Necessity; exceptions; auctions; reports No person, except one whose principal business is the manufacture and sale of new motor vehicles but who incidentally acquires and sells second hand vehicles, or a person whose principal business is financing the purchase of or insuring motor vehicles but who incidentally acquires and sells second hand vehicles, shall engage in the business of buying, selling, exchanging or assembling second hand motor vehicles or parts thereof or allow any property under his control to be used as a place of sale or display of motor vehicles without securing a license as providing in section fifty -nine. This section shall apply to any person engaged in the business of conducting auctions for the sale of motor vehicles, and to any person engaged in the business of leasing or renting motor vehicles and who, as an incident to such business, sells or offers to sell any such tease or rental vehicle to the public. All sales of second -hand motor vehicles or parts thereof made by any person referred to in this section shall be reported weekly to the registrar of motor vehicles on such forms as may be prescribed by him. • SS. Classes Licensee granted under the following section shall be classified as follows: Class 1. Any person who is a recognized agent of a motor vehicle manufacturer or a seller of motor vehicles made by such manufacturer whose authority to sell the same is created by a written contract with such manufacturer or with some person authorized in writing by such manufacturer to enter into such contract. and whose principal business is the sale of new motor vehicles, the purchase and sale of second hand motor vehicles being incidental or secondary thereto, may be granted an agent's or a seller's license; provided, that with respect to second hand motor vehicles purchased for the purpose of sale or exchange and not taken in trade for new motor vehicles, such dealer shall be subject to all provisions of this chapter and of rules and regulations made in accordance therewith applicable to holders of licenses of class 2. Class 2. Any person whose principal business is the buying or selling of second hand motor vehicles may be granted a used car dealer's license; provided, however, that such person maintains or demonstrates access to repair facilities sufficient to enable him to satisfy the warranty repair obligations imposed by section seven N I r4 of chapter ninety A used car dealer shall remain liable for all warranty repairs made and other obligations imposed by said section seven N 114 of said chapter ninety. The registrar of motor vehicles shall promulgate rules and regulations defining sufficient repair facilities for the holder of a used car dealer's license, Class 3. Any person whose principal business is the buying of second hand motor vehicles for the purpose of remodeling, taking apart or rebuilding and selling the same, or the buying or selling of parts of second hand motor vehicles or tires, or the assembling of second hand motor vehicle parts may be granted a motor vehicle junk license. s 59. Ucenslag authorities; expiration; fees; application; prerequisites; premises; ordinance regulations; revocation; notice The police commissioner in Boston and the licensing authorities in other cities and towns may grant licenses under this section which shall expire on January first following the date of issue unless sooner revoked. The fees for the licenses shall be fixed by the licensing board or officer, but in no event shall any such fee be greater than one hundred dollars. Application for license shall be made in such form as shall be approved by the registrar of motor vehicles, in sections fifty -nine to sixty-six, inclusive, called the registrar, and if the applicant has not held a license in the year prior to such application, such application shall be made in d which duplicate shall be filed with the registrar. No such license shall be granted unless the licensing board or officer is satisfied from an investigation of the facts stated in the application and any other information which they may require of the applicant, that he is a proper person to engage in the business specified in section fifty -eight in the classifications for which he has applied, that said business is or will be his principal business, and that he has available a place of business suitable for the purpose. The license shall specify all the premises to be occupied by the licensee for the purpose of carrying on the licensed business. Permits for a change of situation of the licensed premises or for additions thereto may be granted at any time by the licensing board or officer in writing, a copy of which shall be attached to the license. Cities and towns by ordinance or by -law may regulate the situation of the premises of licensees within class 3 as defined in section fifty - eight, and all licenses and permits issued hereunder to persons within said class 3 shall be subject to the provisions of ordinances and by- laws which are hereby authorized to be made. No original license or permit shall be issued hereunder to a person within said class 3 until after a hearing, of which seven days' notice shall have been given to the owners of the property abutting on the