Program is for owner-occupied single-family units, duplexes, and condominiums (interior of the unit only). Eligible home repairs and improvements may include: mold remediation, vermiculite and asbestos removal, vents, air filters, carpet removal, debris removal, pest control, roof repair, floor and stair repairs/replacements, window repair, emergency plumbing repairs (e.g. frozen/burst pipes), water quality interventions (wells, failed water and septic systems), correction of code violations, and other repairs necessary to maintain the integrity of the building envelope. Work under this program does not involve home replacement, nor does it involve substantial rehabilitation for which the estimated cost of the work is 75% or more of the total estimated replacement cost after rehabilitation. This project is therefore compliant with 24 CFR Part 51 Subpart D.  Coastal Barrier Resources Act ( Yes ( No Northampton is not near any CBRS unit or other protected area.  Flood Insurance ( Yes ( No This project does not provide financial assistance for mobile home, building, or insurable property. Therefore, the project is compliant with 42 USC 4001-4128 and 42 USC 5154a.  STATUTES, EXECUTIVE ORDERS, AND REGULATIONS LISTED AT 24 CFR §50.4 & § 58.5  Air Quality ( Yes ( No This project does not include new construction or conversion of land use facilitating the development of public, commercial, or industrial facilities or five or more dwelling units. It is therefore compliant with the Clean Air Act (42 USC 7401 et seq.) as amended particularly Section 176(c) and (d) (42 USC 7506(c) and (d)).   Air Quality ( Yes ( No This project does not include new construction or conversion of land use facilitating the development of public, commercial, or industrial facilities or five or more dwelling units. It is therefore compliant with the Clean Air Act (42 USC 7401 et seq.) as amended particularly Section 176(c) and (d) (42 USC 7506(c) and (d)).  Coastal Zone Management Act ( Yes ( No This project is not in and does not affect any Coastal Zones. It is not subject to state review. Contamination and Toxic Substances ( Yes ( No   Endangered Species Act ( Yes ( No This project does not involve any activities that have the potential to affect species or habitats. There are no endangered species or critical habitats in Northampton. While the exact project sites have yet to be determined, all activities proposed will be entirely limited to modification of previously existing houses and will not expand the footprint in any way.  Explosive and Flammable Hazards ( Yes ( No The proposed project does not involve development, construction, or rehabilitation that will increase residential densities, or conversion of land use. Furthermore, the proposed HUD-assisted project itself is not the development of a hazardous facility (a facility that mainly stores, handles or processes flammable or combustible chemicals such as bulk fuel storage facilities and refineries). Therefore, the review is in compliance with 24 CFR Part 51 Subpart C.  Farmlands Protection ( Yes ( No This project does not involve activities that include new construction, acquisition of undeveloped land or conversion that could convert agricultural land to a non-agricultural use. Furthermore, most of the important farmland in the City of Northampton is in a low population density and permanently-protected area where development is discouraged. The proposed project is in compliance with 7 CFR Part 628.  Floodplain Management ( Yes ( No   Historic Preservation ( Yes ( No   Noise Abatement and Control ( Yes ( No    Sole Source Aquifers ( Yes ( No This project is not within the range of a sole source aquifer, because there are none in Northampton. It is therefore compliant with the Safe Drinking Water Act of 1974 (42 U.S.C. 201, 300f et seq., and 21 U.S.C. 349).  Wetlands Protection ( Yes ( No This project does not involve either new construction as defined in Executive Order 11990, expansion of a building's footprint, or ground disturbance. No draining, dredging, channelizing, filling, diking, impounding, and related activities will occur.  Wild and Scenic Rivers Act ( Yes ( No This project is not within proximity of a NWSRS river as defined by the Wild and Scenic Rivers Act (16 U.S.C. 1271-1287), particularly section 7(b) and (c) (16 U.S.C. 1278(b) and (c)) and therefore in compliance.  ENVIRONMENTAL JUSTICE  Environmental Justice ( Yes ( No No adverse environmental impacts were identified in any of the other compliance review portions of this project's total environmental review. Other measures to mitigate possible environmental justice effects were included in other review portions, such as program requirements (low- and moderate-income homeowners) and ensuring all HUD, EPA, and Mass DEP requirements are fulfilled during the project. Any impact that is disproportionately impactful towards low-income and/or minority communities will be mitigated through public engagement and other appropriate measures. When completed, the project will impact low-income and/or minority communities in a positive manner.   Supporting documentation Coastal Barrier Resources System Map of Northampton MA.pdf Coastal Zone Map for MA.pdf Written Strategies The following strategies provide the policy, standard, or process to be followed in the site-specific review for each law, authority, and factor that will require completion of a site-specific review. 1  Contamination and Toxic Substances    Field observation will occur for (i) project sites for potential sources of hazardous substances and (ii) properties in the immediate vicinity of project sites (including those abutting project sites or located across any roadways abutting project sites) to determine whether any dumps, landfills, gas stations, dry cleaners, or other businesses using hazardous substances exist at those locations. If a dump, landfill, gas station, dry cleaner, or other business using hazardous substances is observed, the following actions, as appropriate will be taken: (i) observe gradients to determine possible pathways for human exposure to potential hazardous substances; (ii) review MA DEP and US EPA on-line map and database information to determine whether the property is listed, and, if so, whether any remediation actions have been taken or are proposed to be taken for that property; (iii) review any additional available information in the databases that may be pertinent to that property, including hazardous materials and oil spills sites and whether a spill involved an above ground or underground petroleum storage tank, registered underground tanks including active and out-of-service underground tanks and tanks that have not been properly abandoned, active landfills, existing and proposed solid waste facilities, and transfer stations; and (iv) if necessary, consult directly with MA DEP to obtain any additional information about the project site or adjacent property.  2  Floodplain Management    Floodplain maps will be consulted for each individual project. Projects in floodways will not be funded. Work may occur if a project is located in the 100-year floodplain and the cost of the work on the structure is less than 50% of its value (excluding the land) before the work is started (i.e., the work involves only "minor improvements" as defined in 24 C.F.R. s.SS.2(b)(8)).  3  Historic Preservation    Section 106 review, Northampton Historical Commission review, and MHC review will occur as applicable to all rehabilitated properties on a case by case basis. Each property will be evaluated for site eligibility and specific compliance measures.  4  Noise Abatement and Control    Each site will be evaluated for it's proximity to roadways, railroads, and airports and a day-night average sound level will be recorded. The Normally Unacceptable and Unacceptable noise level projects will have mitigation measures implemented. HUD will be consulted for Unacceptable noise level measures.
