Standard Permit Conditions: 1. All clearing, grading, drainage, construction, and development shall be conducted in strict accordance with the following plans and information submitted with the application and as amended by any conditions attached to this permit: a. Campbell, P.E. b. Stormwater Management Plan, Proposed Orien Ridge Residential Development, dated May 22, 2006 and Revised July 11, 2006, prepared and stamped by Sara E. Campbell, P.E. 2. The Northampton Department of Public Works (DPW) or its authorized representative shall be provided access to the property to conduct inspections before, during, and after construction activities as necessary. The applicant shall arrange with the DPW to schedule the following inspections: Initial Inspection, Erosion Control Inspection, Bury Inspection, and Final Inspection. The DPW may also conduct random inspections to ensure effective control of erosion and sedimentation during all phases of construction. 3. Annual Reports that are stamped by a Registered Professional Engineer documenting the actions completed as required by the Operation, Maintenance and Inspection Agreement shall be submitted to the Northampton Department of Public Works by October lst of each year. 4. If construction of the proposed stormwater system has not started within five years of the issue date of this permit, then the permit will expire and a new permit will be required. Construction is defined as clearing, grading, excavation, filling, and installation of drainage structures on the lots specified in this permit. - - -- - -- Specific Permit Conditions: 1. Prior to issuance of a Building Permit, the applicant shall record an executed Stormwater Operation, Maintenance, and Inspection Agreement that is binding on all subsequent owners of land served by the private stormwater management facility by recording it in the land records of the Registry of Deeds. This agreement shall be approved by the Northampton DPW and signed by the owner and the Mayor of Northampton. Section 22- 85 of the Northampton Stormwater Management Ordinance provides additional guidance for the requirements of this agreement. The agreement shall include a list and schedule of maintenance tasks including but not limited to twice annual street sweeping, catch basin inspections and clean outs, stormwater treatment maintenance according to the manufacturers specifications, sediment forebay maintenance, detention basin maintenance, Swale maintenance, and retention pond maintenance to the satisfaction of the Northampton DPW. 2. This project will be required to submit one or more Notice of Intent (NOI) to the U.S. EPA for coverage under the NPDES Stormwater Construction General Permit. A copy of the final NOI and Stormwater Pollution Prevention Plan (SWPPP) shall be submitted to the Northampton DPW for approval prior to issuance of a building permit. The Landscape Plan (L-6) specifies the area that will be cleared and the area that will remain woods. Any expansion of the cleared area beyond that specified on the plan shall require an amendment to the Stormwater Management Permit approved by the Northampton DPW. All stormwater systems shall be installed as proposed and stabilized prior to receiving drainage flows and within 4 months of the installation of pavement or start of building construction. 5. Prior to issuance of any certificate of occupancy, the common driveway shall be constructed as proposed and conditioned by this permit, and all land adjacent to the common driveway shall be stabilized and vegetation established. Disturbed areas adjacent to the buildings will be stabilized and vegetated within four (4) months of a final certificate of occupancy for each building. 6. Prior to construction, the applicant must secure all necessary permits and approvals from the Massachusetts Highway Department for construction work in the State Highway System layout and proposed stormwater discharges to the stormwater system owned and operated by the Commonwealth of Massachusetts. 7. Test Pit # 1 submitted by the applicant show approximately 1.4 foot of separation between the bottom of the proposed detention basin and the seasonal high ground water level. While this does not meet the 4-foot separation required by the Northampton Stormwater Management Ordinance, review of the drainage calculations by the DPW shows that the proposed infiltration rate is not a significant factor in the functioning of the proposed detention basin. 7 /3 D6 Signature of City Engi er Date cc. The Northampton Department of Public Works (DPW) or its authorized representative shall be provided access to the property to conduct inspections before, during, and after construction activities as necessary. The applicant shall arrange with the DPW to schedule the following inspections: Initial Inspection during permitting, Erosion Control Inspection prior to the start of construction, Bury Inspection during installation of major components of the stormwater system, and Final Inspection at the completion of construction. The DPW may also conduct random inspections to ensure effective control of erosion and sedimentation during all phases of construction. 