The project is very small (500 square feet existing to 1400
square feet total) to add an elevator lift in order to meet the main
entry concept hurts available space more than the budget
feasibility program which is by itself very extreme . Accessibility
is provided by an entrance off the new pedestrian walking park
which leads from the closest public parking lot. The owner feels
because of the marginal economic feasibility that a Main Street
office address is necessary to market the new second floor space ,
hence the stair down to Main Street.
The first floor will be retail with no public access to the
bathroom.
If a lift is installed in the new lower level addition, it would
eliminate the bank ATM tenant and also the economic feasibility
of the project.

NOTICE OF ACTION
RE: Wally's Soda Shop, 4 Main Street, Northampton, MA
1 . An application for variance was filed with the Board by Tristram MetcIfe
(Applicant) on July 14, 1989. The applicant has requested variances from the
following sections of the 1982 Rules and Regulations of the Board:
Section 26.1 relating to primary entrance
Section 30.1 relating to public toilet on first floor
2. The application was heard by the Board as an incoming case on Monday, A gust
14, 1989.
3. After reviewing all materials submitted to the Board, the Board vote as
follows:
DENY the variances to Sections 26.1 & 30.1 for the reason that impracticability
has not been proven.
Any person aggrieved by the above decision may request an adjudicatory hearing
before the Board within thirty (30) days of receipt of this decision by filing the
attached request for an adjudicatory hearing. If after thirty (30) days, a request
for an adjudicatory hearing is not received, the above decision becomes a final
decision and the appeal process is through Superior Court.
