I met with Colin yesterday and asked him to send me pictures of the deck, existing foundation
and a plan/detail showing how the deck will be mounted to the foundation. Please send the
rest of the pictures and the drawing/detail to me at your earliest convenience.
As you may know, the area where you have proposed to construct two decks falls within a
state jurisdictional resource area (Bordering Land Subject to Flooding) or within forty feet of
areas subject to flooding or inundation as listed in Section 24-2 in the Northampton Wetlands
Ordinance. It is the policy of the Conservation Commission not to sign off on a new permit
while there is an outstanding violation on the property. We understand that you have hired a
wetland scientist to complete the Notice of Intent for the unauthorized work in Bordering Land
Subject to Flooding, as noted in the Enforcement Order issued on May 16, 2005, and look
forward to reviewing the permit application.

Hello Bruce,
I have done the calculations for Tom Horton's floodplain volumes based on our discussion in the field and will be
passing them on to Huntley momentarily. But I thought I'd pass the details on to you so that if there are any
additional issues, they can be addressed before Huntley puts together an amended plan.
Pond: I have assumed a 6 foot expansion over a 2 foot change in elevation to the maximum surface elevation of
the pond. The cross-sectional shape is triangular. So -(2 x 6) / 2 = 6 square feet in cross-section. The outer
perimeter of the pond is somewhat more than 120 linear feet, for a total volume of 720 cubic feet to be divided
over 2 vertical feet from elevation 116 to 118. We discussed the rocks, but I haven't included those since they are
below the maximum water elevation and therefore occupy what would be the same volume as that occupied by
the water.
Stacked wood: 8 x 12 x 4 = 384 cubic feet to be divided evenly from elevation 119 to 123. Tom should just
remove this to a location outside the floodplain.
Rubble pile: 15 x 5 x 3 = 225 cf to be divided into 110 cf, 75 cf and 50 cf over elevations 119 -121 because the
pile's volume per vertical foot diminishes toward its top. Tom would likely remove this too.
Playhouse: I've alloted what I think is a generous 12 cubic feet for this and divided that evenly from elevation 119
-122. This might better be removed to the yard above the flood elevation.
Topsoil (3 inches): First, a question: Wasn't this accounted for in the receipted volumes? I'll have to check again
with Tom. But if not, I have assumed distribution over an area 40 feet wide and 1400 feet long, looking at the site
plan and recalling Tom's description. That works out to a total of 1400 cubic feet (40 x 1400 x 0.25 = 1400)
located entirely between elevations 116 -177.
Two sheds: According to the site plan, one is 10 x 10 and the other is 10 x 15. I have assumed an average of 2
inches wall and roof thickness, including 1 inch planking and 2 x 4 studs/rafters. I have also assumed that the
roof extends 1 foot beyond the walls in both directions. So shed 1: 10 x 4 x 2/12 = 6. 7 cf (each vertical foot of
wall) + 11 x 11 x 2/12 = 20 cf (roof). I distributed the 6.7 cubic feet of wall over 7 vertical vertical feet from
elevation 117 -124, and placed 20 cf into elevation 124 -125. Shed 2 is similarly calculated, distributing 8.3 cf
into each vertical foot from 117 -124, and 29.3 cf into 124 -125.
Now, Tom is planning to remove these two sheds -and will likely choose to to remove the piles and the playhouse
as well. But I will make sure of that before having the plan amended. I will also review the receipts to check the
volumes as we have discussed and will amend the final volumes to reflect that the material Tom removed from
the site does not count toward compensatory storage.
Another element is that the alteration of the floodplain does exceed 5,000 square feet, so according to DEP's
comments, we'll have to prepare an Wildlife Habitat Evaluation. Frankly, I think that's a waste of time -one of
those regulatory exercises that make no difference at all, but it will be done if it's required.
Finally, with regard to testing and disposal of contaminated soil -I reiterate that this is not my business at all.
don't touch contamination issues -never have, never want to -and I have had nothing at all to do with the
disposal of lead-contaminated soil from this site. I never saw the site when it was identified as a problem; I had
not spoken to Tom or anyone else associated with this site until well after the Enforcement Order was issued by
the Conservation Commission. All I have reported about the contaminated soil is what I've been told by Tom. I

