9.3 A-10 The Zoning Board of Appeals approved the special permit with conditions after determining that the
request to reduce the side setbacks by demolishing the current condemned residence and constructing
a new residence would not be substantially more detrimental to the neighborhood. It emphasized that
the preservation or removal of the existing 60” diameter tree that is on the property line shared with
the northerly neighbor should follow the appropriate ordinances.
The Board found that:
1) The lot has a non-conforming width of 31’ versus the 50’ minimum required.
2) The structure on the non-conforming lot has non-conforming side setbacks. The current side
yard setbacks are 3’7” (R) and 9”7’ (L) instead of the required 15’, and the proposed would
become 3’ (R) and 10’ (L).

3) There would be no change in the rear setback.
4) The lot is non-conforming for parking but will be brought into conformance with the provision
of two parking spaces.
5) A tree 60” in diameter straddling the northerly neighbors’ property boundary is intended to be
removed.

12.3 1) Prior to site work/demolition, and in accordance with 350-12.3, if the 60” tree shown on the
plan is to be retained, it should be protected as recommended by a certified arborist.
2) If the 60” tree is to be removed, prior to issuance of a Certificate of Occupancy, the applicant
must show that tree replacement has been completed in compliance with 350-12.3.
