We have been notified by MassHighway that there are some utility coordination issues with the Earle
Street reconstruction plans and the VCA building. The permit for VCA includes a permit condition:
"Applicant shall verify existing conditions plan and proposed redesign of Earle Street to ensure
that proposed utility locations for the building do not interfere with those drainage and sewer
utilities in the street."
Until the utility coordination is addressed, we request that you do NOT issue a final Certificate of
Occupancy for this project.
There is an additional issue of street trees that VCA needs to plant. They can't do that until the
construction is complete. We recommend that whenever VCA is otherwise ready for a CO and the utility
coordination is addressed, they post a letter of credit or cash escrow in an amount sufficient to cover
tree plantings and that should be sufficient to allow the CO to issue.
