Page 1 of 2 The recent 2 -18 -08 decision on the fire escape spiral staircase asked me to put a curb stop to prevent cars from backing too close to the staircase. The curbstop was to stop cars, vehicles, at the tire level (can't run tires over it). The problem...the curbstop has to be 5 feet away from the staircase. This is because wheels are located 3 -4 feet under a car (if backing in), and farther with some larger vehicles. A curbstop, approx 6 feet wide and 5" high, located 5 feet from the staircase; will stop cars from backing further„ BUT, I believe it will present other serious problems. First, my snowplowing service doesn't send the same driver each time. Under snow there is no way it can be 4/9/2008 identified, or is expected to be there....so, snowplows will be broken on it (really).. also, knock it -out of -place or damage it.. The same applies to people, who may fall on it in fresh snow„ or trip on it when stepping out of their car, or drive into it and damage their cars wheel alignment, or suspension. It's just not expected to be there, except to the regular use tenants. Ultimately, it presents a liability, and reasonably a kind of negligence (among us decision- makers for.not having a better vision) if someone gets hurt, or property is damaged. I am requesting, at my option, to put in appropriate protection (curbstop or solid post) if or as needed, to protect the staircase from damage, and to be sure vehicles cannot come close enough to block the lower stairs in an emergency. The design of the staircase itself (if possible) may provide this without adding peripheral obstructions, curbs, or posts, which I am concerned may present hazards in themselves. I believe it is best to install the staricase, which may include a built -in buffer....then take a look. After the staircase is installed, "my option" can involve your approval at that time. I want this to be solid, safe, and protected. I'm not looking for shortcuts, just the best long term solution without problems, or liabilities. It may be too close to an existing egress. The secondary egresses need to be far enough away from an existing egress so as to provide a sufficiently safe alternative for existing the building. i.e., all the egresses can't be in the same location, in case of fire, etc.) Evidently you have been asked to supply a floor plan in order for the Dept. to make that determination. Please contact the Building Department and supply the floor plan as soon as possible. If that is supplied and a determination can be made that this new location complies with the building code and zoning ordinance, sometime tomorrow depending on availability of Building Dept. staff) the Elm Street Commission will go ahead with its review tomorrow night...
