The multi-stage project will encompass the installation of automatic sprinklers throughout the building, a new fire detection system, accessible bathrooms, and bring the building into full code compliance. Phase-1 The first phase will include the installation of sprinklers throughout the sanctuary building including the attic and basement as well as the office and smaller rooms in the rear of the sanctuary structure. The entire area is to be protected by either a Wet Shotgun System which will provide protection in common heated areas or a Dry Pipe System for areas that are subject to freezing. Prior to finalizing the drawings related to the sprinkler system, we will complete a water flow test to determine the area's water pressure and will hire engineers to develop a Hydraulically Calculated System plan. This detailed plan will take into account the water flow and all requirements for a new incoming water line from the street. (note: the existing line is only 1" and is insufficient for sprinklers). Once this step is completed, we will submit detailed drawings along with a permit application to begin the sprinkler system installation for phase-1. In conjunction with Phase-1, we will begin replacing all exterior doors as part of a building-wide security project (BOMBYX received state funding to replace doors, install new lighting, and implement a comprehensive security and access control system). This will also be a separate permit. Phase-2 The second phase is focused on the "core" or"connector" section of the building that connects the original sanctuary and Parish Hall structures. The new sprinkler and detection systems will be extended to core areas including the preschool, kitchen, multi-use room, bathrooms and offices (note: there is a separate kitchen renovation project happening in tandem, which includes an Ansul system that is separate from the sprinkler system). As part of Phase-2, we will also be constructing two new ADA compliant restrooms. You will find a preliminary sketch in the enclosed drawings, however, a more detailed plan will be submitted with a permit application for that work when the time comes. The proposed work involves converting the facility into a full-time multi-purpose community center with potential renovations and a new entrance addition. This code summary is based on a site visit conducted on November 2, 2021. According to IEBC MA Amended Section 104.2.2.1, any building regulated by 780 CMR undergoing a renovation must be investigated and evaluated in accordance with the code in a written report form. The purpose of this report is to serve as the existing building evaluation report for its major fire protection, life safety, and accessibility features. Work Area and Classification of Work: The requirements in the IEBC are based on the classification of the work as Alteration Level 1, 2 or 3. This is based on the extent of the project "work area", which is defined as the area within which architectural reconfiguration will occur (IEBC Chapter 2). Areas where the only work will be new finishes, furnishings, or installation of new building systems are not classified as part of the work area. The levels of work area defined as follows: Level 1 Alteration No architectural reconfiguration, no work area. Level 2 Alteration Aggregate size of work areas (architectural reconfigured area) does not exceed 50% of the gross building area. Level 3 Alteration Aggregate size of all work areas (architectural reconfigured area) exceeds 50% of the gross building area. The proposed scope of work under consideration is expected to be classified no higher than a Level 2 renovation since not more than 50% of the building area will be reconfigured. Level 2 Alterations must comply with IEBC Chapters 7 and 8. The use of the original main church for music, dance, or theater productions requires the space to be classified as a Use Group A-1 occupancy which is considered a change in occupancy classification and requires compliance with IEBC Chapter 10. Reportedly the space is already used for non-religious events and if this has already been approved by the building official it may not be considered a change in use. However, that would need to be reviewed with the building department (and could potentially lead to an order to stop having non-religious gatherings). 2. Exterior Wall Openings Since the relative hazard category of the existing Use Group A-3 occupancy is the same as the proposed Use Group A-1 occupancy in IEBC Table 1012.6, the existing exterior walls fire ratings and existing openings are allowed to remain without further compliance (IEBC 1012.6.2). In addition, it appears all of the building perimeter has a fire separation distance of 10 feet or more and therefore no exterior wall ratings would be required by the IBC even for new construction. 