When hardware is provided or changed on doors in the means of egress, levers, push plates, pull bars, panic hardware, etc. , but not conven- tionally operating door knobs or thumb latch pull devices, shall be used. The application was heard by the Board as an incoming case on Monday, November 27, 1995 3. The Board held a hearing upon an application for variance filed with the Board by George Falk, for modification of, or substitution of the following section(s) of the 1982 Rules and Regulations of the Architectural Access Board: Section 35.13 - Chair lift (a seat that rides the rail) to access Dr. Falk's Dental office. 2. The hearing was held on: Monday, February 5, 1996. 3. The following persons appeared: George Falk, D.D.S. All persons offering testimony were sworn in by the Chair. 4. FINDINGS AND DECISION: The Board having considered the evidence hereby, finds and decides as follows:. By way of background: The building is a 4800 square foot building consisting of two floors for professional and business offices. Dr. Falk, the petitioner, has a dental practice for adults and children on the second floor. The petitioner is proposing to install a chair lift on a stairwell to assist patients that have difficulty negotiating the stairs, to access the dental practice on the second floor. The estimated cost of construction was given as, $5,500.00, and the assessed value of the building, as $314,600. The only work proposed is the installation of a chair lift. 1 The Board took jurisdiction over the facility under Section 3.3A1 of its Regulations: "If the work being performed amounts to less than twenty-five percent (25%) of the one-hundred percent (100%) equalized assessed value of the building, and the cost of the work is less than $50,000, only that portion of the work being performed shall comply with these Regulations". The Chair, Gregory Carell, called upon George Falk, the petitioner to present his case for the variance request. Dr. Falk stated that he applied for a variance to use a chair lift, as a means to provide access to his second floor dental practice, in response to his patient's need. Dr. Falk stated that currently, persons unable to negotiate stairs are transported to the second floor by either the doctors or staff. The dental practice consists of two doctors; two hygienist and additional auxiliary help. A person with a disability, i.e., heart respiratory (emphysema), arthritis, elderly, and persons in wheelchairs, unable to negotiate stairs, ring a bell at the parking level, and the staff/doctors go to the first level and carry said persons up the stairs. Dr. Falk stated that, if the Board approves the proposed chair lift, persons in wheelchairs will be transferred to the chair lift by staff; the chair lift will provide access up one flight of stairs; the staff will then assist patients from the chair lift to a wheelchair, (provided on the premises), to transport them to the treatment chair. Dr. Falk stated that a wheelchair is on site to help move patients around the office for any reason. Dr. Falk testified that persons in wheelchairs are never treated in their wheelchairs, but moved to the dental chairs, after consultation with their personal physicians regarding same. It is Dr. Falk's opinion that a chair lift will benefit the majority of his patients unable to access the stairs. In support of that, Dr. Falk submitted letters from six of his patients, with different disabilities, expressing their need, and support for Dr. Falk's variance request. Dr. Falk particularly noted the letters from Bernice Powers and Hazel Livingstone, as examples of patients who would benefit by use of a chair lift. Ms. Livingston, who has chronic arthritis, and is now carried up the stairs by her husband and Dr. Falk, would be able to access the dental office via the chair lift. Dr. Falk stated that he is very caring of his patients, and noted that he provided in-home service to Ms. Livingstone on occasion, when she was unable to visit the office. Ms. Powers has emphysema, and would also derive a substantial benefit from the installation of a chair lift. Dr. Falk stated his practice is limited to general dentistry and therefore, if someone is severely challenged and needs anesthesia, he is not qualified to treat them. Dr. Falk also noted the letter, dated October 25, 1995, from Michael J. Vito, City of Northampton, Office of the Mayor, voicing support for Dr. Falk's access solution for his business. Dr. Falk asked the Board to grant his variance request, and stated his belief that he has taken a positive step to help persons in need of physical assistance. The Chair called upon Board Members with questions for Dr. Falk. Board Member Kathleen Kelleher asked Dr. Falk if he investigated any other means of providing access to his office. Dr. Falk replied he investigated the use of a Limited Use/Limited Access (LULA) elevator, but he is faced with several constraints regarding same. Dr. Falk stated that over the years he has petitioned the Town to enlarge his building, but it was denied because his business is located in a residential zone. He stated that there is no room within his building to provide an elevator, and he cannot expand beyond the building footprint. He also noted that he is mandated by the Town to keep the current number of parking spaces (8-10) and therefore he cannot expand in that direction. Dr. Falk noted the approximate cost of a chair lift is $6,000, and the cost of an installed Limited Use/Limited Access (LULA) elevator is in excess of $70-75,000, plus a zoning change is required. It