DRAINAGE EASEMENTAffected Premises: 29 Sherman Avenue Northampton, MA 01060 DECLARATION OF DRAINAGE EASEMENT Sovereign Builders, Inc., a Massachusetts corporation, of 710 Southampton Road, Westfield, MA, the owner of land on Sherman Avenue, Northampton, MA as described in a deed dated July 1, 2021, and recorded in the Hampshire Registry of Deeds Book 14167, Page 133 and as shown on the plan recorded in said Registry in Plan Book 190. Page 13, hereby declares this easement and grants the rights and powers hereunder to the City of Northampton, a municipal corporation with offices located at 210 Main Street, Northampton, MA 01060. The land subject to the easement granted hereunder is shown as “Hatched Area Drainage Easement, Area=3,050 s.f.” on a plan entitled “Easement Plan, 29 Sherman Avenue, Northampton, MA” by R. Levesque Associates, Inc. which plan is attached hereto as Exhibit A and incorporated herein (“the Easement Area”). Pursuant to this Declaration of Drainage Easement, the grantee shall have the right and power to enter and remain on the Easement Area on foot and with vehicles and equipment to maintain, repair, and replace the drainage infrastructure within the Easement Area. The Grantor shall not be obligated to pay for any of the costs of such repair, replacement or maintenance of such drainage infrastructure. The acquisition of the easement conveyed herein is pursuant to an order of the Northampton City Council dated __________________, a true copy of which is attached hereto as Exhibit B.
