Additionally, we issued plumbing, gas and electrical permits, also for a single family house. On November 13, 2009 we received a request from the electrician to connect a two socket meter panel. Since the permit allowed a single family dwelling, multiple meters are not allowed. I met with Dan LaRochelle and Kathryn on Friday, November 14, 2008. We discussed the criteria for a single family dwelling, a two family dwelling and a single family dwelling with an accessory apartment. As presently permitted, the City of Northampton Zoning Ordinance restricts the structure to a single family dwelling. The project was allowed as a "zero lot line development" which is restricted to single family dwellings. An accessory apartment would likely be allowed, but would have to comply with chapter 350 -10.10 restrictions. Along with the zoning requirements, an accessory apartment must also meet the requirements of the Massachusetts State Building Code, including means of egress and fire separation. The plans as submitted, and the structure as built, would not comply with the building code requirements for two dwelling units. Compliance with the building code is required for an accessory apartment. If you wish to occupy this structure as anything other than a single family dwelling, please submit a zoning permit application. If the zoning permit is approved, you would then need to submit amended plans showing compliance with the building code. Feel free to call if you have any questions. Zero lot line (ZLL) developments are developments, or portions of developments, where house lots have a minimum side yard setback of zero feet on one side (the "zero lot line ") if the following standards are met: A. If a garage is built, it must be setback at least twice the normal front yard setback, or the garage must cover no more than 25% of the front facade of the principal structure; and B. No windows or doors facing the zero lot line may be placed within 10 feet of the zero lot line, except windows that are at least eight feet above grade; and C. A minimum of a six -foot high sight- impervious fence must be built and maintained along the zero lot line and attached to any buildings on the zero lot line. (The Planning Board may waive this requirement if the applicant demonstrates that a fence is not required to provide adequate private space.); and D.