is Dr. Falk's opinion that it is infeasible to provide other than a chair lift to access the second level, based on the way the building is configured. Ms. Kelleher asked if the building entrance is accessible. Dr. Falk stated that the entrance is just about level with the parking lot. Board Member Edward Kelly asked Dr. Falk if he can provide a dental office on the first level. Dr. Falk replied, there is no first floor, there is only a basement level, and a flight of stairs directly up to his dental practice. He stated that 'the lower level is used for storage and computers for the building. Board Member Ralph Hickey asked Dr. Falk if there are two stairways that go to his office. Dr. Falk replied that the one staircase goes directly to his office, and the other staircase goes to a landing to a storage area through which and one can access his office. Mr. Hickey asked Dr. Falk if he checked with the building official regarding the width of the staircase, i.e., is it wide enough, when the chair lift is in operation, for passage by an ambulatory person. Dr. Falk replied that the building department advised him that the stairs are sufficiently wide. Deborah A, Ryan, the Executive Director of the Board referred the Board to a letter dated November 20, 1995, from Anthony Patillo, Assistant Building Commission, 3 Northampton, relative to the proposed chair lift. The letter read in part as follows: " Chair lift when folded protrudes 13 1/2" into the staircase leaving 34 1/2" for egress. Handrails are allowed under CMR 828.2.1 to project 3 1/2" into required stair width, this would be acceptable for staircase. The bottom landing measures 32" deep x 48" wide, the stair climber extends 9" past bottom riser thus reducing landing to 23" x 48", under AAB 27.8, the area for landing is not sufficient". Dr. Falk stated that it is his understanding that there is sufficient exits out of the building. The Chair asked Dr. Falk if he investigated the feasibility of using a vertical wheelchair lift, and cost for same, to provide said access Dr. Falk replied that he looked at a vertical wheelchair lift a number of years ago, but there is not enough room, because the upper landing itself would block it. He stated that given the existing constraints, the entire footprint of the building would have to be increased in order to provide said lift. Dr. Falk stated that in addition to the cost of a vertical lift, the entire front of the building would have to be rebuilt. The Chair asked Dr. Falk if he sought the services of a design professional. Dr. Falk replied that he only contacted elevator companies. The Chair also asked what percentage of Dr. Falk's practice will use the chair lift. Dr. Falk replied that approximately 20 of his clients will use said lift. The Board inquired if there is a way to provide access from the basement level. Dr. Falk stated that the basement level is used for storage, computer systems, and there is an orthodontist office in the basement. The Board asked how access is provided to the Orthodontist office. Dr. Falk replied there is no accessible entrance to said office. He noted that an orthodontist is a specialist and does not have the equipment that a general dentist has. The Chair called for a motion in the matter. The Board took the case under advisement. Later in the day, in reviewing the matter, the Board found that it did not have sufficient documentation to prove that it is "impracticable", to provide a means, other than a chair lift, to access the dental offices. 4 Therefore, before the Board makes a decision in the matter, it requested that Dr. Falk consult a design professional/someone knowledgeable with building codes to inspect the building, and provide the following information, in writing, to the Board, by March 1 , 1996 (Extended to 4/1/96, per request of Dr. Falk). 1 . Investigate the feasibility/infeasibility of providing vertical access, to said space, using an inclined wheelchair lift; a vertical wheelchair lift, or a Limited Use/Limited Access elevator. If it proves impracticable to provide access via one of the above, written documentation, including floor plans of the building, must be submitted to support said claim, i.e., specifically, outlining all constraints. Impracticability is defined in Section 5.11 of the AAB's Regulations as "Impracticability a) Compliance with the Regulations would be technologically infeasible, or b) compliance with the Regulations would result in excessive cost without any substantial benefit to physically handicapped persons. 2. Submit written costs estimates, from companies who have surveyed the location, for the installation of the above conveyances. April 22, 1996 At its meeting on Monday, April 22, 1996, the Board reviewe a letter dated March 28, 1996, from George Falk relative to the Boa d's request for additional information. That letter read in part, as follows: ..."We have consulted with Structural Engineer, Ryan Hallwig and an Architect, Mark Gelotte. Mr. Hellwig informed us that in order to consider a vertical lift, we must be prepared to relocate the entrance to the building. This is due to the space required by the lift and containment building and the requirement for a separate mechanical's room. The sum total of this additional structure would impact negatively on our parking spaces and driveway access. Parking and zoning changes are a major issue since we 5 have no legal room to expand as per Wayne Fieden, Town Planner. Preliminary design costs are approximately $3,500, and final plans are from $10,000 - $12,000. As you