Dear Ms. Willard:
As you know from previous Wetlands Protection Act permit applications that you have filed,
Parsons Brook and its associated bordering vegetated wetlands are located on Willard Gravel
property. Thus, any activity or disturbance within 100' of wetlands and 200' of Parsons Brook
requires a permit from the Northampton Conservation Commission. Activities that fall within
the jurisdiction of the Commission range from new and expanded roadways, to piling of fill, to
excavation among many others identified in MGL c131 §40 promulgated through 310 CMR10.
Some concern has been brought to my attention that "all -terrain vehicle" activity on the Willard;
Inc. property may be taking place within the resource areas on site. Please note that it is the
responsibility of property owners to identify wetland resource area boundaries and their buffers
to ensure that all disturbance/use that occurs in these areas are appropriately permitted. Owners
are also responsible for damage to resource areas that may result from such use.
