standards for a curb cut width and did not make any findings relative to the use under 11.6. '•
Portion of subsection 5 The requested curb sit will promote the convenience and safety of vehicular and pedestrian movement on .
adjacent streets; minimize traffic impacts on the streets and roads in the area. The proposed intersection design would allow separation
of vehicular and pedestrian access for the future build -out of the site, _yet to be determined. The intersection design proposed Includes a
d- weycrosswalk with pedestrian activated crossing thar will allow sate pedestrian crossing while all vehlculer movement is stopped.
Though the proposed intersection 1s intended to fa cflltate traffic movement in the future at the site, the pedestrian access to the west side
of King Street will be enhanced through this design to provide safe access to businesses located there.
A full traffic analyefs of proposed uses was not conducted because there are no anticipated users at this time. The Board made no
determination about the status ()Havel ofservlce at the site intersection which must be completed at the time a use is proposed, Any
additional mitigation will be analysed at such time.

zoning for special permits and/or site plan approval.. The application for such permits must show
cross - access or easement .areas for vehicle traffic to flow from abutting properties to the signal. The
application shall also show proposed pedestrian' easements across property boundaries and conform
to all aspects of the zoning including those relating retail establishments over 10,000 sf.
NOTE: Northampton's.zoning requires special permit for reuse of existing commercial buildings
substantial improvements.
3. Prior to issuance of a building permit the applicant shall submit to the Planning Board for review a
copy of a draft cross- access agreement for the abutters of both 347 and 303 King St to cross, via
vehicular or non - vehicular means, the subject parcel. This easement may exclude commercial
vehicles used primarily to support industrial uses, such as cement trucks and chemical trucks. The
purpose of this•easemenf is to comply with the Northampton. Zoning Ordinance as specified in the
permit herein allowing a wider curb cut and traffic. signal installation. The applicant shall only be
responsible for granting access across the property to each of the stated abutters at such a time that
reciprocal access is granted to the applicant by that abutter. If one or both abutters do not agree to .a
cross access agreement of the time of the request for a building permit, the applicant must submit
proof of such to the planning board.

Dear Peter,
I have reviewed your zoning permit application to reconfigure the parking lot at 327 King Street
in Northampton.
It is my determination that this project will require site plan review by the Planning Board in
accordance with condition 2 of PLN- 2009 -0038, an amendment to PLN- 2009 -0007.
This decision does not include any consideration of the 4418 square foot structure or the 1500
square foot addition indicated on the site plan submitted with the zoning permit application. Those
structures will need to be reviewed separately.
