May23 1 STAFF REPORT PERMIT TYPE PUBLIC HEARING DATE PROPERTY ADDRESS/ ZONE/LOT SIZE SITE PLAN AMENDMENT MAY 23, 2024 7:00 PM 140 Woodland Rd/WSP /CLICK FOR PERMIT FILE Record #LU- 24-16 OWNER EXISTING USE HABITAT FOR HUMANITY LOT Summary of Request: Habitat is seeking removal of more trees in order to achieve net zero on the new home to be built. Originally the City did the pre-permitting with an assumed house site and orientation for solar access, but no solar study. The lot was then sold to Habitat with permits. Compliance with Zoning: The reason this needs an amendment is because the clearing limit line is being requested to be altered on the easterly side of the lot and on the south side. Even if there were not significant trees being proposed to be removed, an amendment would be required since the plan showed this area to remain undisturbed. Some thinning has been done on the west side that borders the road, however, the agreement with the neighbors was that these trees would remain as a partial screen from the road. 2 This permit was granted under 350.6.12 which allows for trees removed that are more than 20” to be replaced to the extent feasible but not in full compliance with 350-12.3A total of 7 trees (190”) are proposed to be removed that are over 20”. Normally that would require 95” of replacement. Habitat will plant 24” of new trees for a total of 12 trees for this amendment. The applicant’s solar study shows the shading that would be removed with the removal of the trees shown in the report. Habitat is proposing to replace Staff Recommendation: Given the data that has been submitted for solar access and the proposed new trees to be planted, staff recommends approval of the amendment. 5)
