EMAIL ADDRESS: NATURE OF PROPOSED WORK: 2ND FLR ADDITION HARDSHIP: CONDITION OF APPROVAL: FINDINGS: The designated Zoning Administrator granted the Finding based on the materials and graphics submitted with the application. The Findings of the Board Administrator under Section 9.3 for the second floor addition over existing first floor as part of a single family house related to the side yard setbacks as follows: 1. The Administrator found that the change would not be substantially more detrimental to the neighborhood than the existing nonconforming structure on the lot. The structure currently 6.5' from the side lot line and the second floor would cover the same footprint. 2. The Administrator found that the home would not extend any closer to any front, side, or rear property boundary than the current zoning allows and that the pre- existing structure already extends. 3. The Administrator also determined that the new construction would not create any new violation of other zoning provisions; and does not involve a sign. The addition is to be built on the existing walls of the building and the only change to the existing footprint would be a set of stairs on the exterior with a small landing on the second floor. There is currently only one set of stairs to the second floor, and I wish to have an emergency exit. This project would also entail adding two small dormers into the front roof. Our house is a preexisting nonconforming structure situated only 6'6" from the west side of our lot. This zoning issue has been resolved through the city planning department and a finding has been granted. We are currently one week into the 30 day appeal period, and wish to obtain our building permit and get started with the construction. We would start with those parts of the project that can be build within right , and realize that any changes to the structure within the ten foot setback cannot be approved until the appeal period is over and the planning board has finalized the finding. Carolyn Mish in the planning department informed me that they had no objection to me starting construction as long as I realize, that I would have to meet required 10 foot setback should an appeal process lead to a reversal of their decision. I am not at all sure that construction can get started in this short amount of time, but I would at least like to get my building permit and be set to go. The Administrator found that the change would not be substantially more detrimental to the neighborhood than the existing nonconforming structure on the lot. The structure currently 6.5' from the side lot line and the second floor would cover the same footprint. 2. The Administrator found that the home would not extend any closer to any front side, or rear property boundary than the current zoning allows and that the pre- existing structure already extends. 3.
