Patrick J. Melnik, Sr. is an individual and is the Trustee of the Beaver Brook Nominee Trust, who resides at 306 Chesterfield Road, Northampton, Hampshire County, Massachusetts and is a zoning permit applicant, an appealing party, and a plaintiff herein. (Hereinafter "Melnik") 2. The members of the Zoning Board of Appeals (ZBA) acting on Melnik's application were: Maureen Scanlon, of 197 Nonotuck St, Florence, Ma 01062, Sara Northrup, of 147 Hinckley St, #1, Northampton, Ma 01060 and Elizabeth Silver, of 67 Willow Street, Florence, Ma 01062. Bob Riddle of 47 Water Street, Leeds, Ma, 01053 was a member of the Zoning Board of Appeals who was present at the meeting but did not appear to be one of the 3 votes counted in the denial of the appeal that is the subject of this action. David Bloomberg, of 86 Vernon Street, Northampton, MA 01060 was a member of the Zoning Board of Appeals who was not Present and did not vote. Pursuant to the statute, all members of the ZBA are being listed as defendants. Property 3. The property is identified as parcel 05-012 in the City of Northampton Zoning Map sheet 5, it is located on Grove Ave in Leeds, Massachusetts and the applicable zoning is URA, which requires 50 feet of frontage to build a single family home. Procedural History 4. The City of Northampton, on March 25, 2021, through its building official denied Raul and Farrah Matta a zoning permit for the construction of a single family residence. 5. The denial was timely appealed to the Zoning Board of Appeals by Raul and Farrah Matta as well as owner of the property Patrick J Melnik Sr., Trustee of the Beaver Brook Nominee Trust. 6. The Zoning Board of Appeals, by a decision dated June 10, 2021, filed with the City Clerk on June 17, 2021, denied Raul and Farrah Matta's permit for the construction of a single family home for lack of frontage. 7. That decision of the Zoning Board of Appeals was timely filed in the Hampshire County Superior Court, Civil action #21-079. That action is still pending. 8. The Zoning Board of Appeals decision in Civil action #21-079 denied Matta's request for a building permit based on assertions in the ZBA decision that were in accurate. The ZBA, among other assertions, stated that Grove Avenue "ends 37' south of the appellant's locus". The ZBA also found that the "city consistently did not interpret frontage to include measuring from the end of the way". The ZBA also found that the access to the locus was not adequate. 9. Melnik sought to improve access to the lot by obtaining a driveway permit from the Department of Public Works (DPW). The Northampton DPW approved Melnik's application for a 15' driveway to access the lot from the end of the public way on Grove Avenue. Melnik constructed the driveway and also constructed turnaround access for emergency vehicles. All the work done by Melnik was approved by the Northampton DPW. 10. Melnik also identified multiple house lots in the City of Northampton that have their only access at the end of dead end streets, and the only frontage for these approved lots is the frontage counted at the end of the dead end streets. Melnik has not been able to identify any lot where frontage from the end of a dead end street was denied by the City. 11. Melnik applied again for a zoning permit on September 12, 2022 with the Northampton Building Inspector showing his proof of adequate access and Melnik also submitted proof that there are multiple house lots in the City of Northampton that have only the end of dead end streets as frontage. The Building Inspector denied Melnik's request for a zoning permit on September 15, 2022. The application and denial are attached hereto marked "A". 12. Melnik appealed the denial by the Building Inspector to the Northampton ZBA. Melnik presented this evidence to the ZBA, along with his proof of adequate access to the lot at a hearing held on December 8, 2022. Melnik's evidence was ignored by the ZBA which found that conditions of the lot had not changed since it's denial of the Matta permit application in 2021. The ZBA denied Melnik's appeal on December 8, 2022. The certified copy of the decision of the Northampton ZBA is attached hereto and marked "B". This action is an appeal of the denial of the ZBA. Claim 13. The plaintiffs allege that the decision exceeds the authority of the board. 14. The applicable section of the City of Northampton Code of Ordinances Chapter 350 Section 350-2.1 provides three different ways that the frontage requirement may be satisfied stating: FRONTAGE The uninterrupted length of the front lot line, as defined herein, whether straight or not, which conforms to the minimum lot frontage requirement and is on: A. A public way or a way which the City Clerk certifies is maintained and used as a public way; or B. A way shown on a previously approved subdivision plan which has been constructed to the standards required when subdivision approval was granted; or C. A way that predates subdivision control that has, in the Planning Board's opinion, suitable width, grades, and construction adequate and reasonable for vehicular traffic, including emergency vehicles and snow removal vehicles, and the installation of utilities. 15. By Judgment of the Hampshire Superior Court, Docket # HSCV2004- 00029, "Grove Avenue, Northampton, Massachusetts is a public way for its entire length to the point where it abouts the property now owned by Beaver Brook Nominee Trust." 16. The subject property contains 50 feet of frontage abutting Grove Ave. Leeds, Hampshire County Massachusetts and satisfies option "A" of the zoning regulation requirement for frontage. Contrary to the finding of the ZBA, there is no 37-foot gap between the legal public way and the subject parcel per the judgment. 17. The City ZBA contends that frontage along the end of a street should not count to satisfy the frontage requirement. Nowhere in the zoning ordinance is there any reference to the disallowance of use of the frontage at the end of a street to satisfy zoning requirements, the ZBA at hearing, conceded that no language is included in the ordinance that would prohibit the end of a street from being frontage, but continued to insist the end of a street should not count towards frontage. 18. In addition to the new arguments herein made by Melnik, Melnik relies on the arguments and statements made in Civil action #21-079 as if specifically restated herein. 19. The plaintiff, states that the decision of the Zoning Board of Appeals was based on legally untenable grounds, was arbitrary and capricious, and not in compliance with the Zoning By-Laws of the City of Northampton. 20. Specifically, plaintiffs state that the permit denied by the Zoning Board of Appeals was for a single family home and it is clear that the use was allowed by the Zoning By-Laws of the City of Northampton. 21. Justice and equity require that this court compel the Zoning Board of Appeals to issue said permit. At the hearing in front of the ZBA at which your denial of a building pe mit was at issue, there were reports to the ZBA that frontage at the end of a street could not be used to calculate frontage, and, even if frontage w s found, my lot did not have adequate access to the street. Since that time, I have obtained a driveway permit from the DPW and ave constructed the driveway to city standards. The only thing I have not one to date is to pave the edges where the city street was widened. I told t e DPW I would pave when the water and sewer access was constructed. The DPW emailed me to indicate that was acceptable. You can view he site to see my access to the street is now broader and has better than access to the street than most of the houses on Grove Ave. I have also investigated the historical use of ends of street for access o residential houses. In addition to the myriad of houses that are built a' the end of cul-de-sacs, which are essentially dead end streets, I have fou d that most of the lots at the end of dead end streets in Northampton hale houses constructed, with frontage on the end of the dead end street a d no other frontage on any other street, or use most of the dead end fronts a to obtain proper frontage. The Board made its determination based the fact that the conditions from the previous permit request in 2021,which had been argued and denied,had not changed,noting that the addition of the driveway through DPW permitting does not create frontage. Upon hearing that the applicant had not sought review from the Planning Board as prescribed in the zoning,the Board further noted that the Planning Board has the jurisdiction to determine frontage.
