31B-287 • • Accessibility 605.1 General. Accessibility requirements shall be in accordance with 521 CMR. There are no additional requirements beyond those identified in Section 706 above. Energy Conservation 607: No additional requirements beyond those identified in Section 711 above 10 SECTION IV — CHAPTER 34 ANALYSIS ALTERATIONS — LEVEL I GENERAL 601: The work shall not reduce the level of conformance to building, fire, plumbing, mechanical or electrical codes in effect at the time that the affected areas of the building were constructed. BUILDING ELEMENTS AND MATERIALS 602: All new work shall comply with materials and methods requirements in the International Building Code, International Energy Conservation Code, and International Mechanical Code, as applicable. FIRE PROTECTION 603: Automatic Sprinkler Systems will not be required as a result of the reconfiguration of space as this work does not rise to the level of "major alterations" as defined by The Commonwealth of Massachusetts, Fire Safety Commissioner's Automatic Sprinkler Appeals Board, (see Memorandum and Advisory Guidance Document, dated October 14, 2009), and therefore do not trigger the requirements set forth in M.G.L. c. 148, § 26G. MEANS OF EGRESS 604.1: Alterations shall be done in a manner that maintains the level of protection provided for the means of egress, and in accordance with section 102.2.2.1. 102.2.2.1 Existing Non- Conforming Means of Egress: The following conditions shall be corrected in all existing buildings: 1. Less than the number of means of egress serving every space and/or story, required by Chapter 10 of the International Building Code 2009 with Massachusetts Amendments (780 CMR 10.00); There is a sufficient number of exits serving the second story. 2. Any required means of egress component which is not of sufficient width to provide adequate exit capacity in accordance with section 1005.1 of the International Building Code 2009 with Massachusetts Amendments (780 CMR 1005.1.) The exit component widths are sufficient to provide adequate exit capacity. What is the minimum specified elsewhere in the code? 3. Any means of egress which is not so arranged as to provide safe and adequate means of egress, including exit signage and emergency lighting in accordance with Chapter 10 of the International Building Code 2009 with Massachusetts Amendments (780 CMR 10.00); The existing exit stairway shall comply with 780 CMR 10.00 for door closing, handrails., exit signage and emergency lighting. 9 • ENERGY CONSERVATION 711.1 Minimum requirements. Level 2 alterations to existing buildings or structures are permitted without requiring the entire building or structure to comply with the energy requirements of the International Energy Conservation Code or International Residential Code. The alterations shall conform to the energy requirements of the International Energy Conservation Code or International Residential Code as they relate to new construction only. The alterations, (in the Work Area), shall conform to the energy requirements of the International Energy Conservation Code or International Residential Code as they relate to new construction only. Since the reconfigured space results in the expansion of an existing space by reducing the area of an adjoining space, these spaces should be evaluated as a whole for compliance with the energy provisions. Even though some of the elements in the space have not actually changed, some of the existing mechanical system may be altered and new ductwork installed to re -route the ducts to the various spaces. Only the new elements are required to meet the energy provisions, (not the entire system.) 8 521 CMR 3.3.1 If the work being performed amounts to less than 30% of the full and fair cash value of the building and a. if the work costs less than $100,000, then only the work being performed is required to comply with 521 CMR Only the reconfigured work area is required to comply with 521 CMR because the costs for the work being performed in this work area is less than $100,000 and is less than 30% of the full and fair cash value of the building. STRUCTURAL 707.1 General. Structural elements and systems within buildings undergoing Level 2 alterations shall comply with this section. 707.2 New structural elements. New structural elements in alterations, including connections and anchorage, shall comply with the International Building Code. 707.3 Minimum design loads. The minimum design loads on existing elements of a structure that do not support additional loads as a result of an alteration shall be the loads applicable at the time the building was constructed. 707.4 Existing structural elements carrying gravity loads. Alterations shall not reduce the capacity of existing gravity load - carrying structural elements. 707.5 Existing structural elements resisting lateral loads. N/A 707.6 Voluntary improvement of the seismic force - resisting system. N/A MECHANICAL 709.1 Reconfigured or converted spaces All reconfigured spaces intended for occupancy and all spaces converted to habitable or occupiable space in any work area shall be provided with natural or mechanical ventilation in accordance with the International Mechanical Code. Exception: Existing mechanical ventilation systems shall comply with the requirements of Section 709.2. 