Currently, travelers on the Rail Trail wanting to access Main Street must travel north to the Florence Street intersection and then south along Main Street, for a total distance of half a mile. This connection will create a new access for the Mai Street and Arch Street neighborhoods. It will also provide a direct connection to the Hotel Bridge and Water Street once the bridge is reopened to foot traffic. Rehabilitation of the Hotel Bridge is currently out to bid and is hoped to begin in the fall. This segment of trail will eventually become part of the ‘Northampton ONE’ network, a 25 mile trail around the entire City. 400 feet of total new trail, about 150 feet of this Is proposed to be improved with trap rock gravel (TRG). The trail will be four feet wide, with addition of approximately 20 cubic yards of TRG. TRG will be limited to areas where it is necessary to create a smooth walking surface, delineate the trail boundaries, and limit understory growth (primarily invasive and opportunistic plants) from growing. A segment of trail is within bordering land subject to flooding, but no gravel is proposed to be added within this area. Total disturbance within the riverfront will total 1,600 square feet. As shown in the attached aerial photo and survey, prior to City acquisition in 2010, this parcel was associated with the industrial/commercial use to the north. Asbestos pipes, an underground tank, junk cars, and concrete blocks were all removed as part of Conservation Commission’s protecting the property. The TRG portions of path are all proposed in flat areas, outside the floodplain. Because of existing site conditions, embedded trail edges are not proposed, but could be added to project plans if the Commission requests. Vegetation removal is limited to understory growth, no tree removal is proposed. The work is being submitted as a limited project as noted below. The Northampton Wetlands Ordinance also creates an exception to allow the work to occur within the Protected Zone; 50 feet from resource area boundaries in the FFR zoning district that includes all protected open space. The width of trail is 40% of the maximum allowable under the limited project provision, and adverse impacts are proposed to be minimized by limiting TRG to where it is absolutely necessary. Mean Annual High Water (MAHW) is determined by a very steep break in slope, in accordance with the definition of. MAHW is shown on the plan as ‘high water mark,’ this was delineated in the field when the property was acquired and represents “line that is apparent from visible markings or changes in the character of soils or vegetation due to the prolonged presence of water and that distinguishes between predominantly aquatic and predominantly terrestrial land.” Bank undercutting and flows near the dam have created a MAHW that does not easily match up with an aerial photograph. The Wetlands Protection Act regulations provide that: 310 CMR 10.53(6) Notwithstanding the provisions of 310 CMR 10.58 (these are the riverfront area performance standards), the Issuing Authority may issue an Order of Conditions permitting as a limited project the construction, rehabilitation, and maintenance of footpaths, bikepaths, and other pedestrian or nonmotorized vehicle access to or along riverfront areas but outside other resource areas, provided that adverse impacts from the work are minimized and that the design specifications are commensurate with the projected use and are compatible with the character of the riverfront area. Generally, the width of the access shall not exceed ten feet of pavement, except within an area that is already altered (e.g., railroad beds within rights of way). Access shall not be located in vernal pools or fenced in a manner which would impede the movement of wildlife. In addition, the 310 CMR 10.58 (5) standards for redevelopment within previously developed riverfront areas provide that “Notwithstanding the provisions of 310 CMR 10.58(4)(c) and (d), the issuing authority may allow work to redevelop a previously developed riverfront area, provided the proposed work improves existing conditions.” “Acceptable improvements include, but are not limited to… Planting of indigenous plant species.” To provide additional compliance with regulatory standards beyond that required by the limited project provision, 160 square feet of mixed native plantings are proposed within the inner 100 foot riverfront area. This is equivalent to the square footage of trail located within bordering land subject to flooding within the inner 100 foot area. Documentation of this area can be provided upon request for a certificate of compliance.
