Further, the draft International Energy Conservation Code (IECC), does not require a vapor retarder in walls for Massachusetts because of building science considerations. In summary, we believe that the science and experience with these wall systems strongly indicates that the best way to construct the wall is to omit the interior vapor retarder. I would like to emphasize that builders are trying to build the most efficient, healthy and durable houses possible. It is true that the omission of the vapor retarder will save a small amount of money, but the reasons for doing so have only to do with doing it right, not cost savings. The builder is primarily interested in producing the best wall system possible, and it is our belief that the best cellulose insulated wall will have no vapor retarder. As a professional engineer, I attest to the omission of the vapor retarder in this case as the best approach for building performance and durability. Experience in the field, research and moisture modeling all are in agreement that the lowest potential for moisture accumulation in a wall of this type occurs when no vapor retarder is used on the inside of the insulated wall. The Oak Ridge National Laboratory has produced a sophisticated moisture modeling program called WUFI. This program is a far better analysis of moisture potential than the older dew point approach, and can give detailed moisture profiles for wall systems over time. Below are two graphs showing modeled moisture content of walls with and without vapor retarder. The systems were modeled for 1 1 /2 years starting in January, with typical weather (temperature, rain humidity, etc. ) and interior moisture and temperature conditions. As can be seen, both assemblies will dry out over time, but the system without vapor retarder dries more quickly and thoroughly than the one with the vapor retarder. Building Code 780 CMR section 5318.1 as it relates to our project at #2 - #4 Garfield Ave. This project represents our first attempt to have one of our new homes certified under the USGBC LEED for Homes program. This building will be built as a super insulated airtight structure employing advanced wall and roof systems. The wall section will include conventional 2x6 cavity wall filled with cellulose insulation installed at a density of 3.5# per cubic foot. Exterior sheathing will be 7/16: OSB structural sheathing and a layer of 1 ": XPS foam installed outside of the structural sheathing. Air sealing techniques will be employed to create an air barrier at the plane of the OSB sheathing. Because the outside face of this wall system will have a moisture perm rating > 1, we want to delete a vapor retarder at the inside face of the wall system to provide a path for the wall system to dry to the interior of the house. In support of this request, I am attaching a copy of a letter authored by Mark E. Kelley, PE that addresses the concept of deleting vapor retarders from the type of wall system we plan to use. This letter was provided by National Fiber, the company that manufactures and supplies the cellulose insulation we will us at the Garfield Ave. project. Grantee hereby agrees to indemnify, defend and hold Grantor, its successors and assigns harmless from and against any and all damages, liabilities, claims, demands, costs and expenses (including, without limitation, reasonable attorneys' fees and disbursements) arising out of or relating in any way to (a) Grantee's breach of this Agreement, including the reasonable costs of any remediation, relocation, removal or similar action taken by Grantor in accord with this Agreement; (b) all environmental consequences of any discharge of any hazardous substances or hazardous wastes from Grantee's Property to Grantor's Property; and (c) all claims of entities owning properties which nay now, or in the future, be serviced by the sewer Line asserting damage because of blockage of, or other damage to the Sewer Line. The parties hereto specifically acknowledge that this indemnification places upon Grantee the total responsibility for any and all damages arising out of its use of the Sewer Line and Easement Area, except for any gross negligence of Grantor. 8. If Grantee fails to cure or remedy any default by Grantee of its obligations in this Agreement to be performed by Grantee, within thirty (30) days after Grantor shall have given Grantee written notice of such. default, Grantor shall have the right, at Grantor's option, to do any one or more of the following: O.) to cure any default of Grantee, at Grantee's expense, with interest thereon at the National Prime Rate of Interest as quoted in the °Wall Street Journal" (or other similar publication) plus five (5k) percent per annum, which amount shall be payable within ten (10) days following demand; or (ii) to require specific performance of Grantee; or (iii) to avail itself of any other recourse or remedy to which Grantor may be entitled at law or in equity; or (iv) to terminate the Easement. 9. Grantee shall have the right of ingress and egress over Grantor's Property in the area shown on the Easement Plan as "Broposed 20' wide Sewer Easement' (the "Easement Area" more particularly described in Exhihit B-1 attached hereto for the purpose of inspecting, maintaining, repairing {including remedial work required under paragraph a 2 and 4 hereof) and replacing the Sewer Line, Not less than fifteen (15) days prior to entry on Grantor's Property to accomplish the foregoing work, Grantee shall (a) notify Grantor of the date of commencement of entry; (b) provide Grantor with a plan for Grantor's approval showing the location of the proposed work together with such information under the uDig Safe' program as shall enable the Grantor to determine that the location of the proposed work will have no adverse affect on exiting utility lines and/or structures on Grantor's Property; (c) provide Grantor with a schedule of such work for Grantor's approval; (d) furnish Grantor with a payment and performance bond and statutory lien bond; and (e) furnish evidence of workers compensation insurance in the statutory amount issued by a surety acceptable to Grantor, Grantor and/or its engineers shall have the right to observe the work and to require protective measures to prevent injury to persons and property. Grantee shall not interfere with Grantor's (or its tenants) use of Grantor's Property and all of such work shall be performed between the daytime hours of 0.1D a.m. and 4:00 p.m. All such work shall be performed expeditiously, in a aafe and lawful manner. Grantee shall restore the Easement Area to substantially the same condition as existed prior to the commencement of such work.