premises where such license or permit is proposed to be exercised. Except in the city of Boston, the licensing board or officer may, in its discretion, waive the annual hearing for renewal of a class 3 license. MI licenses granted under this section shall be revoked by the licensing board or officer if it appears, after hearing, that the licensee is not complying with sections fifty -seven to sixty -nine, inclusive, or the rules and regulations made thereunder; and no new license shall be granted to such person thereafter, nor to any person for use on the same premises, without the approval of the registrar. The hearing may be dispensed with if the registrar notifies the licensing board or officer that a licensee is not so complying. In each case where such license is revoked, the licensing board or officer shall forthwith notify the registrar of such revocation. Any person aggrieved by any action of the licensing board or officer refusing to grant, or revoking a license for any cause may, within ten days after such action, appeal therefrom to any justice of the superior court in the county in which the premises sought to be occupied under the license or permit applied for are located. The justice shall, after such notice to the parties as he deems reasonable, give a summary hearing on such appeal, and shall have jurisdiction in equity to review all questions of fact or law and may affirm or reverse the decision of the board or officer and may make any appropriate decree. Laband said, "You applied for a Special Permit on the use. The use is listed for a Special Permit. Forget the Finding. If you want the use, leave it as a Special Permit. The sign Finding you can withdraw." Mr. Albano replied, "We'll proceed on the Special Permit for the use. We can meet the criteria. We withdraw the sign request and will re- apply." Mr. Well read the Planning Board minutes on the parking issue, and Mr. Brandt replied, "Let them park where they want - -it's their problem. The legal number of parking spaces are provided for." Mr. Albano said, "The six display spaces total 918 square feet, which requires one parking space. The square footage of the building requires three, and we are providing four." There being no one present to speak in favor or in opposition, Mr. Brandt moved the Public Hearing be closed. Mr. Weil seconded, and the motion passed unanimously. Mr. Brandt moved to allow the Applicant to withdraw the request for a Finding on the sign without prejudice. Mr. Weil seconded, and the motion passed unanimously. Ch. Laband said he would accept the Application as written for the Special Permit. Mr. Brandt went through the Section 10.10 criteria, and found they had been met, and added, "I'll vote in favor." Dr. Laband said. "I concur, with the notation that the parking requirements are met." Mr. Weil added, "I'm not prepared to deny, but the Planning Board's stipulations should be included. It was concluded that Conditions #2,4 and 5 should apply, and Condition #3 be modified to say, "The number of parking spaces required by the zoning ordinance shall be supplied," with no reference to 'employee' or 'customer' spaces. Mr. Weil so moved, Mr. Brandt seconded and the motion passed unanimously. • (Pe"--L ZWC.4 Dr. Peter Laband, Chairman • Northampton Zoning Board of Appeals October 4, 1989 Meeting Page One The Northampton Zoning Board of Appeals met at 7:45 p. m. on Wednesday, October 4, 1989 in Council Chambers, Wallace J. Puchalski Municipal Building, 212 Main Street, Northampton, to conduct a Public Hearing on the Application of Alford Motorcars, Inc. for a Special Permit to allow a used automobile business at 236 Pleasant Street, and a Finding to change a pre- existing nonconforming sign on the site. Present and voting were Chairman Dr. Peter Laband, William Brandt, and M. Sanford Weil, Jr. Ch. Laband opened the Public Hearing by reading the Application, the Legal Notice, and a memorandum from the Planning Board. Atty. Al Albano appeared for the Applicant, and mounted a rendering of the site on the board. He asked the Board for permission to amend his Application from "Special Permit" for the use, to "Finding," because the automotive use, he argued, is also pre- existing nonconforming, and the Planning Board had no problem in letting him amend. His use is to be the sale of luxury, exotic and collectible automobiles. He explained that the Planning Board had a problem with his parking arrangement, and allowed him only four cars on display at the front of the building, until such time as he returned with a site plan showing parking details. He said he is required to provide four display spaces, three spaces for customers' cars, and two employee parking spaces. His plan provides for ten, five of which are the required 8 1/2' x 18, with the display spaces being smaller. Mr. Weil was concerned about cars being parked in front of the service bay doors, but the Board generally agreed that was an inconvenience for the Applicant, and not a material concern. Mr. Albano then turned to the sign, stating, "There's an ugly sign there now. I don't take issue with the Planning Board's position that we need a Special Permit, not a Finding, for the sign, but I ask that you grant the Special