2) As offered by the applicant, and prior to issuance of a CERTIFICATE OF OCCUPANCY, the applicant

mitigation payment of $4,000 has been made to Microcal's contractor. This payment change order is
for the purpose of continuing the construction of a sidewalk extension along Industrial Drive from the

supply and distribution system, sanitary and storm sewage collection and treatment systems, fire protection, streets and schools. The
applicant has received a stormwater permit from DPW based upon revised design and calculations from that originally submitted with the
application.
E. The requested use meets other special regulations set forth in this chapter. For curb cut widths and lighting. The Board did approve
a small waiver of lighting at one point on the site for levels to be approximately. 1 foot candle at the property boundary. The 42' wide curb
cut with concrete rumble strips was approved based on the need for tractor trailer turning movements along Industrial Drive East and
should improve safety of vehiclular entry at that location.
F. Compliance with the following technical performance standards: (1) Curb cuts onto streets shall be minimized. One of the curb cuts
along Industrial Drive will be closed and a new curb cut on the less traveled Industrial Drive East will be created to separate truck traffic
from other vehicular and pedestrian traffic on site. (2) Pedestrian, bicycle and vehicular traffic movement on site must be separated, to
the extent possible, and sidewalks will be provided between businesses within a development. (3) No increase in peak flows from the
one-or two-and ten-year Soil Conservation Service design storm from predevelopment conditions and must obtain a permit stating as
such by the Department of Public Works.

shall be provided access to the property to conduct inspections before, during, and~
construction activities as necessary. The applicant shall arrange with the DPW to
schedule the following inspections: Initial Inspectio~ Erosion Control Inspection, Bury
Inspection, and Final Inspection. The DPW may also conduct random inspections to "-...,
ensure effective control of erosion and sedimentation during all phases of construction.
3. At the completion of the work, including construction of stormwater management
facilities and landscaping, the applicant shall submit a statement to the DPW from a
professional engineer of record in the Commonwealth of Massachusetts certifying that
the materials and construction of the stormwater management system was constructed in
accordance with the approved plans and will function as designed. All changes to the
approved stormwater facilities shall be documented by a professional engineer of record
in the Commonwealth of Massachusetts and approved by the DPW prior to submission of
the certification statement described above. It is recommended that the applicant retain
the engineer during construction of stormwater facilities to ensure that they are
constructed in accordance with the approved plans and specifications.
4. Annual Reports that are stamped by a Registered Professional Engineer documenting the
actions completed as required by the Operation~ Maintenance and Inspection Agreement
shall be submitted to the Northampton Department of Public Works by October 151 of
each year.
5. If construction of the proposed stormwater system has not started within five years of the
issue date of this permit, then the permit will expire and a new permit will be required.
Construction is defined as clearing, grading, excavation, fillin~ and installation of
drainage structures on the lots specified in this permit.
6. The DPW shall require from the developer a cash escrow, irrevocable letter of credit, or
other means of security acceptable to the DPW prior to the issuance of any building
permit for the construction of a development requiring a stormwater management facility.
The amount of the security shall not be less than the total estimated construction cost of
the stormwater management facility. The guarantee so required in this section shall
include provisions relative to forfeiture for failure to complete work specified in the
approved stormwater management plan, compliance with all of the provisions of this
Ordinance and other applicable laws and regulations, and any time limitations. The
guarantee shall not be fully released without a final inspection of the completed work by

the City Engineer, submission of "As-built" plans, and certification of completion by the
Department of Public Works of the stonnwater management facilities being in
compliance with the approved plan and the provisions <>f this Ordinance.
Specific Permit Conditions:

1. Prior to issuance of a Building Pennit, the applicant shall record an executed Stormwater
Operation, Maintenance, and Inspection Agreement that is binding on all subsequent
owners of land served by the private stormwater management facility by recording it in
the land records of the Registry of Deeds. This agreement shall be apprqr8d by the
Northampton DPW, signed by the owner, and signed by the Mayor o~~pton.
Section 22-85 of the Northampton Stormwater Management Ordin~l~~-i~
additional guidance for the requirements of this agreement. The appli'ca-n-~Sllidi ~d the
submitted Annual Maintenance and Inspection schedule to the satisfactiolrof ~'
and submit 3 original signature copies of the Agreement to the DPW. ~ ~
2. This project will be required to submit one or more Notice of Intent (NOi) to the Us~-,, '", -,_
EPA for coverage under the NPDES Stormwater Construction General Permit. A ',,_
Stonnwater Pollution Prevention Plan (SWPPP) must be finalized and implemented.
Prior to issuance of a building permit, copies of both the NOI and the final SWPPP shall
be submitted to the Northampton DPW for review and may need to be amended to the
satisfaction of the Northampton DPW prior to the start of construction.
3. The applicant shall be required to apply for separate permits from the DPW for all
proposed connections to the municipal storm drain system.
4. The elevation of the rim of the proposed Catch Basin #1 (CB #1) is approximately the
same elevation as the top of the existing 36" storm drain main located in Industrial Drive
East, which will connect the proposed drain system via the proposed Manhole #2. If
during a storm event, the 36" storm drain line in Industrial Drive East reaches capacity,
the proposed CB#1, proposed MH #1, and the outlet of the detention pond (AD #1) may
not drain effectively and may surcharge stormwater into the proposed drainage structures
on the site due to the elevation of these proposed structures. The city is not responsible
for problems and/or damage to private or public property resulting from the inadequate
functioning of the proposed drain system or surcharge of drainage flows onto the site.
The DPW recommends that the applicant review other possible drainage designs that will
not surcharge during certain rain events.
5. The drainage calculations specify Area 2 of the roof draining to existing DMH #!located
in Industrial Drive. Sheet 7 of the Site Plans specifies a drain line connecting to DMH #1
in Industrial Drive and heading in the direction of the existing building, but no
connection to roof leaders is indicated. Prior to a certificate of occupancy, the applicant
must confirm with written documentation that this portion of the roof is connected to the
municipal drain system and not to the sanitary sewer system. If any portion of the
existing storm.water system for the site is found to be connected to the sanitary sewer
system, the applicant must reconstruct the system so that all offsite stormwater flows
discharge to waterways or to the municipal drainage system in the roadways.