6. Vertical Openings: All existing vertical openings in the work area connecting two or more floors must be enclosed with 1 hour rated construction and approved opening protectives unless the Florence Congregational Church November 12, 2021 Page 4 openings meet one of the exceptions in IEBC 803.2.1. Since the Relative Hazard in IEBC Table 1012.4 is the same for Use Groups A-3 and A-1, the change in occupancy does not trigger any additional compliance for existing stair or other shafts (IEBC 1012.7.2 & 1012.7.3). New vertical openings are required to comply with IBC 712 & 713. The building includes various interior stairways, some connecting the 1st and 2nd Floors and others connecting the Basement and 1st Floor. However, none of the stairs extend continuously from the Basement to the 2nd Floor (connecting three stories). Currently the existing stairs in the building are not enclosed with fire-rated construction. If they are located within the work area (defined as the architecturally reconfigured area" a 30-minute rated enclosure would be required for each two-story stair (IEBC 803.2.1 Exception 4). Alternatively, if a 1-hour enclosure is provided to separate the stairs leading to the Basement from the 1st Floor, the stairs between the 1st Floor and 2nd Floor can be classified as exit access stairways in accordance with IBC Section 1019.3 and can remain open. The stairs between the main level and mezzanine in the sanctuary are also permitted to remain open (IBC 712.1.11). 7. Interior Finishes: The existing interior finish of walls and ceilings in the work area and in all exits and corridors serving the work area must comply with the code requirements for new construction (IEBC 803.4). All newly installed wall and ceiling finishes, and interior trim materials must also comply with IBC Table 803.11 (IEBC 702.1, 702.2, 702.3). Means of Egress: A change in occupancy classification from Use Group A-3 to Use Group A-1 does not result in an increase in the Relative Hazard in IEBC Table 1012.4 and therefore does not require further compliance for the existing means of egress. Means of egress conforming to the requirements of the building code under which the building was constructed are considered compliant means of egress if, in the opinion of the code official, they do not constitute a distinct hazard to life (IEBC 805.1). This section allows the existing means of egress stairs. doors, etc. to remain unless they are considered hazardous. During the site visit, a few hazardous egress conditions were noted: 1. Illuminated exit signs and means-of-egress lighting must be provided in accordance with the code for new construction (780 CMR 102.6.4). The building includes a mix of illuminated and non-illuminated exit signs, all exit signs must be illuminated. The building also does not appear to include adequate emergency lighting. Florence Congregational Church November 12, 2021 Page 6 9. Required Fire Protection Systems: The building has an existing fire alarm and detection system, and fire extinguishers. It is not protected by an automatic sprinkler system. A change in occupancy from Use Group A-3 to Use Group A-1 requires sprinkler protection and a fire alarm system in compliance with the code requirements for new construction (IEBC 1012.2). These systems must be provided throughout the building unless the area undergoing the change in use (original sanctuary) is separated from the remainder of the building by 2-hour fire barriers, in which case only the change in use area must be protected. Even if the work is not considered a change in occupancy (i.e. the building department has already approved the use of the sanctuary for non-religious events), the following fire protection systems are required in the areas noted if the building is renovated: • Automatic sprinkler protection is required throughout work area if work area serves occupant load greater than 30 and work area exceeds 50% of floor area (IEBC 804.2.2). Also see the discussion on Massachusetts General Law below which can require sprinkler protection throughout the building independent of the building code requirements. • Fire extinguishers (527 CMR 1 Section 13.6 & IBC 906.1). Fire extinguishers must be located throughout the building so that the maximum travel distance to an extinguisher is less than 75 feet. M.G.L. Chapter 148 Section 26G Since the building is over 7,500 gross square feet in area, it is subject to the requirements of M.G.L. Chapter 148 Section 26G. These amendments require the entire building to be provided with sprinkler protection if the renovations are considered "major". Renovations are considered major depending on the type of work and the scope / cost of work. The following are general guidelines established by the board to be used to determine if the scope or the cost of the planned alterations are major: 1. Major alterations are reasonably considered major in scope when such work over a 5 year period affects 33% or more of the total gross square footage of the building (measured from the outside walls, regardless of firewalls). 