Subject: Appeal of the Building Commissioner’s Decision by Pat Melnik Sr, Trustee of Beaver Brook Nominee Trust & Raul and Farah Matta that a lot is not a building lot end of Grove Ave,
Leeds, Map ID 5-12
Dear BOARD MEMBERS,
I fully agree with and support the position taken by Bucky & Emily Sparkle in their Dec 2022 message set to the Zoning Board of Appeals c/on Carolyn Mish, AICP, Senior Land Use Planner
& Permits Manager. Sparkle noted and I agreed: “that you uphold the Building Commissioner’s decision that the land (see subject) is NOT A BUILDABLE LOT”.
In addition, as a nearby property owner to the subject matter I also would like to make the Board aware of the following concerns over future development plans shown as Fig 3 “Potential
ANR development” in the Sparkle 8 June message.
CONCERNS with “Potential ANR development”
Since Melnick sold his last lot in Beaver Brook Estates in 2018 he has NOTHING to do with the estate lands. All are now managed by the Beaver Brook HOA. It should also be noted the northern
portion of Beaver Brook Estates was designated "PERMANENT CONSERVATION RESTRICTION (book 9109 page 58). This restriction, on the west end, extends down to the northern end of the "bicycle
path extension of Grove Ave". The northern
portion of the "bicycle path extension of Grove Ave" is also bracketed (on the east and west side of the path) by Beaver Brook HOA controlled Common area #4.
Ludwig Imre owns the property at 72 Chestnut Ave Ext. This property includes more than 1.16 acres, 2/3 is forested with hardwood trees (more than 2 1/2 dozen varying in size 12" - 22"
dia) on the more than 210-foot west end property border with the "bicycle path extension of Grove ave". Ludwig has planted new trees, 4 blue spruce and 3 Canadian larch on the west
end of the property. Ludwig Imre would like to maintain the natural environment in this area and is STRONGLY APPOSED TO ANY FURTHER DEVELOPMENTS HERE.
I am very concerned that Mr. Melnik will just continue to attempt to develop his other land holdings into commercial property adjacent and to the west of Beaver Brook estates.
