RE: Illegal apartment above detached garage
Mrs. Orloski,
A complaint was filed with Northampton Board of Health regarding conditions in an apartment located
in a detached garage which you own. The complaint was referred to the Building Department for
potential building code violations.
I made a site visit on February 2 and met with Kim Elefterakis the renter of the apartment who allowed
me to enter the premise.
The apartment is in violation of 780CMR section 10 with regards to egress as there is only one means
of egress leading from second floor to grade.
The garage located below the apartment Iacks fire separation from the living quarters above. Th
ceiling of the garage has large hole exposing the floor joist system , this is a fire hazard which would
cause fire to spread easily from garage to apartment.(photo attached)
The apartment lacked smoke detectors and carbon monoxide detectors as required by law.
The city assessors records indicate property has been taxed as a "2 living units ", the creation of a
detached accessory apartment requires a special permit as per Northampton Zoning 350 -10.10 —B. No
permit has been issued for this address for this use.
The apartment located on the second floor in the detached garage on your property cannot be rented
until all of the above violations are corrected. Failure on your part to comply with correcting these
violations can result in fines and or court action.

Assessors Office, Fire Department and your Office.
