31B-221 New Iron Fence @ 47- 49 Elm Street Northrop & Gillett Houses Smith College NARRATIVE Zoning Permit Application The applicant, Smith College, seeks to install a four foot wrought iron style fence in front of Northrup and Gillett House on Elm Street (shown on the attached plan). The fence replaces an existing four to five foot high hedge. §350 — 6.8E provides: "At no street intersection in any district shall any obstruction to vision exceeding three feet in height above the plane established by the intersection streets be placed or permitted to grow, on any lot within the triangle formed by the lot liens abutting the intersection and a line connecting points on these lot lines at a distance of 25 feet from the point of intersection of the lot lines. This restriction shall apply to the intersection of a street and a driveway in a B or I district." Section 6.8 assumes a ninety degree intersection and a street layout that is not on a radius or a divided intersection. There is no recorded taking or layout for the recent relocation of the intersection of Prospect Street and Elm Street. The recorded layout for the Elm Street Prospect Street intersection does not show a split entrance and exit around an island that divides the roadway and a twenty -five foot set back would fall within the island and be compliant with the requirements of Section 6.8E. Even if Section 3.8E was to be applied to the Elm Street Prospect Street intersection, because it is a divided intersection with a one -way entrance and one -way exit, the twenty -five foot requirement would be measured from the exit lane and the fence is outside the twenty -five foot limitation. The proposed fence is replacing an existing hedge and is a pre- existing non- conforming barrier and does not impair the intersection sight lines. Because of the divided roadway and the arc of Elm Street the sight lines are unimpaired at the intersection for over one hundred yards in both directions. Notwithstanding the provisions of Section 6.8E, the following Section 6.8F provides that a fence can be maintained within five feet of a front line if it can be shown that it will not restrict visibility safe entry /exit. The purpose and intent of subsections E and F is safe visibility which is unimpaired by the proposed fence. • • 10. Do any signs exist on the property?
