Northampton,' MA Dear Frank: We were asked by the Assistant Building Inspector to confirm our timetable for the rectification of the violation concerning the indoor stairs from the first to the second floor in the convenience building. As you know, the existing stairs in the convenience store are in violation of the Code in that the risers and treads do not fulfill the requirements of the 7 -11 rule required for commercial buildings in this state. We intend to rebuild the stairs as shown on our Dwg, #CDA.1706.A2 dated 5/17/93 which we delivered to you by hand 8.30 Tuesday morning, May 18, 1993. We are in the process of ordering the material and arranging for a carpentry company to perform the work and we can confidently predict that the stairs will be finished in place for your inspection on or before Friday, June 4, 1993. Per your directive to Evelyn Mock and myself on Monday, May 17, 1993, that we could immediately proceed with the work on the apartments if we presented to, you revised drawings and letters of statement and intent on Tuesday, May 18, 1993 at 8 :30. This we did and, therefore, immediately started work, per your instructions, and have proceeded expeditiously therefrom. The apartments are rough framed and we would appreciate your department inspecting the rough framing prior to our proceeding further. We are also wondering when your secre -Ary will be able to type up the formal building permit so that we can exhibit it at the jobsite. We had intended to use the second floor for a small amount of commercial storage and two apartments. We have since changed our minds on its use for commercial storage. We sincerely apologize that we inadvertently did not notify you of this change. We intend at a future date, if our major project does not proceed, to install two apartments, as is permitted under the General Business Zoning. We have been informed that there is an error in your Assessor's Book which incorrectly identifies our property as "general industry." We have been "general business" for several years and if you will review the variance that the City gave us to allow our ice cream sales, you will see that the zoning is correctly stated as "general business." At that time, we discussed the fact that there is still a violation outstanding on this project that we would like to rectify. I would like to apologize that it has taken so long to address this matter. We appreciate your help and courtesy in this matter and we feel that we should take your advice and install commercial stairs to the second floor since this will then allow us multiple use of the building until such time as we convert it to residential. It will also avoid any confusion in the interpretation of whether the residential should have one and two family stairs. Upon review I feel I must agree with you that this really should be classified as an R2 occupancy and, hence, the main stairs which are common to the two apartments should fulfill the commercial code requirements. We have, therefore, as you can see on our drawing no. CDA.1706.A2 dated 5/17/93, used the seven and eleven rule in designing the stairs. Even though it is two stories with an occupancy of less than fifty and only requires a 3 ft wide stairs we would like to use the existing stair opening which is approximately 3'6" wide, as shown on the drawing. Northampton, MA Dear Frank: Reference is made to our conversation this morning in your office. At that time we discussed the exact code interpretation that should be used to define the stairs to the two apartments above the car polishing facility. Even though it is only two apartments, it is not owner occupied and it is a common front stair which does not allow it an R 4 use group. I would, therefore, agree with your first interpretation that it should be classified as R 2 and, hence, requiring 7 -11 dimensions for the stairs. As you can see on the revised copy of the drawing dated 5/17/93, we have revised the stairs from their two family residential sizing to the commercial dimensions and have rotated the stairs so that they lie flat against the building. We appreciate your courtesy and consideration in this matter. We would like to further impose upon your consideration by requesting that now that the violation at the convenience store and the interpretation of the stairs have both been definitized, that we be allowed to proceed immediately with construction on this project. We have a situation in which the contractor that we can afford and who will give the quality work that we desire, will not be available for much longer prior to his starting another job of considerable size. It would, therefore, be extremely advantageous to us if you allowed construction to proceed immediately. We will, however, make any changes that you desire upon lengthy perusal of the drawings.
