Dear Commission Members:
The attached Notice of Intent is filed on behalf of Thomas Horton describing work to remediate
lead-contaminated soil and improve the safety of a small pond on his property at 115 Bridge
Street in Northampton. In addition, the Mr. Horton proposes to finish construction of several
raised bed gardens and a 25 x 35 foot at-grade barn. The work area is located within the 100-
year flood zone of the Connecticut River.
Application fees of$42.50 has been paid to the Commonwealth of Massachusetts and $172.50 to
the City of Northampton, including the $105.00 application fee required under Northampton's
Wetlands Protection Ordinance. If you have any questions or comments regarding the Notice of

In accordance with the second paragraph of Massachusetts General Laws Chapter 131, section
40 and the Northampton Wetlands Protection Ordinance, you are hereby notified of the

The Northampton Conservation Commission meets on the 2nd and 4th Thursdays of each
month in Hearing Room 18, located on the 2nd floor of City Hall at 210 Main Street.
Notice of the Public Hearing, including its date, time and place, will be published at least five
(5) business days in advance of the Public Hearing in the Daily Hampshire Gazette legal ads
section.
Notice of the public meeting, listing all hearings, including the date, time and place, will be
posted in the Northampton City Hall not less than 48 hours in advance of the meeting date.

Contaminated Soil Remediation, Barn and Garden Construction

Project Narrative
PROJECT OVERVIEW
The parcel is a 3.1 acre property, part of which supports a house and barn, and the remainder is
under cultivation as garden, young orchard and horse pasture. It is located on the east side of
Bridge Street on the broad and relatively open floodplain of the Connecticut River. The back, or
east, portion of the parcel is within the 100-year floodplain of the River.
The area behind the barn at 115 Bridge Street was for years a dumping ground for an equipment
and small engine repair business. The area was also the receiving ground for excess concrete,
broken machinery, used batteries and other noxious material. As such, the soil turned out to be
heavily contaminated with lead, as was discovered during an assessment of vegetable garden
soil. The contaminated soil beneath the vegetable gardens was removed and, with consultation
with experts on the topic of contaminated soil, spread nearby, covered with two to three inches of
loam and seeded to grass. The soil was replaced with gravel in anticipation of creating a series
of raised bed gardens.
In addition to the soil remediation work, a small pond had been constructed by a previous owner
to receive drainage from beneath the barn, which had tended to fill with water, to the detriment
of its foundation. This pool drained to the city storm sewer about 20 feet away via a small
constructed channel. When originally constructed, the pool had been built with vertical sides in
the soil, presenting a hazard to the new owners' children, who were toddlers and would not have
been able to climb out if they had fallen in. The new owners therefore pulled soil back from the
sides to create a sloping bank and added some stone to stabilize the edges and provide te~ture.
They also installed a number of ornamental aquatic plants. The soil from the "beveled" banks
was also spread nearby.
The actions taken by the property owner were, unbeknownst to him, conducted within Bordering
Land Subject to Flooding; specifically, within the floodplain of the Connecticut River. For this
reason, the Northampton Conservation Commission has issued an Enforcement Order requiring
the owner to cease and desist any work in this resource area. The Order requires the owner to
present a Notice of Intent describing the area and the work, as well as any mitigation necessary
as a result of the work. This Notice of Intent is presented in compliance with the Enforcement
Order.
SITE DESCRIPTION
The project area consists of a very flat piece of land bounded to the west by a floodplain terrace,
to the north and south by abutting parcels and by open land to the east. The barn and attached