can see, the cost for the most basic vertical lift will range from $70,000 - $100,000, most probably closer to the higher figure due to the major relocation of the building entrance. As I stated February 5, 1996 in person, our patients in need of assistance up the stairs could all be served very safely and adequately with a stairclimber. There are three other dental facilities nearby that are newer, in large buildings that have total handicap access...." In addition, Dr. Falk submitted a letter, addressed to him, dated March 26, 1996, from Mark Gelotte, an architect who met with Dr. Falk and outlined the issues and rough costs associated with a proposed elevator installation. That letter read, in part, as follows: "As you requested I have outlined the issues and rough costs associated with the proposed elevator installation which we discussed briefly last Thursday, the 21st. A project of this scope could cost in a range from $70,000 to $100,000 depending on the complexity of the issues involved. The elevator portion would account for $30,000 - $50,000 and the building and site work portion from $40,000 - $50,000. issues such as parking, zoning, setbacks, drainage, security, site utilities and handicap accessibility rules as well as architectural structural engineering and aesthetic considerations would have to be examined. Design and engineering fees for all work including design, construction drawings, contractor bid supervision and site and construction visits would cost between 8 and 12 percent of the construction cost. The feasibility portion of this would account for about 35 percent of the total design fee and would include a study of 2 to 3 schemes, the impact of the issues listed above, sketch drawings and rough costs of each".... 6 In discussing the case, Board Members voiced their concern with the use of a chair lift in any location and in particular, to provide access in a medical care facility. The Board noted that for the purposes of its regulations, a dental practice falls under, Medical Care Facility. The Board stated that its primary objective is to provide a safe independent means of access to as many persons with disabilities as possible, and it does not find a chair lift meets its objectives. Board Member Mary Connelly, who uses a wheelchair, noted that most persons in wheelchairs cannot transfer out of their chairs and onto a chair lift, without considerable assistance, and making several transfer, as this method dictates, is not independent and could set up an unsafe condition during the many transfers required. The Board also discussed the letters submitted by Dr. Falk, and noted that it appears Mark Gelotte's letter addresses the costs and work required for the installation of an elevator, not a vertical wheelchair lift, or an inclined lift. The Board also questioned the requirement in Dr. Falk's letter relative to the, "space required by the lift and the requirement for a separate mechanical room". The Board finds that it was not proven to be "impracticable" to comply with its Regulations. The Board stated that the cost for compliance is not a consideration given the substantial benefit for all persons, not just persons with ambulatory disabilities, to have a safe independent means of access provided to the second floor dental practice. The Board finds that most persons with disabilities cannot transfer out of their wheelchairs and onto a chair lift and therefore, a chair lift is of no use to them. In addition, it is impossible for persons using electric wheelchairs to transfer out of their wheelchairs and have someone carry the wheeichair up to the second floor. Therefore, the Board finds there is a substantial benefit for persons in wheelchairs to have a safe independent means of access provided, i.e., one that does not require transferring in and out of a wheelchair several times to reach a dental chair. The Board finds that a more independent means of access, such as a limited use elevator, a vertical wheelchair lift, or an inclined wheelchair lift, will provide safe access for either a patient or a person accompanying a patient such as, a disabled parent bringing their child to the second floor dental office. Therefore, based on its finding of substantial benefit, the Board voted to DENY the variance request to Section 35.13 to allow the use 7 of a chair lift to provide access to Dr. Falk's second floor dental practice. The Board voted to waive the site visit requirement. This constitutes a final order of the Architectural Access Board, entered pursuant to G.L. c. 30A. Any aggrieved person may appeal this decision to the Superior Court of the Commonwealth of Massachusetts pursuant to Section 14 of G.L. c.30A. Any appeal must be filed in court no later than thirty (30) days of receipt of this decision. We currently operate a Dental practice on the second floor of 41 Main Street. We keep a wheelchair on site for any individuals that require help moving around the office for any function or reason. We help individuals gain access to the second floor by either the doctors or staff transporting those individuals up the stairs. We request permission to install a stair climber chair to make this task more efficient and less manpower intensive. The location of the stair climber would be at street level, where a vehicle could unload and easily transfer an individual to the stair climber. We are very familiar with this kind of transfer, because we do this kind of transfer when aiding patients into the dental treatment chair from our wheelchair or any assisted situation.