Ken Patel's house over to you a week or two ago. Has the Order of Conditions been issued?
Also, I spoke with Tom Horton yesterday -he will be removing the sheds, the lumber pile and the rubble pile, so I
have revised the volume calculations to reflect that and the other information we discussed during the site visit.
Those recalculations have been sent to Huntley for plan revision and as soon as it is complete, I'll get it to you.

Bruce: I've been on a heavy travel schedule and have pretty much left this
process to Alec and Huntley. Alec tells me that Huntley has been backed-up
and had (see below) just at the end of last week supplied him with the
recalculation of the compensatory storage. In the meantime, I have removed
two sheds and am in the process of having the "rubble pile" which is in
fact
mostly good lumber, removed from my backyard. I feel like the application
work requires professional involvement. I suppose I could fire this group
and start over, but I'm not sure it would solve anything. Please know that
I'm doing every think in my power to move things along as it's also holding
up work on my house that I want done before the snow flies. If you have any
ideas for me, please advise. In the meantime, I'll keep on pushing.

point, it is necessary to stop all work and consider hiring a surveyor/environmental consultant to assist you
in putting together hydraulic and hydrologic calculations, elevations and drawings for the necessary permits
needed for the work that has been completed and the work you intend to do. If you have questions about

Huntley, who is preparing new drawings with the calculations on the
drawings, b) I have hired Tim Stokes of Acme Design to develop

drawings of the proposed barn and lean-too structure, and c) I am meeting
with Alex Macleod on December 30th to finalize all of the other
calculations, including the pond and cement "block" below the porch. I will
also have the remaining wood and debris removed from the property by B&B
waste early in the year. Please confirm that you will have no further
requirements as I am as I know you are committed to putting this all behind
us.

Hello Bruce,
The site plans have been revised to show the appropriate amount of compensatory storage, and I'm told they are
either in your office or on the way via mail. Also, the compensatory storage between 116 and 118 has been
moved to the rear of the lot, so that it is not in the place where Tom placed and covered the contaminated soil. It
turns out that the proper amount of complensatory storage was created in the grading, so Huntley did their part; I
just missed that one number when I was revising the table. My fault. ..
When will the public hearing be opened?

Wayne: Thank you for joining us and sharing with us a bit of background on Northampton. Marina is great
and internationally respected for her town planning work. I look forward, some day, to plugging into my
local Northampton community and playing a positive role to support the good work you are doing at the
planning office.
On a separate front, I wanted to let you know that we have worked up the compensatory storage numbers
for the retaining walls (about 11 cubic yards) and have brought a schematic map back to Huntley
Associates. They are going to put the retaining walls on a new map and put the new figures into the table
on the map and have this ready by noon tomorrow. I'll pick it up and bring it directly over to you and Bruce
at the planning office. Btw/ the folks at Huntly agreed that the retaining walls were a good idea and that the
40+ degree pitch bank would likely result in erosion, sending the soil back into the flood plane.

Once we have this all signed off, I will send you a detailed work plan for how we plan go about removing
the soil. As you'll remember, we have a few "hot spots" where lead showed up in the soil as a result, we
presume, of burying fly ash from soft coal. We have tested the soils at the back part of the property (horse
field) and there is no evidence of lead in that soil. We have not tested the soil on the bank below the pool
and adjacent to the barn where much of the soil is to be removed. What I propose to do is to remove the
soil and put it (on tarps) in a pile in the field. We can then test the soil and also have Huntly confirm that we
removed the appropriate quantity of soil. We'll provide you with both the soil tests and the "sign-off' from
Huntly. Depending on the soil tests, we'll sell/give away the soil or send it to the lined Northampton Landfill.
Please let me know if you think this approach makes sense.