2. Major alterations are reasonably considered major in scope or expenditure, when the total cost of the work over a 5 year period, excluding costs relating to sprinkler installation, is equal to or greater than 33% of the assessed value of the building, as of the date of permit application. Major alterations would include work such as the demolition or reconstruction of existing ceilings, sub flooring, walls, stairways, doors, or the removal or relocation of a significant portion of the building's HVAC, plumbing, or electrical systems. Cosmetic work such as painting or installing / replacing carpeting would be considered minor and would not trigger compliance with this law. Florence Congregational Church November 12, 2021 Page 7 Also, regardless of whether the remainder of the building is renovated, if an addition of any size is constructed the entire existing building must be provided with an automatic sprinkler system throughout. 10. Energy Code Provisions for Existing Buildings New work is subject to the 2015 International Energy Conservation Code (IECC) or ANSI/ASHRAE/IESNA 90.1 with Massachusetts Amendments (Massachusetts Energy Code). Level 2 alterations to existing buildings are permitted without requiring the entire building to comply with the energy requirements of the International Energy Conservation Code (IECC). The alterations (new elements) shall conform to the energy requirements of the IECC as they relate to new construction only (IEBC 811.1). The Massachusetts Stretch Code as adopted by the City of Northampton does not apply to existing buildings renovations or additions (780 CMR Appendix AA 101.2). 11. Ventilation Requirements All reconfigured spaces must provide mechanical or natural ventilation in accordance with the International Mechanical Code, except that existing ventilation systems are permitted to remain provided they achieve not less than 5cfm of outdoor air per person and not less than 15 cfm of ventilation air per person (IEBC Section 809). 12. Structural Provisions for Existing Buildings Any structural alterations to buildings must be evaluated by a registered structural engineer to determine compliance with the IEBC and IBC. The change in use structural requirements are as follows: • Where the change results in higher uniform or concentrated loads based on IBC Table 1607.1 must comply with the gravity load provisions of the IBC for new construction (IEBC 1007.1). Since the religious hall has fixed seating, the uniform load in IBC Table 1607.1 is the same for either Use Group A-3 or Use Group A-1, therefore there is not an increase in the gravity loads further compliance is not required. • Where the change results in a higher risk category in IBC Table 1604.5, the building must comply with the wind, snow, and seismic load requirements for new construction (with some exceptions) (IEBC 1007.2 & 1007.3). Since the risk category in IBC Table 1604.5 is the same for Use Group A-3 or A-1, no further compliance is required due to the change in use. Accessibility for Persons with Disabilities Massachusetts Architectural Access Board Regulations Alterations to the building must comply with the requirements of the Massachusetts Architectural Access Board Regulations (521 CMR). For existing building alterations the requirements of 521 CMR are based on the cost of the proposed work: A. If the cost of the proposed work is less than $100,000, only the new work must comply. B. If the cost of the proposed work is greater than $100,000 then all new work must comply and the existing building must include an accessible public entrance, toilet room, telephone and drinking fountain (if public phones and drinking fountains are provided) (521 CMR Section 3.3.1(b)). Exempt work when calculating the cost of work includes roof repair or replacement, window repair or replacement, and repointing and masonry repair work unless the exempt work exceeds $500,000. C. If the cost of the proposed work is greater than 30% of the full and fair cash value of the existing building, the entire building is required to comply with 521 CMR (521 CMR Section 3.3.2). There is no exempt work, i.e. the entire project costs apply to determining the 30% criteria. The cost of all work performed on a building in any 36 month period must be added together in determining the applicability of 521 CMR (521 CMR Section 3.5). The full and fair cash value of the existing building is determined by using the 100°/0 equalized assessed value of the building on record with the city assessor's office. Based on the City of Northampton Assessor's on-line database, the assessed value for the building (not including the land) is $764,190 (see attached Appendix). The State Department of Revenue's website indicates the assessment ratio for Northampton is 0.95. Therefore, the 100% equalized assessed value is $804,410 and full compliance with 521 CMR is required if the cost of renovations and/or an addition exceed $241,323. If the renovation triggers the 30% threshold, all portions of the building open to the public must be upgraded to comply in full with the current requirements of 521 CMR. Any employee-only areas such as staff lounges, staff bathrooms, and staff work areas are not required to comply with 521 CMR, as long as public access is not permitted. Major upgrades required to meet full compliance with the provisions of 521 CMR will likely include the following building features (not this is not a comprehensive list of deficiencies): • All public entrances