APPROVAL CRITERIA /BOARD FINDINGS
2.1 The Zoning Board of Appeals Voted 3-0 to deny the appeal and uphold the Building Commissioner’s
determination that there was no frontage to serve this lot and therefore denied the application for a
building permit for a single family house lot. The Board made its determination based the fact that the
conditions from the previous permit request in 2021, which had been argued and denied, had not
changed, noting that the addition of the driveway through DPW permitting does not create frontage.
Upon hearing that the applicant had not sought review from the Planning Board as prescribed in the
zoning, the Board further noted that the Planning Board has the jurisdiction to determine frontage.
Board members also noted that the case was still pending in court.