greenhouse extend into the floodplain, which is also bounded by a retaining wall located along
the steep terrace. The small pool receiving drainage from the barn foundation is located just east
of the greenhouse, and the ditch carrying flow from the pool to the city storm sewer stretches
from the northeast corner of the pool to the catch basin found at the boundary line between the
subject parcel and the neighboring property to the north. A horse pasture occupies the large
eastern block of the parcel. The Connecticut River is located about% mile to the northeast.
Hydrology
The hydrology of the site is ostensibly simple, other than during a flood event, at which time
things can become considerably more complex. The land is nearly level, the soils are silty
floodplain soils and rainfall infiltrates readily into the silty floodplain soils. However, there
appears to have been a seep or spring where the barn was constructed, such that the foundation
actually retained water when the original drain collapsed or otherwise became plugged. A small
pool had been constructed at the outlet of the original drain, with a small ditch dug from the
eastern edge of the pool to the existing city storm sewer, which crosses the property from north
to south. This storm sewer effectively drains the floodplain portion of the property, as it has two
inlets located at the north and south boundaries respectively. There are no streams or wetlands
on the site.
Soils
Map 14 of the SCS Soil Survey of Hampshire County, Western Part show the soil beneath the
study area to be Winooski silt loam (Ws). Winooski silt loam is described as deep and
moderately well drained. Neither soil is hydric, though Winooski silt loam is noted as having
inclusions of Limerick silt loam, a hydric soil associated with streams and other water bodies.
No streams or wetlands are located within the project site. Field investigation shows the soil
mapping to be accurate to at least the standard resolution of the soil survey process.
Vegetation
The subject property is mostly occupied by pasture. Near the house and outbuildings, the
vegetation consists of lawn and a few trees, mostly Silver Maples, and some older ornamental
shrubs. There is no plant community normally associated with a native gallery forest on the site.
RESOURCE AREAS
Resource Area Review Procedures
The property was reviewed for the presence of resource areas other than Bordering Land Subject
to Flooding using a multiple parameter methodology. This approach emphasizes the
determination of a prevalence of wetland plant indicator species as described in the US Fish and
Wildlife Service classification (Reed et al, 1988), as well as the 50% wetland vegetation criterion

as articulated at 310 CMR 10.55(2)(c) in combination with hydric soil identification and
determination as described in Field Indicators for Identifying Hydric Soils in New England
(NEIWPCC, 1995) and the US Anny Corps of Engineers Wetlands Delineation Manual
(Environmental Laboratory, 1987). Areas containing over 50% domination by wetland indicator
plants as well as hydric soils and other indicators of wetland hydrology would have been
included within the delineated wetland boundary, had Bordering Vegetated Wetland been
encountered. Wetland indicator plants are those plants listed as having a wetland indicator
status of Obligate (OBL), Facultative Wetland (FACW, including FACW+ and FACW-), and
Facultative (FAC or FAC+).
Bordering Land Subject to Flooding (BLSF): BLSF is located between the mean annual high
water elevation and the statistical 100-year flood elevation calculated for the purposes of
producing the FEMA floodplain maps. BLSF on this site is associated with the Connecticut
River.
REGULATORY CONTEXT
Massachusetts Wetland Protection Act: The Act identifies resource areas and buffer zones (to
BVW and Bank) and specifies certain performance standards to be incorporated into projects
impacting these jurisdictional areas. On this site, the resource area of concern is Bordering Land
Subject to Flooding.
Northampton Wetlands Protection Ordinance (the Ordinance): The Ordinance provides
protection and performance standards beyond those contained in the Act, including protection of
Isolated Vegetated Wetlands. The Northampton Conservation Commission has also determined
that it will maintain a policy of leaving at least a 50-foot undisturbed buffer between any work
and the wetland boundary. The term "undisturbed" includes cutting of vegetation, even mowing.
Natural Heritage and Endangered Species Program (NHESP): The Natural Heritage Atlas shows
that the study site is not located within the boundaries of any mapped Habitats of Rare Species
and Priority Habitats.
DESCRIPTION OF WORK
Work to Date:
Clean-up: Work in Bordering Land Subject to Flooding (BLSF) began when the owners first
took possession of the property about 6 years ago. Prior to the change in ownership, the barn had
been used as an equipment repair shop, and the detritus from that activity had been tossed out the
back to accumulate over many years. This detritus included arts, hardened puddles of leftover
concrete, construction debris and, most importantly relative to the current situation, old batteries.
All this material was picked up by the owners and removed to be recycled or landfilled, as was
appropriate to the material. This work in BLSF was entirely subtractive; that is, it involved
removal, not importation, of volume.

