Re: Easthampton Road / South Street (Route 10) – Notice of Intent

Dear Ms. LaValley:
On behalf of the Applicant, MassDOT, TEC is pleased to submit the Notice of Intent for the
Easthampton Road / South Street (Route 10) project located in Northampton, MA. The project
proposes to reconstruct a portion of the existing sidewalk east of Earle Street on South Street
and extend the existing sidewalk along the southern perimeter of South Street / Easthampton
Road. The project also proposes pavement milling and overlay of Route 10.
The project is located within the 100-foot buffer zone to Perennial Stream and 200-foot
Riverfront Area (RFA) of the Mill River. The project proposes alterations to 14,580 square feet
within the RFA as part of the project. 6,158 square feet of alterations are proposed within the
inner 100-foot buffer, with the remaining 8,692 square feet of alterations between 100 and
200-feet. Only 390 square feet of these alterations are considered a permanent impact, as the
rest will be redevelopment of existing roadway and sidewalk. The project does not propose
impacts to the Mill River. No mitigation areas are proposed, and the project will not affect flood
storage. A portion of the project is located within an Estimated Habitat of Rare Wildlife, outside
of the resource area. A MESA review will be filed along with the Notice of Intent.
As an agency of the Commonwealth providing essential government functions, MassDOT is
exempt from certain municipal requirements including but not limited to wetland bylaws,
ordinances and policies, and for paying peer review fees. Additionally, MassDOT is not required
to notify abutters per the WPA Regulations at 310 CMR 10.05(4).
The proposed sidewalk improvements conform to the Limited Project standard at 310 CMR
10.53(3)(f) which reads, “Maintenance and improvement of existing public roadways, but
limited to widening less than a single lane, adding shoulders, correcting substandard
intersections, and improving inadequate drainage systems.”
TEC trusts this project upholds all provisions of the Wetlands Protection Act. Please see the
enclosed submission, containing the Notice of Intent package and roadway construction plans.
