Property description The Saw Mill Hills Greenway, Russell Pomeroy Section, located at Roberts Hill and Sylvester Roads, Northampton (Florence), a portion of Assessors’ map 22 lot 007, is held by the City of Northampton, under care and control of its Conservation Commission, and subject to a conservation restriction held by the Kestrel Land Tusy for the purposes of conservation and passive recreation, in perpetuity. The deed was recorded on April 5, 2023, in Boo k 14832 , Page 221 in the Hampshire Registry of Deeds. 2. LAND Grant Program regulations & legal protection This property is permanently protected open space, for conservation and passive rec- reation only. It is subject to the standards and guidelines in 301 CMR 5.00: LAND and PARC Programs, of the Division of Conservation Services, Executive Office of Energy and Environmental Affairs (EEA). Important requirements include: - 5.05(4): The property interest acquired with LAND Grant funding must be under the care and control of the Conservation Commission - 5.08(1): The property must be for open space conservation and passive recreation purposes only, in accordance with MGL Ch. 132A, Sec. 11 - 5.08(1): The property is permanently protected under Article 97 of the Massachu- setts Constitution, and may not be converted to other uses without explicit ap- proval of the Secretary. Municipalities must pursue all feasible alternatives to conversion of grant -funded land. If conversion is finally determined to be the only possible choice, all of the following must occur: municipal approval of the con- version; a two-thirds majority vote of both houses of the state legislature; replace- ment of the land with new conservation land that is of equal or greater fair market value at the time of conversion, and of equal or greater acreage, ecological value, and usefulness, to be approved or disapproved by the Secretary of EEA. - 5.08(2): If the property is no longer used, in whole or in part, for conservation and/or passive recreation purposes, the interest in the property may revert to the Commonwealth. The Conservation Commission must notify the Secretary of EEA of any change or potential change in the use of the property inconsistent with open space conservation and passive recreation. Additionally, t he Secretary of EEA may notify the Conservation Commission that an inconsistent change in use has occurred. The Conservation Commission has 90 days to rectify the use to the satisfaction of the Secretary, or the property may revert to the Commonwealth. - 5.07(2) and (3): The property must be open to use by all members of the public without discrimination - 5.05(1): Off-street parking may be required Additionally, no private enterprise may occur on properties for which the fee property is owned by the municipality, except that which contributes to and does not conflict with appropriate public use and benefit. New structures are prohibited on properties where the fee interest is owned by the municipality, except those that further conser- vation or public passive recreational use of the property. Through receipt of funding under the LAND Grant Program, this property is perma- nently protected under Article 97 of the Constitution of the Commonwealth of Massa- chusetts and may not be converted to other uses without pursuing all feasible alterna- tives to conversion of grant -funded land. If conversion is finally determined to be the only possible option, all of the following must occur: municipal approval of the con- version; a two-thirds majorit y vote of both houses of the state legislature; replacement of the land with new conservation land that is of equal or greater fair market value at the time of conversion, and of equal or greater acreage, ecological value, and useful- ness, to be approved or disapproved by the Secretary of EEA. A LAND Grant Project Agreement prohibiting conversion of the property from open space conservation and passive public recreation has been recorded with the property deed. Planned stewardship activities and regular management: Increased signage of property, boundary marking, communication with abutters, re- freshing of corner pins and markers, ongoing trail maintenance, removal of invasive species. Collaboration with user groups, particularly mountain bikers, regarding trail maintenance and construction Known stewardship issues or potential management challenges to address: The logged areas will need to be monitored for invasive species growth. The area is used actively by mountain bikers, and some unauthorized trail creation has been ob- served. Conservation Value Existing Condition Passive Recreation - Maintenance of a Recrea- tional Trail System . Public access to the Premises will be allowed for passive out- door recreation, education, and nature study. The property also includes trails that connect to miles of other trails within the Sawmill Hills Protection of ground and surface waters The Premises includes multiple Headwater Streams, which are among the most vulnerable resources to climate change. These streams form two separate sub watersheds – Parsons Brook and the Mill River. This watershed divide means that activities here could have far reaching riparian and drainage impacts. Approx- imately half of the Premises is within 300 feet of a Wetland, Stream or River. The premises contains varied Resources; ver- nal pools, headwater streams and seeps, and they contribute significantly to the Premises overall diversity. Habitat Conservation The Premises includes areas designated by the MA Division of Fisheries and Wildlife Natural Heritage and Endangered Spe- cies Program (NHESP) as “Priority Habitats of Rare and En- dangered Species”, the protection of which aligns with NHESP’s wildlife and habitat protection objectives. This in- cludes vernal pools, potential habitat, and natural communities. Fully half of the Premises is within estimated and priority habi- tat for rare plant species and wildlife. Natural Heritage and En- dangered Species has documented habitat of one Special Con- cern Amphibian; one Threatened Amphibian and one Special Concern Bird Climate Change resilience The Premises is identified as an area of slightly above average, Terrestrial Resilience according to The Nature Conservancy’s (TNC) Resilient Land Mapping Tool, including slightly above average for both Landscape Diversity and _Local Connected- ness Permitted Activity Existing Condition / Evidence Hiking The Premises already includes a trail and woods road network Prohibited Activity Existing Condition / Evidence Boundary Encroachments There are some minor encroachments present from abutting residen- tial uses. See Photos 179 and 180 C. Additional comments regarding the present condition of the property: 3. Boundary Conditions A. Describe existing boundary markings or physical bounds that identify the property lines (e.g., stone wall, water ways, flagging or property boundary signs): Boundary lines are marked by recent surveyor flagging B. (If a CR is recorded for the property): Are there portions of the property that are ex- cluded from the Restriction? If so, are these clearly marked or otherwise evident on the ground? There are no portions of the pr operty excluded from the restriction. C. Are there existing or potential encroachment by abutters on the property? (If a CR will be recorded on the property, please consult with the CR holder to identify appro- priate actions to address encroachments prior to recording the CR. Describe here how these encroachments have been or will be addressed.) We will communicate with abutting property owners regarding encroachments, and work with them to remove temporary structures and landscaping materials. These ap- pear to be unintentiona l encroachments resulting from prior lack of boundary mark- ing. D. Any other comments on boundaries?
