This Limited Warranty is provided by Contractor. Contractor warrants that,under normal use and service conditions,the System will be free from defects in workmanship or defects in materials or components for ten (10) years following the date of Owner's receipt of materials. This Limited Warranty covers installation hardware, brackets and supports, and all other components not covered by a manufacturer's warranty. If a defect is discovered and noticed to Contractor during the warranty period,Contractor will,at no additional cost to Owner, provide such labor and materials as required to restore the System to its originally installed state. Contractor is not responsible for replacement of or damage to these items if they are removed by Contractor during installation. 8.Owner Obligations.Owner agrees to:(a)Only have the System repaired pursuant to the Limited Warranty(as defined herein);(b)Not modify the Property in a way that shades the System;(c)keep trees and bushes trimmed so that the System receives as much sunlight as it did at Installation;(d)Not do anything,or permit or allow to exist any condition or circumstance which would cause the System not to operate as intended(e)Permit Contractor,after providing reasonable notice,to inspect the System for proper operations,and to make any necessary repairs;(f)Not to make any modifications,improvements,revisions or additions to the System or to take any other action that could void the Limited Warranty without Contractor's prior written consent. In the event that Owner fails to comply with the provisions of this paragraph, Owner's Limited Warranty shall be automatically voided. Except as expressly provided in this Contract,including the warranties attached hereto,this Contract does not include system maintenance,the upkeep and services required or recommended to keep the system operating as intended. 9.Liability.Contractor assumes no liability for damage to:improperly installed,improperly maintained,defective,old,or deteriorated roof coverings or supports;siding;exterior covering or paint;underground pipes;sewer or drain lines;tanks;or any other non-visible installations. Contractor's liability shall be limited to the Installation area specified in the system design.Contractor shall not be liable for damage to deteriorated or improperly installed sub-roof or roofing within the serviced area.Contractor's liability with respect to the roof shall be limited to the Roof Limited Warranty(as defined herein). OWNER IS NOT PERMITTED TO RELY ON ANY ESTIMATES OF PRODUCTION.OWNER'S EXECUTION OF THIS CONTRACT IS AN EXPRESS ACKNOWLEDGMENT THAT CONTRACTOR MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING PRODUCTION. 13.Insurance.Contractor will carry liability insurance covering personal injury in an amount not less than$1,000,000,and insurance covering property damage caused by the work of a home improvement contractor in an amount not less than$2,000,000.Owner acknowledges that upon delivery of the materials to Owner,ownership and risk of loss shall pass to the Owner.Owner acknowledges that Contractor will not cover nor carry property insurance to cover damage or loss of the System or its components except as expressly set forth herein. 14.Past Due Payment Policy.Unless otherwise agreed to in writing by Contractor,Owner understands that payment in full is due at Installation Start and at Interconnection.An interest charge of two percent(2%)per month will be charged on any outstanding balance not paid within 15 days of such date(s).In the event the account is turned over to an attorney for collection,Owner shall pay interest charges and reasonable attorney's fees allowed by the law.There is a$50.00 return check charge. If the Owner defaults on any payments due hereunder or any terms or conditions or in the event that the Owner makes an assignment for the benefit of creditors,files a petition in bankruptcy,or otherwise admits his/her/their inability to pay debts as they become due,then the Contractor may cease all work under this contract and shall be entitled to receive from the Owner the value of all work and services performed and materials and equipment furnished hereunder plus 25%as liquidated damages,minus any payments already made hereunder.In no event,however,shall the amount due exceed the full contract price(which shall include extras authorized by owner)plus attorney's fees if turned over to an attorney for collection and accrued finance charges due to delinquency of payments due under this Contract.Where applicable by law,any rights to Contractor and/or Mechanics liens shall be considered waived by Contractor upon receipt of any and all outstanding balances owed. 15.Entire Agreement.This Contract cannot be modified or discharged orally unless consent in writing is made by Contractor and Owner(the "Parties"),and this Contract shall be binding upon the heirs,successors,and permitted assigns of the Parties.This Contract supersedes all agreements,oral or written,previously made between the Parties.There are no other understandings or agreements,except as contained in the addenda listed below.The proposal,all Exhibits and Addenda are incorporated herein by reference and made a part of the Contract.
