Butler LetterCarolyn Misch <cmisch@northamptonma.gov> Appeal of Building Commissioner's denial of a building permit for Melnik property at 0 Grove Ave., Leeds Linda Butler <butleresl@gmail.com>Wed, Dec 7, 2022 at 2:41 PM To: Carolyn Misch <cmisch@northamptonma.gov> Cc: bucky sparkle <zygoticbucky@gmail.com> Dear Ms. Misch, I would like to add my voice to those of the many residents on and around Grove Avenue in Leeds who support the Building Commissioner's decision that the parcel owned by Pat Melnik past the end of Grove Ave. is NOT a buildable lot. I attended a virtual hearing on this issue in June of 2021. The facts presented at that hearing clearly supported the Building Commissioner's finding in the matter. I have read the excellent letter to the ZBA submitted by Bucky & Emily Sparkle. I found it very informative and persuasive in upholding the Building Commissioner's decision. I especially noted the section of that letter quoted from Section 81M of the Subdivision Control Law which "requires that new lots, including ANR lots, have an adequate public way 'that will be safe and convenient for travel; for lessening congestion in such ways and in the adjacent public ways; ...." It is clear that it would be completely against the public interest to make an exception to development rules for this particular parcel: The dead end portion of Grove Avenue is already at the maximum length for a dead-end street. The street has no sidewalks so vehicles must share it with kids walking to and from school, dog walkers going to and from the woods, bicyclists riding to and from the rail trail, and others. Grove Ave. is so narrow that the US Post Office refuses to deliver mail to any of our houses on the dead end. For safety's sake, no on-street parking is permitted along the dead end.