must be accessible (521 CMR 25.1) The existing building appears to have four entrances (main entry to day care, side entrance to the social hall, front entrance to the social hall, entrance from day care playground, and the main entrance to the sanctuary). Currently only the side entrance to the social hall and main entrance to the sanctuary appear to be accessible. Vertical access to all floor levels (521 CMR 28.1) Currently the 2nd Floor and Basement Day care are not accessible (the building does not have an elevator). If in the future either level was not open to the public (i.e. the 2nd Floor is employee only space), an elevator could potentially be avoided. • Accessible toilet rooms must be provided in each toilet room location (521 CMR 30.1). None of the existing toilet rooms are accessible. • Stairs must have compliant handrails along both sides (521 CMR 27.4). Treads and risers must be of uniform depth (i.e. winder treads are not permitted) and stair nosings cannot be abrupt. None of the existing stairs have compliant handrails and many that are not covered by carpet have abrupt tread nosings. The second means of egress from the sanctuary balcony includes winder treads. • A wheelchair accessible route to the stage/platform in the sanctuary is required (521 CMR 14.6). Currently there isn't any accessible route to the stage/platform, a ramp or vertical wheelchair lift would be required. Variances to the requirements of 521 CMR are also granted by the Access Board when it can be shown that full compliance is "impracticable' (521 CMR 4.1), which is defined as follows: IMPRACTICABLE/IMPRACTICABILITY: (a) Compliance with 521 CMR would be technologically unfeasible; or Florence Congregational Church November 12, 2021 Page 10 (b) compliance with 521 CMR would result in excessive and unreasonable costs without any substantial benefit to persons with disabilities. This may include technical variance for specific items to allow reduced or alternate accessibility in lieu of full compliance, or a request to delay compliance for a limited time period can also be requested. Americans with Disabilities Act Guidelines The ADA Guidelines are not enforced by the Commonwealth of Massachusetts, they can only be enforced through a civil lawsuit or complaint filed with the U.S. Department of Justice. Compliance with the ADA Guidelines is triggered by renovations to the existing building. All renovations to the building must be made to ensure that, to the maximum extent feasible, the altered portions of the facility are readily accessible to and usable by individuals with disabilities (28 CFR Part 36 Section 36.402(a)). Alterations made to provide an accessible path of travel to altered areas and accessible facilities (i.e. provide accessible toilet facilities) are not required if the cost exceeds 20% of the total cost of the alteration (28 CFR Part 36 Section 36.403(f)). However, if the cost to meet these accessibility requirements does exceed 20%, alterations are still required to the maximum extent that the area can be made accessible without exceeding the 20% criteria (28 CFR Part 36 Section 36.403(g)). The ADA also contains less stringent dimensional requirements for some building elements in an existing building where it is infeasible to meet the requirements for new construction (ADA Section 4.1.6). 14. Plumbing Fixtures: 248 CMR: The Massachusetts State Plumbing Code The Massachusetts Plumbing Code (248 CMR) regulates the number of plumbing fixtures required throughout buildings. For existing buildings the plumbing code only states that the minimum plumbing fixture requirements apply to "installation, alteration, or extension" projects (248 CMR 10.10(18)(a)). The plumbing code doesn't specifically address a change in use, however it can be subject to interpretation by the plumbing inspector. The plumbing code occupancy classifications also don't all directly correspond to the building code designations. The existing assembly spaces in the building would likely be considered a "House of Worship) in 248 CMR 10.10(18) Table 1. The new occupancy as a community center would likely be considered a "Hall" which has the same fixture requirements as a "House of Worship" and therefore it is likely the plumbing inspector would not require compliance with the minimum fixture requirements due to the change in use. However the sanctuary space could potentially be considered a "Theater", which has more restrictive fixture requirements (i.e. 1 toilet per 30 females for Theaters vs. 1 per 50 females for a House of Worship). The maximum building occupancy supported by the plumbing fixture is typically limited by the female toilet requirements since they are the most restrictive. In the existing Florence Congregational Church there are an equal number of toilet fixture for male and female, two each in the toilet rooms near the social hall (male urinal counted as one) and one each at the back of the sanctuary. Based on a total of three female toilets, the maximum occupancy supported for a "Hall" occupancy classification is 300 people and the maximum for a "Theater" designation is 180 people.
