would make it more difficult to enter and exit Chestnut Street safely. 2. If a variance is not granted, would the applicant be denied all use of the property? Yes and No: If my mother cannot have reasonable, safe access to her home, it could ultimately mean that she will not be able to stay there. While someone else could live there, or I could sell it, the home is my mother's. My late father built it for my mother's use and enjoyment. I bought it with the promise that my mother would have a home until her death, and not be obliged to move nor to live in a nursing home. 3. Is the hardship self - created? No. All zoning - compliant carport options create hardship (see above), and are neither the most advisable nor the most desirable. The hardships arise from the constraints of the lot, the land and the zoning. It is not possible to have reasonable use of the property, as outlined above, except with a variance to normal side - setback requirements. C. (2). If granted, would the variance nullify or substantially derogate from the intent or purpose of the Zoning Ordinance? No. I understand that it is the purpose and intent of the Zoning to discourage the massing of dwelling space or of enclosed structures and additions too close to the lot lines, constricting the open character of a setback and the privacy of adjacent properties. The proposed carport is not dwelling space and, being open, it does not substantially alter the massing of the house nor the open character of the setback. D. Is your request for the smallest relief possible? Yes. I am requesting no relief other than that which is required to allow reasonable and necessary use of the property. I have considered other alternatives (described above), but all create hardship without fulfilling the intent —safe access to the home, safe entry/exit to street, and a design consonant with the character and aesthetics of the neighborhood. cdc#t Re: Variance Application: Montgomery/155 Chestnut St., Florence (17C/66 /URA) 8.A. Are there circumstances relating to soil conditions, shape or topography of the land or structures (where the variance is being requested) that affects only this property /structure, and not other properties in the neighborhood? Yes. The lot has a sharp vertical drop of approx 10-12 feet at the back of the house, making the rear an impractical, unsuitable carport location. Also, the lot is very narrow, limiting access and use within normal side - setback requirements (50' frontage on Chestnut St., balance of frontage is on Garfield Avenue)(see site plan). 8.B.1. Would a literal enforcement of the Zoning Requirements create a hardship, financial or otherwise? Yes. The principal hardship is that I would be prevented from creating for my mother, Ilona Montgomery, 77 years of age, a safe access to her home. My main interest (see architect plan) is to provide covered, attached access from her car into the house, protected from the elements, particularly snow and ice. My concern originated with my mother's accident in 1995, when she slipped on ice as she exited the house to go to her car, falling and breaking her ankle. Further, locating the carport where I am requesting will allow safe entry and exit to and from Chestnut Street. Traffic on Chestnut Street is increasingly heavy and fast. The proposed plan allows turnaround space so that my mother can turn her car to enter Chestnut Street nose - first. Also, setting the carport back, attached to the house (rather than further forward and detached) allows the car to enter from Chestnut without effectively having to stop in Chestnut Street traffic to enter the driveway /carport. Lastly, I employed the services of an architect to ensure that the proposed carport, in addition to serving the expressed need, will aesthetically enhance the character and value of the neighboring properties. Alternative (zoning compliant) locations considered: The idea of putting the carport in the rear of the house is impractical and unsuitable. As mentioned above, the 10 -12' vertical drop would require a build -up of land which, if possible, would be cost- prohibitive, a significant financial hardship and effectively impossible. Location of the carport at the rear of the house, with lower -level access from Garfield Avenue, would also be a hardship — physically, because my mother would have to climb a flight of stairs whenever leaving and coming home; and financially, because we would be obliged to maintain an 800' driveway, the approx distance from the rear of the house to Garfield Avenue (see site plan). 11 g (2) If a Variance is not granted, would the applicant be denied all use of the property?