3. At the completion of the work, including construction of stormwater management facilities and landscaping, the applicant shall submit a statement to the DPW from a professional engineer of record in the Commonwealth of Massachusetts certifying that the materials and construction of the stormwater management system was constructed in accordance with the approved plans and will function as designed. All changes to the approved stormwater facilities shall be documented by a professional engineer of record in the Commonwealth of Massachusetts and approved by the DPW prior to submission of the certification statement described above. It is recommended that the applicant retain the engineer during construction of stormwater facilities to ensure that they are constructed in accordance with the approved plans and specifications. 4. Annual Reports that are stamped by a Registered Professional Engineer documenting the actions completed as required by the Operation, Maintenance and Inspection Agreement shall be submitted to the Northampton Department of Public Works by October 1 of each year. 5. If construction of the proposed stormwater system has not started within five years of the. issue date of this permit, then the permit will expire and a new permit will be required. The DPW shall require from the developer a cash escrow, irrevocable letter of credit, or other means of security acceptable to the DPW prior to the issuance of any building permit for the construction of a development requiring a stormwater management facility. The amount of the security shall not be less than the total estimated construction cost of the stormwater management facility. The guarantee shall include provisions relative to forfeiture for failure to complete work specified in the approved stormwater management plan, compliance with all of the provisions of the Northampton Stormwater Management Ordinance and other applicable laws and regulations, and any time limitations. The guarantee shall not be fully released without a final inspection of the completed work by the City Engineer, submission of "As- built" plans, and certification of completion by the Department of Public Works of the stormwater management facilities being in compliance with the approved plan and the provisions of this Ordinance. Specific Permit Conditions: 1. Prior to issuance of a Building Permit, the applicant shall record an executed Stormwater Operation, Maintenance, and Inspection Agreement that is binding on all subsequent owners of land served by the private stormwater management facility by recording it in the land records of the Registry of Deeds. This agreement shall be approved by the Northampton DPW and signed by the owner and the Mayor of Northampton. Section 281 -8 of the Northampton Stormwater Management Ordinance provides additional guidance for the requirements of this agreement. 2. This project will be required to submit one or more Notice of Intent (NOI) to the U.S. EPA for coverage under the NPDES Stormwater Construction General Permit. A copy of the final NOI and Stormwater Pollution Prevention Plan (SWPPP) shall be submitted to the Northampton DPW for approval prior to issuance of a building permit. The DPW requests the following revisions to the Draft SWPPP: -If the small bioretention basin located north of Station 9 +00 is proposed for use as a temporary sediment pond during construction, this bioretention basin must be carefully reconstructed to meet the projected infiltration performance of the approved final design of this basin. Specify the location, size and outlet of the proposed temporary sediment basins on Plan Sheet PL -5. -The proposed silt fence as shown on PL -5 must always be installed on the construction side of the proposed limit of clearing and not within the wooded area. -Silt Fence and /or other erosion and sediment control structures may be necessary during construction down gradient of the proposed detention basin located northeast of the access road and adjacent to North King Street. Define the protection of existing and new catch basins. 3. The Landscape Plan (L -6) specifies the area that will be cleared and the area that will remain woods. Any expansion of the cleared area beyond that specified on the plan shall require an amendment to the Stormwater Management Permit approved by the Northampton DPW prior to commencing cutting operations in these areas. A future Reserved Parking Area (19 spaces) has been shown on the plans located at approximately Station 6 +50 on the access drive. A stormwater system has not been designed or approved for this parking area. If this parking area or any other additional impervious surface is proposed in the future, the applicant shall be required to request and be granted approval of an amendment to the Stormwater Management Permit for this site by the Northampton DPW. 5. All stormwater systems shall be installed as proposed and stabilized prior to receiving drainage flows. 6. Prior to issuance of any certificate of occupancy, the common driveway shall be constructed as proposed and conditioned by this permit, and all land adjacent to the common driveway shall be stabilized and vegetation established. Disturbed areas adjacent to the buildings will be stabilized and vegetated within four (4) months of a final certificate of occupancy for each building. 7. Prior to the start of construction, the applicant must submit a cross section of the small bioretention basin adjacent to the road circle specifying materials for construction and depths of these materials similar to the cross section on Sheet PL -3.4 for the larger bioretention basin.
