Dear Board Members,
I request that you uphold the prior determination that the Melnik lot at 0 Grove Avenue, Leeds, is not a buildable lot.
Bucky and Emily Sparkle have presented you with a highly detailed, letter and supporting documentation as to why this lot is unbuildable. Among the reasons cited are:
1. The DPW, in its approval of a driveway permit to access the lot, wrote that "nothing in this permit shall be construed as an admission or otherwise as evidence of adequate frontage under the Northampton Zoning Ordinance."
2. There has been no change in the frontage from when the ZBA issued its prior decision.
3. The 8 prior plans that the applicant cites as supporting his plan date back many years. Four of them are over a century old; the most recent one is 1965. The ZBA had not adopted a zoning ordinance prior to any of these lots. Building at the end of
a dead-end street is an outdated practice which is clearly not in compliance with the current ZBA regulations.
For these reasons, and for the others cited in the letter from Bucky and Emily Sparkle, I request that the ZBA deny Mr. Melnik's appeal.