709.2 Altered existing systems. In mechanically ventilated spaces, existing mechanical ventilation systems that are altered, reconfigured, or extended shall provide not less than 5 cubic feet per minute (cfm) (0.0024 m /s) per person of outdoor air and not less than 15 cfm (0.0071 m /s) of ventilation air per person; or not less than the amount of ventilation air determined by the Indoor Air Quality Procedure of ASHRAE 62. ASHRAE 62 minimum overarching ventilation requirements to be determined and provided by the Mechanical contractor. 7 • 704.2 Automatic sprinkler systems. Automatic Sprinkler Systems will not be required because work area does not contain exits or corridors shared by more than one tenant; the shared occupant load for the entire second floor is less than 30; and the work area the work area is less than 50% of the floor area. 704.2.4 Other required suppression systems. In buildings and areas listed in Table 903.2.11:6 of the International Building Code, work areas that have exits or corridors shared by more than one tenant or that have exits or corridors serving an occupant load greater than 30 shall be provided with sprinkler protection under the following conditions: N /A, because the work area does not contain exits or corridors shared by more than one tenant:, the shared occupant load for the entire second floor is less than 30; and the building and work area is not listed in Table 903.2.11.6. 704.3 Standpipes. Where the work area includes exits or corridors shared by more than one tenant and is located more than 50 feet (15 240 mm) above or below the lowest level of fire department access, a standpipe system shall be provided. N/A for the B Use Group where the work area is less than 50 % of the floor area MEANS OF EGRESS 705.1 The requirements of this section shall be limited to work areas that include exits or corridors shared by more than one tenant within the work area in which Level 2 alterations are being performed, and where specified they shall apply throughout the floor on which the work areas are located or otherwise beyond the work area. N /A, the Work Area is not shared by more than one tenant, and does not include corridors or exits that affect others. Therefore, the tenant space undergoing this alteration need only comply with the means of egress requirements of section 604, (see below.) ACCESSIBILITY 706.1 General. Accessibility requirements shall be in accordance with 521 CMR. 521 CMR 3.3 EXISTING BUILDINGS: All additions to, reconstruction, remodeling, and alterations or repairs of existing public buildings or facilities, which require a building permit or which are so defined by a state or local inspector, shall be governed by all applicable subsections in 521 CMR 3.00. 6 • "To assist fire officials, building owners and construction project managers in making decisions, the Board has established the following two presumptions that may be used to determine if the scope or the cost of the planned alterations, or modifications are "major" thus requiring sprinklers to be installed throughout the building. 1.) Major alterations or modifications are reasonably considered major in scope when such work affects thirty -three (33)% or more of the "total gross square footage" of the building, calculated in accordance with section 26G. 2.) Major alterations or modifications are reasonably considered major in scope or expenditure, when the total cost of the work (excluding costs relating to sprinkler installation) is equal to or greater then thirty-three (33)% of the assessed value of the subject building, as of the date of permit application. _ It was the conclusion of the board that if the nature of the work is the type of work described in Part A and also meets at least one of the two presumptions described in Part B, then it can reasonable to conclude that the alterations or modifications are "major ", thus requiring sprinklers throughout the building. If the specific permitted alterations or modifications are not considered "Major" as described, but appear to be one phase of a series of modifications being conducted over a reasonably short period (i.e. five years or less), it may be reasonable to conclude that such work could be part of a long range project resulting in "major alterations" to the entire building, or a substantial portion of it, thus triggering the sprinkler requirements. Consideration should be given to determine if there is a series of future and recent past planned projects that, taken together, would be amount to "major" alterations. The proposed reconfigurations for the work area identified in this building permit application do not rise to the level of "major alterations" as defined by The Commonwealth of Massachusetts, Fire Safety Commissioner's Automatic Sprinkler Appeals Board, (see Memorandum and Advisory Guidance Document, dated October 14, 