Dear Ms. Voorhees:
As a result of the October 30, 2011 snow storm there are two tree limbs hanging from the
maple tree along our mutual property line which could result in damage to our fence and
on our property. Given that the tree limbs have been left without removal since October
30, 2011 please be advised we intend to hold you personally responsible and your
homeowners company negligent if their falling causes damage to our property.
The weather pattern for this year has been very intense and who knows what it will be in
the future, and the two trees in your yard have become quite tall and large; therefore, you
are hereby put on notice to have those trees reduced in size in order to avoid any damage
in the future.
In addition, you currently operate a daycare business from your home and these hanging
limbs pose a safety hazard to the children who are entrusted to your care.
Kindly forward a copy of this letter to your homeowners insurance carrier and child care
liability carrier. If you intend not to notify them, please respond in writing to 83 Barrett
Street, Northampton, MA 01060 by US Postal Service Certified Mail their names and
address in order that we may forward this correspondence to them.