Foundation Drainage: In addition, the existing metal pipe carrying accumulating groundwater
from within the barn foundation had been rendered incapable of transmitting flow to the existing
pool just east of the barn, either by clogging or collapse, and was replaced by a plastic culvert
,that re-established th~~ the foundation. The barn foundation then had to be
repaired following to year.r·ofwater damage. This work in BLSF was volume-neutral, such th.rt
it had no effect on flood storage volume.
Pool Bank Shaping: When the pool near the east side of the barn was created, it was left with
vertical banks. The owners were concerned that their toddlers would not be able to get out of the
water if they fell in, so they graded the banks back to a more natural slope. This material was·
spread around the pond such that this work was also volume-neutral. They also moved flat rocks
from nearby areas to stabilize the bank and to provide texture so that the children would be able
to get a grip on the ground if they needed to. At the time of the work, there was little vegetation
around the pool other than lawn grasses and weeds. The owners planted the Weeping Willow
that is there now and more recently installed an number of aquatic ornamental plants.
Lead Contamination: illtf owners created vegetable gardens in the cleaned-up back yard. After
.Sfitffld years, they decided to have the soil tested for nutrie~ls. Since this testing also
includes analysis for lead levels, they found they had been growing their organic vegetables in
soil that was highly contaminated with lead (Appendix l contains the Soil Analysis Reports). In
that the owners have small children, this represented an immediate and urgent concern.
They discussed the matter with soil remediation specialists, who agreed that the best approach
was t.G' dig out the'OOftWninated&Oil, spread it evenly near'-cover it with an adequate layer (2
to 3 inches) of screerieafoanfartaseed it to grass. This approach avoids land-filling of the soil-
which may make the issue worse in the long run, especially if the soil is used as cover such that
it can be raised as dust, and secures the soil in place and covered both to prevent generation of
lead-laden dust and to promote long-term mitigation of the lead through bioremediation
processes.
The contaminated soil was therefore removed and covered by loam imported for that purpose.
Gravel was brought in to fill the holes left when the contaminated soil was removed. Appendix 2
contains the receipts for the loam and gravel applied to the property.
Current Net Volume: The ~d ~} material brought into the portion of the property located
within BLSF shows thaf-32'~ yards of gravel and 35 cubic yards of screened loam were
placed there, based on a generally agreed-upon conversion of 3,000 pounds to one cubic yard of
gravel (Appendix 2). This is based on the process of contaminated soil removal, such that the
contaminated soil was removed and spread to the rear, the gravel was brought in and placed in
the same volume as the contaminated soil previously occupied, and the screened loam was

placed on top of the spread contaminated soil. The record of material taken from the site is less..-···· 1 clear, but the owner reports that he removed at least 17 5-ton truck loads of trash and debris. ;
Using the previous ratio, this produces a figure of 28.3 cubic yards of material removed, leaving
a net increase of 38.7 cubic yards. It is assumed that this increase took place within the first two
feet above baseline elevation.

Additional proposed volume: The owners wishes to complete their gardens and to construct a
barn to shelter their horses as well as materials associated with the horses. The gardens will
require a total of 14.4 cubic yards of loam to be placed within the wooden frames now in place. Tne frames amount to 3.1 cubic yards for a total of 17.5 cubic yards displacement attributable to
the gardens. The volume of the barn is calculated based on a 25 by 35 foot barn with an internal
frame consisting of 12 vertical timbers 6 inches by 8 inches and on a sill of 6 x 8s. The 120
linear feet of sill amounts to 1.5 cubic yards, and the vertical walls, including the posts, 120
linear feet of 1 inch external sheathing and 60 linear feet of internal walls made of 1 inch lumber
and dimensional 2 x 4s, displace 0.82 cubic yards per vertical foot.
Proposed Work: It is proposed to provide compensatory storage amounting to 68 cubic yards of
volume between the elevations of 116 and 125 feet above mean sea level, as shown on the
accompanying site plan and in Table 1, below. This approach will not disturb any potentially
contaminated soil, but will entirely satisfy the performance standards for work in Bordering Land
Subject to Flooding.
