DECLARATION OF RESTRICTIVE COVENANTS
KNOW ALL PERSONS BY THESE PRESENTS that We, THOMAS C. FOLEY and NANCY
A. FOLEY, being the owners of Lot 21 and Lot 21A located on Ice Pond Drive, Northampton,
Massachusetts, by deed of TCB Hospital Hill, LLC, which deed is dated March 31, 2004 and
recorded with the Hampshire County Registry of Deeds in Book 7741, Page 162, hereby make the
following declaration imposing the restrictions set forth below on the owners of said Lot 21 and Lot
21A (individually "Lot" and collectively "Lots "), and their heirs, successors and assigns
(individually "Lot Owner" and collectively "Lot Owners "). The restrictions set forth below shall run
with the lands referred to herein and shall be binding upon the Lot Owners, their heirs, successors
and assigns. The lot owners of said Lot 21 and 21A are hereby made subject to the following
restrictions and requirements:
1. The undersigned have submitted to the City of Northampton a plan depicting the
structure(s) to be erected on the subject premises, which plan identifies an "Oversize
Two Car Garage." (Said plan was prepared by T &T Consulting and is dated May
2007.)
2. The Lot Owners, their heirs, successors and assigns acknowledge and agree that no use
shall be made of the said "Oversize Two Car Garage" other than as a garage, or as a
storage area, or for purposes for which a workshop or tradesman unit may be used. It
is further acknowledged and agreed that no residential use of any kind shall be made
of the stated "Oversize Two Car Garage."
IN WITNESS WHEREOF the said Thomas C. Foley and Nancy A. Foley have caused their hands
