10. An easement shall be required from the owner of Detention Basin 5 to discharge storm
flows to this basin.
11. Construction plans and specifications shall be submitted to the DPW prior to
construction.
12. A project specific detail of the Cultec Recharger 330 XL Detention System must be
included in the construction plans and specifications.
13. Sheet 6 of the Site Plans includes a Detail of Stone at Culvert Ends but only specifies
stone up to a 5% slope pipe. The construction plans must include specification of stone
for the 7.5% slope that is shown on the plans.

2. This project will be required to submit one or more Notice of Intent (NOI) to the U.S.
EPA for coverage under the NPDES Stormwater Construction General Permit. A copy of
the final NOI and Stormwater Pollution Prevention Plan (SWPPP) shall be submitted to
the Northampton DPW for approval prior to the start of construction and prior to issuance
of a building permit.
3. The proposed stormwater management system is designed to mitigate peak stormwater
flows. If, after construction of the proposed system, the system is found to increase
stormwater flows to adjacent properties or to the municipal storm drain system, the owner
shall redesign and reconstruct the drainage system to prevent any increased stormwater
flows to adjacent properties or the municipal storm drain system.
4. The proposed bioretention areas have been designed with a specific volume capacity as
documented in the approved drainage calculations. The applicant must provide surveyed
as-built plans stamped by a professional engineer that demonstrates that each bioretention
area provides equal or greater volume capacity to the volume specified for each
bioretention area in the approved drainage calculations.
5. The installation of trees and lighting fixtures in the bioretention areas must in no way
stop flow or disrupt the proper functioning of these drainage structures.
6. The plans specify a "Limited Snow Storage Area" in the northwestern and northeastern
corners of the property. The proposed bioretention areas shall not be used as dedicated
snow storage areas.
7. The applicant has provided an analysis of expected drainage flows from the proposed
detention basin 6 as well as sheet flow to the wetland area and to an inlet to the municipal
drainage system near Grove Street. The inlet near Grove Street is currently being
reconstructed as part of the South Campus Infrastructure Improvement Project and the
applicant must confirm in writing that the redesign of this inlet is adequate to safely
convey drainage flows from the proposed project. The inlet near Grove Street is located
on private property that will be owned by Kollmorgen and therefore ongoing operation
and maintenance of this structure is the responsibility of the property owner. The
applicant must specify maintenance tasks for this inlet structure in the approved
Stormwater Operation, Maintenance, and Inspection Agreement discussed above.
8. All detention basins, swales, outlets, bioretention areas and other non -piped components
of the proposed stormwater system shall be constructed as proposed and stabilized prior
to receiving drainage flows from the proposed development.
9. The drainage calculations include potential build -out of Lot 1 (Prince Street lot) but do
not include potential future build -out of Lots 12 A and B (Earle Street lot(s)). The future
build -out of these lots shall be included under the existing Stormwater Management
Permit issued for The Village at Hospital Hill, South Campus by the DPW on 1/13/05.
Prior to Site Plan approval for these lots, the drainage calculations for Detention Basin 5
must be revised to reflect the proposed build -out for these lots and submitted to the DPW
for approval. The peak flow to Drain Point 5 as defined in the drainage calculations must
be shown to be below existing condition peak flows for all design storms.

2. The Northampton Department of Public Works (DPW) or its authorized representative
shall be provided access to the property to conduct inspections before, during, and after
construction activities as necessary. The applicant shall arrange with the DPW to
schedule the following inspections: Initial Inspection, Erosion Control Inspection, Bury
Inspection, and Final Inspection. The DPW may also conduct random inspections to
ensure effective control of erosion and sedimentation during all phases of construction.
3. At the completion of the work, including construction of stormwater management
facilities and landscaping, the applicant shall submit to the DPW as -built plans stamped
by a professional engineer of record in the Commonwealth of Massachusetts and a
statement from a professional engineer of record in the Commonwealth of Massachusetts
certifying that the materials and construction of the stormwater management system was
constructed in accordance with the approved plans and will function as designed. All
changes to the approved stormwater facilities shall be documented by a professional
engineer of record in the Commonwealth of Massachusetts and approved by the DPW
prior to submission of as -built plans and the certification statement described above.
4. Annual Reports that are stamped by a Registered Professional Engineer documenting
the actions completed as required by the Operation, Maintenance and Inspection
Agreement shall be submitted to the Northampton Department of Public Works by
October 1 of each year (see Specific Condition 1 below).
5. If construction of the proposed stormwater system has not started within five years of the
issue date of this permit, then the permit will expire and a new permit will be required.
Construction is defined as clearing, grading, excavation, filling, and installation of
drainage structures on the lots specified in this permit.
Specific Permit Conditions:
1. Prior to issuance of a Building Permit, the applicant shall record an executed Stormwater
Operation, Maintenance, and Inspection Agreement that is binding on all subsequent
owners of land served by the private stormwater management facility by recording it in
the land records of the Registry of Deeds. The maintenance schedule and responsibility
for maintenance of all components of the proposed stormwater management system must
be adequately specified in Attachment A to this Agreement. The Stormwater
Management System Operation and Maintenance Plan submitted as Appendix F in the
Revised Stormwater Management Report must be revised to specify the operation,
maintenance and inspection schedule for each component of storm drain system. This
agreement shall be approved by the Northampton DPW and signed by the owner and the
Mayor of Northampton. Section 22 -85 of the Northampton Stormwater Management
Ordinance provides additional guidance for the requirements of this agreement.