6. The proposed pavement in the southeast portion of the site adjacent to the loading dock
must be graded so that the majority of the pavement drains toward the paved waterway
and only a small area drains to CB #1 according to the approved drainage calculations.
7. The proposed forebay and detention pond must not be used for snow storage.

At a meeting conducted on October 24, 1996, the Northampton
Planning Board unanimously voted 7:0 to grant the request of
Jonathan Wright for a SITE PLAN APPROVAL PERMIT under the
provisions of Section 10.11 of the Northampton Zoning Ordinance,
to construct a 2,200-square-foot addition at 115 Industrial
Drive, and known as Assessor's Map #25A, Parcel 181 in accordance
with the following plans:
1. "SITE PLAN," prepared by Kuhn-Riddle Architects, dated
October 6, 1996.
2. "ADDITION FOR WRIGHT BUILDERS," prepared by Kuhn-Riddle
Architects, dated September 19, 1996.
Planning Board Members present and voting were: Chair Andrew J.
Crystal, Vice Chair Daniel J. Yacuzzo, Jody Blatt, Nancy Duseau,
Kenneth Jodrie, Anne Romano and Associate Member Paul Diemand.
In Granting Site Plan Approval, the Planning Board found:
A. The requested use protects adjoining premises against
seriously detrimental uses because the current use of the
property for manufacturing and offices will not change.
Additional office space will be added, but the total square
footage of off ice space will remain below the forty percent
allowed in the industrial park for accessory uses. Roof
drains and scuppers will collect water run-off from the
roof, and surface water drainage patterns will not change.

B. The requested use will promote the convenience and safety of
vehicular and pedestrian movement within the site and on
adjacent streets because the use will not generate
additional traffic. The required number of parking spaces
have been provided for the additional office space.
c. The requested use will promote a harmonious relationship of
structures and open spaces to existing buildings and the
natural landscape because the new building will be in
keeping with other structures within the industrial park .
. D. The requested use will add new toilet facilities. However,
since this addition will only minimally impact municipal
services, no mitigation measures are proposed. Otherwise,
the project will not adversely impact the City's resources.
E. The requested use meets the site Plan Approval requirements
set forth in Section 10.11(6) of the Zoning Ordinance.
F. The applicant has complied with the technical performance
standards as follows:
(1) No new curb cut has been requested, and the business
already shares a common drive.
(2) Pedestrian and vehicular traffic has been separated to
the extent possible by the existence of a walkway at
the main visitor entrance.

The following conditions were imposed upon the project:
1. As offered by the applicant, the applicant shall amend
the site plan to delete seven parking spaces along
Industrial Drive.
2. An amended site plan shall be filed with the Office of
Planning & Development, to become part of the permanent
file.
No waivers were requested.
Pursuant to Massachusetts General Laws (MGL), Chapter 40A,
Section 11, no Special Permit, or any extension, modification or
renewal thereof, shall take effect until a copy of the decision
bearing the certification of the city Clerk that twenty days have
elapsed after the decision has been filed, or if such an appeal
has been filed that it has been dismissed or denied, is recorded
in the Hampshire County registry of Deeds or Land Court, as
applicable and indexed under the name of the owner of record or
is recorded and noted on the owner's certificate of title. The
fee for such recording or registering shall be paid by the owner
or applicant. It is the owner or applicant's responsibility to
pick up the certified decision from the city Clerk and record it
at the Registry of Deeds.
The Northampton Planning Board hereby certifies that a site Plan
Approval Permit has been Granted and that copies of this decision
and all plans referred to in it have been filed with the Planning
Board and the City Clerk.
Pursuant to Massachusetts General Laws, Chapter 40A, Section 15,
notice is hereby given that this decision is filed with the
Northampton city Clerk on the date below.
If anyone wishes to appeal this action, an appeal must be filed
pursuant to MGL Chapter 40A, Section 17, with the Hampshire
County Superior Court and notice of said appeal filed with the