Dear Bruce:
Thank you for your prompt review of the fill/compensatory storage situation at 115 Bridge
S1rect. We have calculated the additional fill caused by the support for the deck. and have
exami11ed where it falls within specific elevations below the 100-year flood elevation.
My original assessment that it would be within the same elevations for which we have already
provided additional flood storage was not entirely correct -it turns out that the deck support is at
a slightly higher elevation than I had thought. I have therefore distributed the 80 cubic feet of
volwne through elevations 120-123, and have also added more flood storage volumes in
elevations 118 -120 and 123 -125 to acknowledge the natural effects of excavating the
necessary volumes. The net effect is that we will be providing more additional storage than we
were initially providing in the original submission. The site plan will be amended to show tbe
additional excavation directly to the south of the originally proposed excavation between
elevations 118 -125.
I trust 1his clears up this issue, and that Mr. Horton's other permits can be released. Please call
me if you have any further questions or comments.

Additional proposed volwne: The owners wishes to complete their gardens and to construct a
bam to shelter their horses as well as materials associated with the horses. The gardens will
require a total ofl4.4 cubic yards ofloam to be placed within the wooden frames now in place.
The frames amount to 3.1 cubic yards for a total of 17.5 cubic yards displacement attributable to
the gardens-The volume of the barn is calculated based on a 25 by 35 foot barn with an internal
frame consisting of 12 vertical timbers 6 inches by 8 inches and on a sill of 6 x 8s. The 120
linear feet of sill amounts to 1.S cubic yards, and the vertical walls, including the posts, 120
linear feet of l inch external sheathing and 60 linear feet of internal walls made of I inch lumber
and dimensional 2 x 4s, displace 0.82 cubic yards per vertical foot.
PrQRQsed Work: lt is proposed to provide compensatory storage amounting to 68 cubic yards of
volume between the elevations of 116 and 125 feet above mean sea level, as shown on the
accompanying site plan and in Table 1, below. This approach will not disturb any potentially
contaminated soil. but will entirely satisfy the performance standards for work in Bordering Land

After both on and off site consultation with Conservation Agent Bruce Young, we have arrived
at adjusted volumes regarding work described in the Notice of Intent referenced above. The
adjusted numbers reflect not only compensatory flood storage for fill placed prior to issuance of
an Enforcement Order, but also to compensate for proposed construction of a small barn and a
lean-to shed.
Enclosed please find a table of fill volumes and compensatory storage volumes distributed
according to elevations and the specific categories of the fill for which compensatory storage is
to be created. Also enclosed is a grading plan showing the locations of the compensatory
storage.
We hope this information is sufficient to allow the Conservation Commission to complete its

Removed fill: Conservation Commission has determined that no credit will be given for debris removed from the site. This was

Pond Volume: Calculated as a triangular cross-section 2 feet deep and 6 feet across along 120 linear feet distributed evenly from
116-118 feet.
Playhouse: Calculated to occupy (at the very most) 12 cubic feet from elevations 119 -122 feet.
Gardens: Includes timbers framing the gardens and the loam to be placed inside them. The loam has not yet been brought on site.
Lean-to: The applicant wishes to attach a lean-to to the rear of the existing barn for storage of his tractor and other yard
machinery. This will consist of a roof (above the flood elevation) supported by four 4 x 4 posts on sonotubes installed flush with
the soil surface, which will be excavated to the 121 foot elevation to create a flat surface beneath the lean-to.
Barn: The foundation and sill of the 30 x 35 foot barn will be located within elevations 117 -118. The walls of the barn were
calculated to occupy 0.8 cy (22 cubic feet) per vertical foot up to (and beyond) the flood elevation.
Deck support: The deck support is a large concrete block upon which are posts leading up to the new deck.
