17D-012 (38) have a correlation to the cost to the municipality incurred in relation to the issuance of the permit. See Emerson College v. City of Boston, 391 Mass. 415, 424 (1984). Here the cost to the City is essentially the cost for the inspector to inspect the work performed. Given the limited nature of the work, this can easily be accomplished in one day. Therefore, a fee of $3,620.00 more than adequately compensates the City for this electrical permit. Under M.G.L. c. 143, §3P, a party aggrieved by a decision of an electrical inspector can appeal such decision to the Board of Electricians Appeal in Boston. After such appeal, compliance with such decision or order is deferred until a final determination of the appeal. We would prefer not to go this route; but to instead reach a compromise with you on the amount of the electrical fees. ( "Callahan "). Callahan was the contractor who had a small Contract to replace electrical panels at the above referenced property. The Contract value was $184,500.00 to simply replace the electrical panels in all 240 units. I am advised that you have recently made a decision that the electrical permit fee for this work is $14,940.00. I am advised that you based this electrical permit fee by reference to the Section 174.5 Fee Schedule in effect as of July 21, 2008. That Fee Schedule provided as follows: "Service and one meter — up to 200 AMPS - $60.00" We believe this is not the correct item on which to base the electrical fee for this limited work. We believe this section relates to situations where there is a completely new or redone electrical service to an entire dwelling unit. We believe the more appropriate level of fee would have been the same as called out for under Major Appliances with the first "appliance" fee at $35.00 and each additional "appliance" (electrical panel) at $15.00 each. This would result in a total fee of $3,620.00 not $14,940.00. Therefore, we believe your decision to impose an electrical fee of $14,940.00 to not be reasonable or justified.
