In Granting the Special Permit, the Zoning Board of Appeals found: A. The requested use protects adjoining premises against seriously detrimental uses because the sign is in keeping with the character of the surrounding business district. B. The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets, minimize traffic impacts on the streets and roads in the area because the sign will not affect vehicular and pedestrian movement behind as well as in front of the planting bed and sign, and it will reduce the safety hazards caused by large trucks hitting the sign when using A to Z's parking lot. C. The requested use will promote a harmonious relationship of structures and open spaces to the natural landscape, existing buildings and other community assets in the area because the sign is designed to be compatible with the character of the surrounding neighborhood. D. The requested use will not overload, and will mitigate adverse impacts on,the City's resources including the effect on the City's water supply and distribution system, sanitary and storm sewage collection and treatment systems, fire protection, streets and schools. E. The requested use meets all special regulations set forth in Section 7.2 (13)of the Zoning Ordinance. (see Attachment A) F. The requested use bears a positive relationship to the public convenience or welfare because it will notify the public of the presence of the three current businesses at this location. The use will not unduly impair the integrity of character of the district or adjoining zones because the sign is in keeping with other signs in the immediate vicinity. The use will not be detrimental to the health,morals, or general welfare, and the use shall be in harmony with the general purpose and intent of the Ordinance. G. The requested use promotes City planning objectives to the extent possible and does not adversely affect those objectives, as defined in City master or study plans adopted under M.G.L. Chapter 41, Section 81-C and D. The following conditions were imposed on this Special Permit: 1. The sign is to be no higher than 12 feet above grade, the signs surface area shall be no larger than 50 square feet and the sign width shall be no longer than 10 feet from pillar to pillar; 2. Location of the sign shall be in the present site of the old sign, the pole of the existing sign will be the location of front pillar on the new sign; 3. The iron fence shall be a 12 inch fence instead of the originally proposed 18 inch fence, and no drainage shall be allowed to spill onto driveways; 4. Sign shall be according to the plans submitted except for the brick planter shall be six inches lower resulting in a planter height of 2 feet above grade; 5. The lights shall not interfere with traffic, and the lights shall be directed upwards facing the individual sign; 6. No more than two lights shall be placed on each side of the sign face; 7. Any changes in said sign shall require a new or revised Special Permit unless the Special Permit specifies that no particular changes are allowed; 8. A permit will be required from the DPW if the drainage will be tied into the City's stormwater system; 9. The location of the existing driveway shall not be altered; 10. The applicant shall clear the planter bed of snow or other obstructions that may limit visibility for pedestrian or vehicular traffic. CERTIFICATE OF SERVICE Pursuant to M.G.L. ATTACHMENT A SIGN/SPECIAL PERMIT CRITERIA Section 7.2 (13) In Granting the Special Permit to allow a sign taller than otherwise permitted. the Zoning Board of Appeals found: A. Signs are located only where they are otherwise permitted in the district; and B. The architecture of the building, the location of the building and the land and the nature of the use being made of the building or land is such that signs of a larger size would not detract from the character of the neighborhood and should be permitted in the public interest. C. The Board of Appeals has specified the exact sign permitted, and the size and location of the sign. Any change in said sign requires a new or revised Special Permit. Pursuant to Massachusetts General Laws (MGL), Chapter 40A, Section 11, no Special Permit, or any extension, modification or renewal thereof, shall take effect until a copy of the decision bearing the certification of the City Clerk that twenty days have elapsed after the decision has been filed, or if such an appeal has been filed that it has been dismissed or denied, is recorded in the Hampshire County registry of Deeds or Land Court, as applicable and indexed under the name of the owner of record or is recorded and noted on the owner's certificate of title. The fee for such recording or registering shall be paid by the owner or applicant. It is the owner or applicant's responsibility to pick up the certified decision from the City Clerk and record it at the Registry of Deeds. The Northampton Zoning Board of Appeals hereby certifies that a Special Permit has been GRANTED and that copies of this decision and all plans referred to in it have been filed with the Planning Board and the City Clerk. The existing sign is 13.5 feet high, not including the 48" flood lamps atop the pole. The face of the sign is two sided, 6' by 8' lexan. The face advertises the presence of the Coffee Gallery and Friendly's as well as the bank. The present sign is subject to regular contact by the leading edge of large tractor-trailer trucks driving under the sign to use A to Z's driveway. As a result, the sign is twisted and skewed about a foot from its true position. The concrete at the foal'of the sign has deteriorated and needs replacing, as well. In replacing the sign, it is our intention to 1) eliminate vehicular contact with the sign, 2) replace the deteriorated concrete base with a brick and stone planting bed that will serve as a base for the sign as well as a certain divider between A to Z's driveway and the Bank's, 3) construct a slightly smaller and significantly more attractive sign than the present sign The proposed sign is congruent with architecture of surrounding buildings and the character of the neighborhood in terms of scale,proportion and materials. Your attention is particularly drawn to the Hotel Northampton sign across the street, similar in may respects to the proposed sign, though larger, and to the planters directly across the street from the Bank.. The proposed sign will be supported between two brick pillars that rise from the planting bed(see drawings). The top of the brick pillars (and the sign) will be 11' from the ground. The pillars will be crowned with matching stone urns, 16 "tall, that in 1947 adorned the front roof corners of the present Bank building, then the First National Store. The urns have been stored in the basement of the Bank for several decades. The face of the proposed sign will be divided into three parts, one for each of the three included businesses. However, the total sign surface will be 45 sq. ft. rather than the 48 sq. ft. of the present sign. The sign will be lit from flood lamps located as unobtrusively as possible within the planting beds. The planting bed will end before the corner of A to Z building to permit the passage of pedestrian traffic behind as well as to front of the planting bed and sign.
