legal ad proof3300276 NOTICE OF INTENT TO REQUEST RELEASE OF GRANT FUNDS JULY 11, 2014CITY OF NORTHAMPTON - COMMUNITY AND ECONOMIC DEVELOPMENT OFFICE 210 MAIN STREET - CITY HALL NORTHAMPTON, MA 01060Margaret Keller 413-587-1288 On or about July 30, 2014 the City of Northampton’s Community and Economic Development Offi ce will submit a request to the United States Department of Housing & Urban Development (HUD) for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing & Community Development Act of 1974, as amended, to undertake the following project:Demolition of 23 Laurel Street / Northampton Massachusetts $30,000This project will accomplish the removal of a dilapidated farmhouse on the former Northampton State Hospital property now owned by the Northampton Housing Authority.The proposed activity outlined above is categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on fi le at the Community and Economic Development Offi ce, City Hall, 210 Main Street, Northampton, MA and may be examined and copied weekdays between the hours of 8:30 a.m. and 4:30 p.m. PUBLIC COMMENTSAny individual, group, or agency may submit written comments on the ERR to the Community and Economic Development Offi ce. All comments received by July 28 will be considered by the City of Northampton prior to authorizing submission of a Request for Release of Funds. RELEASE OF FUNDSThe City of Northampton certifi es to the U.S. Department of Housing & Urban Development (HUD) that David Narkewicz, in his offi cial capacity as Mayor of the City of Northampton, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfi ed. HUD’s approval of the certifi cation satisfi es its responsibilities under NEPA and related laws and authorities, and allows the City of Northampton to use CDBG Program funds for the purpose specifi ed. OBJECTIONS TO RELEASE OF FUNDSThe U.S. Department of Housing & Urban Development (HUD) will consider objections to its release of funds and the City of Northampton’s certifi cation received by July 28 or for a period of fi fteen days following its actual receipt of the request (whichever is later) only if the objections are on one of the following bases: (a) the certifi cation was not executed by the Certifying Offi cer of the City of Northampton; (b) the City of Northampton has omitted a step or failed to make a decision or fi nding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written fi nding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD at the Boston Area Offi ce, 10 Causeway Street, Boston, MA 02222-1092.