2009). They are also not part of a phase or series alterations or modifications being conducted over a period of five or less years. Ratio of Work Area to total Building Area is: 3 %. Work Area: 85.75 square feet Total Building Area: — 2,807.00 square feet .00305 The total cost of this reconfiguration is less than 33% of the assessed value of the building. Automatic Sprinkler Systems will not be required because they do not trigger the requirements set forth in M.G.L. c. 148, § 26G. 5 FIRE PROTECTION 704.1 Scope the requirements of this section shall be limited to work areas in which Level 2 alterations are being performed, and where specified they shall apply throughout the floor on which the work areas are located or otherwise beyond the work area. 704.1.2 Major Alterations. In addition to the requirement in section 704, automatic sprinkler systems may be required in buildings undergoing major alterations per section 102.2.1.1 102.2.1.1 Major Alterations. When existing buildings or portions thereof undergo additions or alterations, M.G.L. c. 148, § 26G may apply with respect to automatic sprinkler requirements. The requirements of this statute are enforced by the fire official. Applicability of these requirements can be found at the Department of Fire Services web site www.mass.gov /dfs. The Commonwealth of Massachusetts, Fire Safety Commissioner's Automatic Sprinkler Appeals Board, (hereinafter the "Board "), has defined the term "Major Alterations" in its Memorandum and Advisory Guidance Document, dated October 14, 2009. The Board established a two pronged test to determine if the proposed work is rises to the level sufficient to be considered "major alteration" and thereby triggering the requirements of M.G.L. c. 148, § 26G Part A - Nature of the Actual Work. • Is the planned physical work the type of work that would make the effort to install sprinklers substantially less than it would have been if the building were intact? • Is the work merely minor repair or cosmetic vs. major alterations? Examples of "major" alterations or modifications include, but may not be limited to: o The demolition or reconstruction of existing ceilings or installation of suspended ceilings; o The removal and /or installation of sub flooring, not merely the installation or replacement of carpeting or finished flooring; o The demolition and/or reconstruction or repositioning of walls or stairways or doorways; or o The removal or relocation of a significant portion of the building's HVAC, plumbing or electrical systems involving the penetration of walls, floors or ceilings. Part B - Scope of the Work or Cost /benefit of Sprinkler Installation. This involves a review of the scope of the major alterations or modifications to see if they affect a substantial portion of the building. This requires a review to determine how much of the building is being affected by the work; or a determination that the cost of installing sprinklers is moderate in comparison to the total cost of the work. 4 • SECTION III — CHAPTER 34 ANALYSIS GENERAL Level II Alterations include the reconfiguration of space, the addition or elimination of any door or window, the reconfiguration or extension of any system, or the installation of any additional equipment. 701.3 Compliance. All new construction elements, components, systems, and spaces shall comply with the requirements of the International Building Code. Exceptions: 4. The minimum ceiling height of the newly created habitable and occupiable spaces and corridors shall be 7 feet (2134 mm). BUILDING ELEMENTS AND MATERIALS 703.1 Scope. The requirements of this section are limited to work areas in which Level II Alterations are being performed, and shall apply beyond the work area where specified. 703.2 Vertical openings. Existing vertical openings shall comply with the provisions of Sections 703.2.1, 703.2.2, and 703.2.3. N /A, there are no vertical openings in the work area and the total 2 floor area is less than 3,000 square feet, (see exceptions below.) 703.2.1 Existing vertical openings. All existing interior vertical openings connecting two or more floors shall be enclosed with approved assemblies having a fire- resistance rating of not less than 1 hour with approved opening protectives. Exceptions: 5. In Group B occupancies, a minimum 30- minute enclosure shall be provided to protect all vertical openings not exceeding three stories. This enclosure, or the enclosure specified in Section 703.2.1, shall not be required in the following locations: 5.1. Buildings not exceeding 3,000 square feet (279 m per floor. 703.4 Interior finish. The interior finish of walls and ceilings in exits and corridors in any work area shall comply with the requirements of the International Building Code. Exception: Existing interior finish materials that do not comply with the interior finish requirements of the International Building Code shall be permitted to be treated with an approved fire- retardant coating in accordance with the manufacturer's instructions to achieve the required rating. This requirement shall be met. 703.5 Guards.
