If at the end of the first 24 months of operation of your System, and every 12 months thereafter, the cumulative kilowatt hours produced by your System is less than the applicable Cumulative Guaranteed System Generation for that period, as set forth in Table 1, then IGS Solar will provide you a credit equal to the difference between the cumulative kilowatt hours produced by your System and the Cumulative Guaranteed System Generation. The credit per kilowatt hour will be equal to the annual total Monthly Lease Payments divided by the Annual Estimated System Generation for the applicable Contract Year. Any kilowatt hours that are credited will then be considered as part of the total cumulative kilowatt hours produced by the System going forward. ACCOUNT SETTLEMENT.At the end of the first 24 months of operation of your System, and every 12 months thereafter, IGS will determine if the kilowatt hours produced by your System met the Guaranteed Annual kWh for that period.Within three months of this calculation,IGS Solar will issue any credits,if applicable,to your account which will be displayed on your monthly invoice, and will be used to offset any amounts owed to IGS Solar. IGS Solar will not seek reimbursement for any credits it has provided should overproduction subsequently occur. You will never be charged more than your Monthly Lease Payment amount for your System production,as displayed below. LEASE TRANSFER&TERMINATION.Any credits due under this Production Guarantee belong to the Lease counterparty at the time the credits are issued. If you transfer the Lease, all rights hereunder transfer to the new Customer under the Lease. If you terminate the Lease or purchase the System, this Production Guarantee will automatically terminate. However, if you pre-pay your Lease the Performance Guarantee will remain in effect. SYSTEM SPECIFICATIONS. This Production Guarantee is an estimate based upon your initial System design at the time of Lease signing. Because every home has unique features (such as roof design, tree shading, exhaust vents, skylights, chimney placement, surrounding structures, etc), so too is the design of every residential solar project. While we aim for the most accurate initial System design and production estimates, it is commonplace that between the initial System design and final System design some adjustments may need to be made to the design of your System for aesthetic and efficiency purposes. If the System design is modified, the estimated production of your System may change as well, and by extension the Production Guarantee in Table 1.By signing this Lease, you acknowledge and accept that the Final Production Guarantee may vary by up to 5%from the estimates initially provided in Table 1, and should this occur,we will provide you with an updated Final Production Guarantee once your System has been installed and energized. If the Final Production Guarantee varies by more than 5%from the estimates in Table 1, we will contact you and execute a Contract Amendment. SYSTEM DEGRADATION.The Production Guarantee assumes a System production degradation rate of 0.5%for every Contract Year. EXCLUSIONS. The Production Guarantee does not apply to the extent that any of the following events result in a material change in the production of the System: (a)System repair as the result of customer interference; (b)Any home repair that causes the System to be offline, including the installation of a new roof; (c)System damage not caused by IGS Solar or its contractors; (d)Breach of your obligations under this Lease, including failure to properly maintain foliage to prevent shading and failure to make Monthly Lease Payments; (e)Newly built or modified structures that result in shading and/or interference that was not contemplated when the System was designed; (f)Theft or destruction of the System; (g)System curtailment or outage(s)caused by the local electric utility or state regulatory authority; (h)A Force Majeure event,as defined in Exhibit 2;and/or (i)Inability to complete the Account Settlement process because the System was offline or the data required for the calculation was permanently lost. • • RESIDENTIAL SOLAR EQUIPMENT LEASE AGREEMENT 1 RS.SL.CS.1022 Lease Production Guarantee DocuSign Envelope ID:7D2111B0-317C-4F4F-9CB4-3F5A6330C75C Production Guarantee: Table 1 Contract Annual Estimated Cumulative Monthly Lease Guaranteed Annual Cumulative Year System Generation Estimated System Payment System Generation Guaranteed System (kWh) Generation(kWh) (kWh) Generation(kWh) 1 7908 7908 160.00 6722 6722 2 7868 15776 164.64 6688 13410 3 7829 23605 169.41 6654 20064 4 7790 31395 174.32 6621 26685 5 7751 39146 179.38 6588 33273 6 7712 46858 184.58 6555 39828 7673 54531 189.93 6522 46350 8 7635 62166 195.44 6489 52839 9 7597 69763 201.11 6457 59296 10 7559 77322 206.94 6425 65721 11 7521 84843 212.94 6393 72114 12 7483 92326 219.12 6361 78475 13 7446 99772 225.47 6329 84804 14 7409 107181 232.01 6297 91101 15 7372 114553 238.74 6266 97367 16 7335 121888 245.66 6235 103602 17 7298 129186 252.78 6204 109806 18 7262 136448 260.11 6172 115978 19 7226 143674 267.65 6142 122120 20 7190 150864 275.41 6111 128231 21 7154 158018 283.40 6081 134312 22 7118 165136 291.62 6050 140362 23 7082 172218 300.08 6020 146382 24 7047 179265 308.78 5990 152372 25 7012 186277 317.73 5960 158332 CUSTOMER: IGS SOLAR, LLC: —DocuSSiigned by: / P71,_ -)- -- baj..1\, 111,14-:.,LL Signature J ` Signature Oh h JUOZUAtlJ04l.`J...
