2003 Hampton Gardens Draft Agreement
HAMPTON GARDENS FUND
Program Participation Agreement
Hampton Gardens Fund
This is a fund that has been created by the City of Northampton in partnership with the Hampton Associates Nominee Trust (Spear Management). The fund was created to ensure that some
of the apartments at Hampton Gardens are affordable to households with modest incomes. Funds donated by local financial institutions, private citizens and the Hampton Associates Nominee
Trust will be used to create lower rents to allow qualified families to live more affordably at Hampton Gardens.
The fund is a separate account of the Affordable Housing Fund of the Northampton Affordable Housing Trust. The fund is overseen and managed by the City of Northampton and the Trustees
of the Fund.
Your Participation
Your application for residency at Hampton Gardens Apartments has indicated that your family qualifies for use of the Hampton Gardens Fund. Your family may already be living at Hampton
Gardens and may also be eligible to access the Fund. If your family agrees to participate in this program and is eligible, the Fund will subsidize the appropriately sized apartment
in which you (will) reside, so that the rent will be based on a percentage of your household income.
Participation in the program is based on the initial and on-going eligibility of your household, as well as the availability of funds from the Hampton Gardens Fund.
Program Operation
This program has been created and guided by the Affordable Housing Agreement for Hampton Gardens, executed between the City of Northampton, the Affordable Housing Trust and Hampton Associates
Nominee Trust, dated April 22, 1999.
Your Agreement
As a condition of receiving this assistance from the Fund, you and members of your household agree to all of the following:
To provide any and all information about your household income, assets, and household composition to determine your initial and on-going eligibility for assistance under this agreement;
To provide all information in a timely fashion as reasonably required;
To provide information that is to the best of your knowledge and ability true and accurate;
To provide timely and accurate information as required above because failure to do so could result in the denial of your application, termination of your assistance from the Fund, or
if appropriate, eviction or other remedies under your lease, or civil or criminal penalties resulting from your actions.