Permit. We sought a Finding because we thought we were dealing with a pre - existing nonconforming structure, since the definition of 'structure' on Page 2 -18 includes 'sign.' That's why we filed under 9.3." He described the sign as being three by four feet, with the Alford family crest, and the words, "Alford Motorcars, Inc." He said the pole sign was needed because, coming from the south, the Northampton Lumber Company blocks one's view of his building. Ch. Laband was reluctant to allow the Application to be "upgraded" from Finding to Special Permit, since "Finding" is what was advertised. He said, "I don't think I want to move tonight. We will act on this exactly as requested." Mr. Albano pleaded, "We are most seeking the Finding for the use. Alford has a contract to purchase the real estate contingent on a Special Permit or Finding and a License. The sign is clearly something we can live without tonight. Sanford Weil, Jr. DECISION OF NORTHAMPTON ZONING BOARD OF APPEALS At a meeting held on October 4, 1989, the Zoning Board of Appeals of the City of Northampton voted unanimously to GRANT the Application of Alford Motorcars, Inc. for a Special Permit under the Provisions of Section 5.2 of the Northampton Zoning Ordinance to allow a used automobile business at 236 Pleasant Street, Northampton. Present and voting were Chairman Dr. Peter Laband, William Brandt, and M. Sanford Weil, Jr. At the same meeting, the Applicant asked for permission to withdraw his request for a Finding to change a pre- existing nonconforming sign. The Board voted unanimously to allow the Applicant to withdraw without prejudice. The Findings are as follows: The requested use is listed in the Zoning Ordinance as allowed by Special Permit. The requested use bears a positive relationship to the public good in that it will permit a high - quality business to locate in the city and become part of our tax base. The requested use will have no effect on any municipal systems, nor will it have any effect on traffic or pedestrian safety. The requested use will not have any impact on the integrity or character of the district, and is in harmony with the general purpose and intent of the Ordinance. THE FOLLOWING CONDITIONS SHALL APPLY: 1. No disabled vehicles, or vehicles being worked on are to be parked outside the building. 2. Cannibalized vehicles must be screened from public view, and the total number of parking spaces required by the Northampton Zoning Ordinance shall be furnished. 3. No vehicles for sale or to be serviced shall be parked on the public way. Once again we will be adding a second location in Northampton. This will only be a satellite office with only one staff person at a time. The previous license indicated vehicles being displayed inside. which is what we intend to do. We are hoping to have at least 8 -10 outside. the vehicles we sell are all compact cars ie: Honda, Toyota, and Nissan so the space that we will use for each vehicle will be minimal. We have already painted the outside of the building, (which is quite an improvement. it was looking pretty shabby) I will be putting flowerpots with flowers at the front of the building and around the tree that is by the side walk. Laband opened the Public Hearing by reading the Application, the Legal Notice, and a memorandum from the Planning Board. Atty. Al Albano appeared for the Applicant, and mounted a rendering of the site on the board. He asked the Board for permission to amend his Application from "Special Permit" for the use, to "Finding," because the automotive use, he argued, is also pre- existing nonconforming, and the Planning Board had no problem in letting him amend. His use is to be the sale of luxury, exotic and collectible automobiles. He explained that the Planning Board had a problem with his parking arrangement, and allowed him only four cars on display at the front of the building, until such time as he returned with a site plan showing parking details. He said he is required to provide four display spaces, three spaces for customers' cars, and two employee parking spaces. His plan provides for ten, five of which are the required 8 1/2' x 18, with the display spaces being smaller. Mr. Weil was concerned about cars being parked in front of the service bay doors, but the Board generally agreed that was an inconvenience for the Applicant, and not a material concern. Mr. Albano then turned to the sign, stating, "There's an ugly sign there now. I don't take issue with the Planning Board's position that we need a Special Permit, not a Finding, for the sign, but I ask that you grant the Special Permit. We sought a Finding because we thought we were dealing with a pre- existing nonconforming structure, since the definition of 'structure' on Page 2 -18 includes 'sign.' That's why we filed under 9.3." He described the sign as being three by four feet, with the Alford family crest, and the words, "Alford Motorcars, Inc." He said the pole sign was needed because, coming from the south, the Northampton Lumber Company blocks one's view of his building. Ch. Laband was reluctant to allow the Application to be "upgraded" from Finding to Special Permit, since "Finding" is what was advertised. He said, "I don't think I want to move tonight.
