Planning Board Members present and voting were: Chairman Andrew Crystal, Vice Chairman Daniel Yacuzzo, Joseph Beauregard, Jody Blatt, Nancy Duseau and Kenneth Jodrie. In Granting Site Plan Approval, the Planning Board found: A. The requested use protects adjoining premises against seriously detrimental uses by providing for surface water drainage, providing dumpster screening and by not blocking abutters light or views. B. The project will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets, by providing "one way" driving lanes through the site; allowing for visibility at crosswalks and by providing parking spaces in excess of the minimum required. ORIGINAL PRINTED ON RECYCLED PAPER C. The project will promote a harmonious relationship of structures and open spaces the architectural design and will tie in to local historic buildings to the greatest extent possible since the new bank will be constructed on the front lot line. D. The requested use will not overload, and will mitigate adverse impacts on, the City's resources including the effect on the City's water supply and distribution system, sanitary and storm sewage collection and treatment systems, fire protection, streets and schools since there will be no significant change in use. E. The requested use meets the Site Plan Approval requirements set forth in Section 10. 11(6) of the Zoning Ordinance. F. The applicants complied with the technical performance standards as follows: (1) Curb cuts will be reduced in size from curb cuts currently in use. Access to this business will be by a one-way looped drive. (2) Pedestrian and vehicular traffic has been separated to the greatest extent possible. There were no Conditions imposed upon the project. Pursuant to Massachusetts General Laws (MGL) , Chapter 40A, Section 11, no Special Permit, or any extension, modification or renewal thereof, shall take effect until a copy of the decision bearing the certification of the City Clerk that twenty days have elapsed after the decision has been filed, or if such an appeal has been filed that it has been dismissed or denied, is recorded in the Hampshire County registry of Deeds or Land Court, as applicable and indexed under the name of the owner of record or is recorded and noted on the owner's certificate of title. The fee for such recording or registering shall be paid by the owner or applicant. Mark Sternak from Dietz & Company Architects was present to review the case. He reviewed what had transpired at the last public hearing and noted that the Board had seemed very positive about the application with the exception of the way that traffic would be routed near and around the Store 24 . Sternak said that the applicants had hired and talked to traffic consultants regarding the property, and had devised a solution with the help of the BSC Group. He referred to the August 18, 1995 letter from BSC with recommendations to improve site access and traffic circulation (copy in file) . Sternak said that there is currently a single curb cut between the bank and the Store 24. The applicant is now proposing reducing that curb cut. Sternak said they are proposing to keep the Store 24 sign on a small part of the island and to create new curbing to separate and open up the existing island and paint a very bold yellow line with traffic signage to allow for people and patrons to go straight out and for through traffic to come across the right-of-way and be directed back out through the same exit. Sternak noted that there is only a small volume of people anticipated at the bank and it is not expected that traffic from the bank will back up. Sternak said that there will be bright yellow chevron pavement markings added in the vicinity of the raised island with the Store 24 sign. When Chair Crystal asked if anyone were in favor of the proposal, - Charlie Lyons, who owns the Store 24 property, said he had reviewed the situation and thought that the current proposal is the best solution for both businesses, the bank and the Store 24 . No one spoke in opposition to the proposal. Crystal said correspondence from the DPW had noted that All construction within the City's layout must conform to City standards and that the applicant is required to apply for a trench permit. Sternak said that the bank plans to install new trench drains. Jody Blatt asked about the separation between the two properties. Sternak explained how the right-of-way, owned by Charlie Lyons, operates . Lyons was unwilling to have a raised speed bump on the property. Crystal said the concern that traffic crossing the Store 24 property has not been addressed. Kuzdeba said that the DPW may need to comment on the proposal to reduce the size of the curb cuts . Charlie Lyons said that the 9-1/2 ' right-of-way runs up the property 152 ' from the sidewalk. Lyons noted that, if, in the future, everything needs to be torn out of there, and fences are put up, there would be no access out of the right-of-way because of expansion of the curb cut on the street. The expansion of the curb impacts the legal right-of-way on Lyons' property. Duseau said she thought the signage would help orient traffic direction. Beauregard said he did not think that you can control human nature and that some people may cross the yellow line but he noted that the applicant's current proposal is probably the best solution for the property's use. Jodrie said he agreed that the new plan is a big improvement over the original proposal and a good solution. Crystal agrees that the new plan is better than the original proposal.
